Nice lecture. But, sorry to say ma'am that in this topic Arnesh Kumar's case is very important and the guidelines given by the Supreme Court to be followed during the arrest of the husband and his relations are too extremely essential.

After kicking me out of the house in 2 and a half months of marriage and 2 months of pregnancy, my husband filed Restitution Petition but did not serve me a copy as it was dismissed due to court office objection. And has an illegitimate daughter after 4 years of our marriage from illegal wedding.
My question is could this Restitution Petition have saved him if i had filed 498a at that point in time? What was the purpose of his filing this Petition bcoz he did not allow me even to enter the house after many approaches.
I have filed 498a n 494 but his team of lawyers are just dragging for nearly 5yrs.

Back in 2006 (I was 26 then) was convicted and had served in one of the Calcutta's prison (20/10 - 02/11/2006).
FUN FACT : I was only engaged and had filed for marriage under Special Marriage Act in court and we never were legally married. This was done to snatch our Good Old Property. Now 42, single and shall ever live in this way.

Mere filing a case against you doesn't mean that you are convicted.if The facts and merits of the case are in her favour means there is likely a chance of getting convicted . All that facts merits will go down in drain if you have a better advocate

Maybe that 2nd marriage is not valid in Hindu marriage. But marriage happened that's why seema Aggrawal case is valid for complain under 498A
