It really doesn't matter, that the whole process is sophiscated enough, while the expression of the recreation is very vaguely influenced by the original, which doesn't reflects anything critical of others' original creation.
Credit where credit's due, you're still taking someone else's work, albeit transforming it into something else. Only the owner of copyright in a work has the right to prepare, or to authorize someone else to create, a new version of that work. Accordingly, you cannot claim copyright to another's work, no matter how much you change it, unless you have the owner's consent.
@@KonradJablo I think either you misunderstand copyright law, or you're talking from the perspective of a different country. In the US, if you transform a work "enough" (and that is something that may have to be debated in court) then your work falls under fair use, and is not a copyright violation of any kind. You don't need to credit anyone either. Of course, if you choose not to credit, you might annoy the copyright owner and they sue you, and then you waste time and money defending yourself, even if you win the case. Fair use has other factors that will be considered too, like how much of the original work is being copied. For example, if you borrow only part of one frame from a movie (like the soldiers in this guy's paintings), that one frame is only a tiny part of a much larger work. So he is not copying the movie, just some visuals from a small part of it. That would factor into a judge's decision if he got sued.
@@creedolala6918 That's fair enough and I agree with the idea of taking frames from a movie being under fair use. What I failed to specify is taking the risk of cutting portions from someone elses art work, or photography and implementing it into your own piece. As art work is significantly more valuable than a singular frame in a movie, I hope you can see how this warrants my previous response. I also doubt anyone wants to go through all the legal battle, the risks outweigh the rewards in my opinion.
@@KonradJablo yeah it's wise to be careful. I would not try to cut out the face of one of the actors from Game of Thrones for example, and then try to sell a Photoshop painted version of it. It would be asking for trouble.
