    There’s no legal document you can sign that prohibits you from suing someone other than a settlement agreement

      Correct, but most people don’t realize that. So the intent is to wave it in people’s faces that they signed away there right to sue and hope they just drop it, if it goes to court it would obviously be dismissed, but it still cuts down the number of lawsuits the company has to deal with

      You can sue if you sign an arbitration clause. It's just a lot more difficult. Liability waivers require loopholes and jumping around fine print, so again, it is still possible, just very unlikely if it's air-tight.

    I remember thist story. Turns out the Lawyer for the company walked into the CEO's office and told him she would not be defending this case and they needed outside Counsel. There was a settlement, the guy got his job back and a Fair raise, an apology from the CEO, and the CEO reached out to the Company that he applied to and explained exactly what had happened. There were firings and demotions. His boss apologized, OP understood where he was coming from, but would never trust him again. OP was going to hide out in the company for a year or so and rebuild his reputation and then go look for another position elsewhere.

      @@legacyplays6050 regardless of it being proved he was innocent the label of “potential rapist” follows him everyone since somebody else told a Company higher up he was under investigation for it. If anyone asks about his history they’ll be forced to share he was accused of it and it’ll make others unsure of him. Anyone that is accused of rape will have that accusation follow them everywhere even when they’re proved to be 100% innocent of that accusation. Once it is thrown at you there’s no getting rid of it.

      ​@Alienator-999 Only if they are accused and taken to court. This investigation and accusation took place at his company, and no legal action was involved yet. No one will ever have to put "accused for rape" when talking about him. Also, the company did infact have a word with the other company as well. It isn't like all the big companies have a word with each other, so the HR department at the other company are likely the only people tha5 even know about that. As when hiring someone, you aren't really allowed to talk about their profile with the workers.

    I would have gone through with the lawsuit no matter what. They defamed you, slandered you, fired you, and didn't have the common decency to properly investigate some very serious charges against you. A lawsuit is the only way to move forward. How many people are they going to screw over in the future? How many innocent people are going to have to have their lives ruined. How many innocent people have offed themselves over a lie? Take a stand for once.

      This exactly! He's got a strong enough case to make heads roll if you ask me... Allthough I personally don't put too much faith in the system either. Once being screwed over like that would understandably make him think twice about his course of action. In an ideal world, which we already know it isn't because of this happening in the 1st place, he'd get justice handed to him on a silver platter with a case this clear.
      I'm always so extremely disappointed with the non-action taken against the people that made the false accusations in the first place. They should never ever be getting away with it and not face SERIOUS consequences. Equally serious to what he has been going through and what would have happened, had he not had the video to prove his innocence. Frankly a judge should also look at the "reasoning" of the accuser, in this case there was absolutely NO REASON for that woman to make such a serious accusation and to try and DESTROY his entire life over.. what?! All he did was have a conversation about her shortcomings and he did not even discipline her over the mistakes she made. Why on earth did that manager she talked to after that tell her to go to such extremes? From this video it seems she doesn't even know him really as they're working in different units and have no business connecting them in any way. Why does she just randomly want to destroy someone? Both women should get a very serious reality check for what they did. Unfortunately, more often than not.. these false accusers just get away with what they did. Very often too because the person that was falsely accused doesnt want to pursue anything just to stay low on the radars. As someone already said, once you're associated with accusations like that, people will spin stories, like giving the false info to that other companies hr department. Even if youre innocent, people will think where theres smoke, there's probably fire. So in an effort to keep things as quiet as possible, they won't go after anything even tho it is very very well within their rights to go and get justice.

    Non-arbitration contracts are considered null and void if the company violates the law in the process of you working there or being fired. As op was fired through negligence of the company on a false basis, arbitration is not required

OP also explained that he applied for other jobs and when he was offered one some from the old company let it slipped that he was fired and he lost the new job . Op only stayed there a year and left

      yeah. cause what is stopping them from happening again? If they are easily persuaded by a simple lie, then what is stopping them from hearing another lie about you? The person that told the IT person can easily be sued for destruction of evidence cause that camera video could be counted as evidence of what really happened.

    Similar happened to a roommate of mine. School had a 0 tolerance article 7. And revoked his deploma after he walked because of a "she said". It was categorically proven false. But they stood firm. His father had a lot of money to burn and so sued them for every penny that school was worth. He got 25mill out of the school and his diploma back. Now my roommate never has to lift a finger again in his life and still have enough to buy a plane and send 4 kids through private school and college... still to this day dont know why people would hold firm against shit like this... it costs so so so much less to take the first deal.

All the women is such disputes get no repercussions, and the men have their lives ruined. Often times with no evidence. It's almost always guilty until proven innocent in these cases, and this behavior spits in the face of actual victims. It's all to common for men to be accused with no evidence, and often times they are given the guilty verdict without evidence.

    Remember folks. YOU CAN ALWAYS SUE THE TORT FEASOR! (In this case the person who actually made the original defamatory claim.) Sue her and the rest of the company will be investigated. Then sue the OTHER tort feasor who spread it to the job OP applied for.

    I wouldn't accept working for the company again , I would increase my demand to 5 years salary at the higher rate from the date of suspension. A public apology, and a personal phone call to the 2nd employer explaining the claims made were false. Plus attorneys fees

    I never would have accepted the job to work there again. After everything that happened? Sure it was HR who was the cause of all this, but no one dared question them nor handled it professionally. I would have sued for back pay, a year of salary, and a public apology.

      OP knew for a fact that he would win the sue. just one single evidence is needed. the feed from the security camera. if the company can't show it at the trial, they f*cked up for destroying evidence. if they show it, they f*cked up since it clearly shows they knew OP was innocent.

      That being said, cameras or not the guy was a bonehead for having that meeting where nobody else could see.
      If you are in a workplace environment and are forced to deal with a member of the opposite sex then you either bring a camera to record it, or go to a place where you know their is working surveillance and make them fully aware that they are being recorded.

    Cases like these just get my blood boiling. A whole bunch of people being incompetent AF, supporting(!!!) two psychopaths that, for NO REASON AT ALL... got it into their toxic narcissistic pea brains to try and utterly destroy a completely innocent human being. Why and how someone could not only think about doing that, but actually going through with it, is beyond me. The actual chain of events after that by all the people involved in that company is beyond my comprehension as well. How is this company even run and surviving if this is how this case was handled? How did no-one even think to check those camera's? On the other hand, perhaps a good thing no one remembered those camera's but OPs friend... or with the way they tried to go after OP, I would not have been surprised if someone "accidentally" erased the footage of that day. Those two women should face some serious consequences for falsely accusing someone of something that serious. Especially if you weigh it against their motives. I mean, if they had had some serious beef with OP or issues and disagreements that had been simmering for years.. still no reason to accuse him of SA which could quite literally destroy his entire life.. but then at least any sane person would get some sort of sense of why... but from this video it seems the manager doesnt know or work close with OP and as for the employee, OP did nothing more than say something about the mistakes she made, she wasn't written up or anything at all. And to spare her from any public humiliation he even talked to her in private and then she turnes around and goes to use that against him. (Bet if he had said something publicly, she'd somehow made a stink about it too) Thank God for the camera's in that room! As for whatever steps and measures were taken after the employee made the false accusation, EVERY SINGLE PERSON involved in that process of failure upon failure should be seriously reviewed and reprimanded. This is someones entire life they just blatantly disregarded and in the end cost the company greatly as well. So as a CEO id definitely rethink the position each and every involved person has in that company including myself. If they make mistakes of this magnitude and no one is apparently keeping anyone responsible for what they're doing, then there is 100% other stuff alipping through those cracks as well. OP Is one of the good ones, but they've obviously lost him, even though he did settle for a bit with them. He rightfully never trusted them again and still left after he had his ducks in a row. In my opinion he should have gone after them full force, but alas. Many falsely acused victims, (in my opinion they are victims) wont be doing any real retaliation out of fear of making the case bigger and more public. Having your name associated with sa is never good even if its proven without a doubt that youre innocent. People will make a negative connection still and many will think: where there's smoke, there's most likely to also be fire. And so the real evil and vile ones, those making these false claims, they never face any consequences.

    A couple of times when I've wanted to sign up for an American site, I've noticed the Terms of Agreement say that the user can't sue the company and any disputes must be handled in arbitration. Every time I refuse to sign up. Better without a web service I need, than to agree to some American legal BS.
