The last thought I would have would be to sue somebody because I drove over a block wall. It amazes me how people want to blame somebody else for their actions.

I don't understand their thinking. They want to do a lawsuit because they don't have the commonsense to know the difference between pavement and greenery with plants? The only people I've seen do something like this is elderly folks, my dad did something like this at about 80 years old.

I hate to tell the little foreign dude but if there's a lawsuit it will be the rental company suing him for off roading their vehicle. I hope he bought the rental car policy from who ever he rented from. I don't know how willing I would be to touch their car after their first thought was a law suit because they are sure to drag you into court and probably blame you for some of the damages.

Jeff very tactfully (and smartly) avoided answering that lawsuit question because I'm sure that person would have no qualms drawing Jeff into a dispute (or court case) that he had nothing to do with. Now is the time to talk like a politician by saying nothing that can pin you down.

They don’t own the vehicle and he did not drive with due regard and be aware of his surroundings. No law suit. Don’t blame bad driving on someone else. Makes no sense….like wiping before you poop, makes no sense.

Pro tip:
Open zip-tie bags in the middle of the package. If you open at the top, the zip ties fall out, but opening in the center keeps them in the bag for storage/use.
This does not however, work very well on a bag of chips.....now I have Funyuns scattered everywhere. 😮

Rental companies can sue. My sister-in-law was sued by Enterprise, even with the insurance added. On grounds of negligence.
The impromptu off-roading Toyota is a clear ID10T vehicle control issue. So sad that they go directly to lawsuit when they're the ones at fault.
That is infuriating. It was their own fault; who are they going to sue? The property owners? smh.
they can't sue anyone...they don't own the car..its a rental...but I am concerned about them trying to claim that the wrecker service damaged the car.

They would sue over lack of prevention methods aka fencing, signs or barriers to prevent drivers from driving off.

yep...they will have to worry about the rental companies suing them if their car insurance refuses to pay for the damages.
@@MsJimmysgirl Car rental companies offer optional damage waivers, that are financially reasonable and cover you against _any_ damage, regardless of fault. I _always_ buy it, every 5-10 years that I rent a car!

A lawsuit? for what? a Towing fee? and a couple hours (depending how long it took them to get the vehicle off) of waiting? It would cost more to hire the lawyer then what the suit would be for.

Jeff, that Park Vista sign brings back nice memories. That's where my wife and I had our wedding reception.
I don't understand why people don't think twice about attempting to drive over curbs, grass medians, etc. while cutting through parking lots because of situations exactly like the first car. But I don't understand how he didn't see the height difference unless he has depth perception issues with his vision.
I think you were quite professional telling the vehicle renters to take lots of photographs and keep receipts and records of what occurred. That advice was appropriate and it wasn't legal advice. It certainly didn't hurt anything for them to have all the evidence of what occurred. I have little doubt that an attorney will advise them they have no grounds for a lawsuit but maybe can advise them how to handle the issue of damages to the rental vehicle they will be returning. You handled the situation quite well.
If they got the rental insurance (top tier level), they shouldn't have to worry about anything. Hope he didn't say "no" to that one.

As a former tow op all I can say is good job and you did the best you could with the circumstances that the client put their rental vehicle in.... some companies would've just hooked it and pulled it back without blocking and said "too bad, you drove it over the edge, not our fault"
I'm always impressed with the care you guys take to prevent further damage, even when a car is already wrecked. Many would just hook to it and drag it back up over the wall without a thought to what else they tear up.

As a retired lawyer I can say that there’s PROBABLY no ground for a legal claim, but never say never. ( There used to be a fence there. This has happened before. Was it night with inadequate lighting?) What is 100% correct is your advice to take lots and lots of pictures and save all relevant documentation. I can’t tell you how many times I wished that my clients had taken more pictures from different angles.

They are filming evidence that will be used against them if they do decide to sue. They are documenting the damage caused by their own negligence.

An FYI for anyone renting a car. You can temporarily add use of non-owned cars to your personal policy if you have comprehensive coverage. It will pay for the loss of use of the vehicle while it is out of commission. The insurance offered by the rental agency doesn't cover that.
They'd be better off walking - as would the rest of the world!

I don't know what they could sue for....it's a rental and it's insured. No one was hurt, and the car's insurance might even cover up to X amount of dollars for minor injuries???
And I agree with most here...that there is a visual boundary with the grass and cinderblocks between the two areas...plus there are still some metal fencing poles still standing.

Lawsuit on one or the other parking lots ? I don't know (I'm not a Latrine Lawyer) and it looks as if there WAS some type of fencing or metal poles set in place but has over time been knocked over. The plant and the grass growing in the middle should say something (that was missed) You da man Jeff, with the ramp, I didn't think of that
If his insurance covers the expense of the damage and there were no injuries involved, he has no grounds upon which to sue. If anything, it would be the insurance company that could sue to recover their financial loss. However, in this case it would not be worth pursuing as it would cost more in legal fees than the case is worth. Having spent my career working for attorneys, I can tell you we live in a very litigious society. Too many people looking for what they think will be an easy pay day. I will say this though, whoever owns that parking lot, should have a fence or some type of barrier. At night time or if it is raining hard, that drop would be difficult to discern.
To blind to drive a vehicle, let's blame someone else.

Not to be overly critical, but it would seem obvious to anyone actually paying attention to where they're going, that drops off sharply there. It's not marked very well, but it's also not hidden.

He did say that they weren’t the only ones to do that. You can see that the concrete blocks were damaged previously. There’s no sign, wall, fence or even lines. If you’re in a vehicle it probably looks like you can drive through to the other parking lot. I would think that the lots are connected with maybe a slanted driveway. There’s other factors such as weather it was getting dark.
That is why they wanted to sue, over the lack of signs or barriers
