    The brutal truth of the matter is if you do all of those things you'll be labeled a problem tenant right from the start that's just the truth. It really sucks and tenants are losing more and more rights everyday

      Bad Company 💯 % Agree, and unfortunately the local governments and court systems in the USA side with them all the time , recently they took my brother’s security deposit when he moved out (despite leaving the apartment in better condition than it was) and yet he couldn’t do anything about it , the office staff were as$Holes cause they know if he takes the matter to the court he will lose thousands of dollars $$$$ on legal fees with small chance of winning back a 900$

    The drains are not the tenants responsibility. The drains in this apartment are clogging up repeatedly and the landlord doesn't hire professionals she sends people off the street looking to make money and they end up messing things up worse than before then she tries to blame me. She doesn't accept wear and tear she thinks nothing is ever supposed to break or wear out and when it does she blames me.

      Miss Dee document EVERYTHING & when conversing with your SlumLord video tape it or record it!!!!! Call the Board of Health asap & have the Building Inspector check over all the issues you're having!! i have had & am now currently going through a SlumLord situation once again. It's brutal & exhausting however since i keep renting from slimy SlumLord's i now have a Law library card. I highly suggest you looking into obtaining one for yourself. However, you can go online to find your State's Sanitary Code as well as a multitude of other info. i live in Massachusetts so i use Mass.gov Keep strong Miss Dee & may you find the knowledge you're searching for 🌷

    What happens when they declined to do the walk through after multiple requests. Also, can they take utility bills out of the SD? They are also refusing walkthrough when moving out, “due to COVID” In MD

      Hi @Candace According to information online Maryland moved to step 3 reopening on Labor Day so if 100 people can gather one rep from your landlord should be able to attend a simple walk through. You can set a walk through time and give them notice by email or paper delivered to the office. Be sure to match the length of time if any is required for notice under the lease. Note the date and time you deliver it. If they don't show up do the walk through on your own with a friend or other person there also as a witness. Video the whole thing. The utility bills question depends upon the lease and your state law and how those bills are assigned with the utility company. Good luck!

    I’m in Philadelphia. In short, my lease was supposed to start 11/1. They gave me the approval & I moved in on the 30th & moved out on 11/1, when my lease was supposed to start. The place was dirty. Issues that were promised to me were not rectified & I was told by the leasing agent that they were & where not & when I did my walk through when getting my keys, I had already signed the lease & paid the deposit to realize that nothing was fixed. I essentially moved into a squatters triplex. I saw someone pick the front door with a card, the window was broken. Dirt & dust everywhere. Windows didn’t lock, no doors closed properly & the apartments above me had a horrendous stench. How can the owner tell me he isn’t returning the entire deposit?

      Can't really tell from here- please have someone look at the lease for a penalty or cancellation/ surrender clause. Could have ripped up the lease at the time and received refund on the spot. But- check the papers!

    In West Palm Beach FL on my move-in day I gave my landlord actually it was the property manager cash payment for security deposit. First and last months rent was already paid including $100 application process fee. On my security deposit receipt she wrote non refundable. I was also told that the security deposit will not be place in an escrow account and I will not be getting any information on that. And they did not do a walk-through with me. I did however get a form to fill out on my own and they picked it up while dropping off a copy of my signed lease... Is this Legal? 🤔

      Hi @Ana can't give you any specific information without seeing the lease etc. For that seek assistance from an attorney in your area. Generally the nonrefundable part about the security deposit does not jive with Florida law which provides for time and notice after the lease is up to advise the tenant as to what part, if any, would be kept by the landlord. However it might be that you agreed to this in your lease document - if you did not agree to this then it would be best to make your position on this known to the landlord. Also check your lease for the required notices on prepaid items and how those will be retained etc. Give them a chance to correct their mistake. Maybe the person you dealt with was not properly trained or is new.

    Can a landlord charge you a paint fee if you have lived in a unit for 3 years or longer? Also, how do you prevent them from charging excess cleaning fees?

      Hi @Renaissance - always check your lease for what can & can't happen - that's where you would write in language to restrict or further define what will/won't be charged. Beyond that it depends on the laws of the place where you live.

    What if landlord moved out of state and does not respond to letters requesting return of security deposit? Small claims court would not help since landlord is out of state, putting a lien on the property may not help for years.

      Hi Missy. Service can be made out of state on the person - or if it is a company on a representative in state - if the amount is significant to you it is worth consulting with an attorney. Hope it works out!

    Can landlord keep security deposit if tenant failed to give a written 60 days notice ( tenant gave 3weeks verbal/phone notice instead) as requested in contract? Tenant met all other contract requirements including last month’s rent and no damage to property.

      Hi @PomPom Each answer is different depending upon the terms of the lease agreement and the state law. Also the parties may make agreements to modify their original agreement.

      HI @Mosae there should be a requirement for this in the lease that sets out the way to arrange it - or your state law may have a provision that will help. Follow those directions and then coffirm when you will be doing it and give them notice and make a video and have a witness - when in doubt document everything.

    We moved out about 30 days ago due to the owner of the house passing away and we needed to vacate the property per landlord. We had to return keys back at their office, landlord did not do the walk around with us on the property prior to us giving the keys back. We have called and e-mailed landlord asking when we will expect our deposit back and there hasn't been any response. What can we do?

      Good question Jamaal- it is up to the landlord and the tenant- so long as the agreement is legally enforceable you can agree to what works best for you!

    The best way of handling this is to never think you're going to get your deposit back the information you gave us is legal in actions and it don't work too much in a courtroom nobody has the time if you don't get nothing in the end of the day totally waste

      Nah, I've always gotten every penny of my deposit back because I make sure the landlord knows I'm willing to go Karen af, I've got all my receipts, and I will take them to court if they are even a day late returning it. I will literally email and call every day until they give it back. Landlords want to avoid court too, so stand up for yourself.

      If the check did not clear it can be stopped. Normally there is not any payment made until the lease is signed. Small claims court can help if this cannot be worked out amicably.

    I moved into a new apartment and we made the mistake of not waiting to see the inside (granted we didn't have the time) they claimed it was ready to live in but there is still lots of construction not just repairs

    I have a landlord trying to charge me for spiderwebs. I know I cleaned out everything in my apartment they they are saying I left pots and pans and I asked them for pics but they refuse! I paid a $1100 just to get $300 back. I know for a facts a few spider webs, base board and pots and pans (which I did not leave) is a grounds to take $800! Plus I never got an invoice or anything of what needed to be done and I understand they have 21 days to do so. But I moved out a month ago and just now getting back to a manager. Is the grounds for small claims court

      Mines is worse, i paied 3500$ and im only getting back 200$… i had left everything good condition and guys is saying things are missing when they werent… like what lol he is saying paint and flooring was damgaed when me and my family cleaned before leaving and ‘damage’ was normal use ! I keep trying to contact him but everytime i text he doesnt answer, i call and he clicks like what should i even do at this point?

    I don't have my former landlord address. I am unable to send him my forwarding address and he is not returning my deposit. What should I do?

      Hi @Manjinder You will need to find the address for the landlord. It should be on your (a) lease (b) check that you paid for the security deposit (c) any statements or letters you received while you were a tenant. Then make a formal demand in writing and send it by certified mail or fed ex etc to prove delivery. If they don't pay then you can file suit in small claims court all by yourself. The Courts have those papers available for you to fill out and file.

      Hi Natasha - that depends on where you would be suing- each state has different time limits. For something like this you should file within the year from when the money was due back to you- the sooner the better!

      Then it would be a he said/she said situation- It is the landlord's burden to show damage beyond normal wear and tear. Pictures of the place from the beginning vs the end would help to have ready in case they are needed.

    I'm waiting for 10 months to get my security deposit back.
    They leasing office has weak Managment and they really don't have one manager to get my work done, every time I got to leasing office I met new manager which I have to give my info again and again

      Check your lease- does it specify when (a time frame) the deposit should be returned? Sounds like they are dodging you. 10 months is too long. You may need to file a small claims case with the court. The filing fee should not be very expensive- the court should have the forms for you to fill out. Once they are served they will probably pay you.

    My husband and I rented a house for 5 years. I asked the realtor agent for a report and the status of our security deposit 2 weeks after we moved out. She asked for my address to send it to me certified. I get an envelope and get a notice with no check in it. I proceed to read and it says we owe versus we are owed. I was confused because we had an inspection about 2 or 3 months prior and everything was the same way we left it. I sent an email and text to the realtor to speak about the notice, she usually responds quickly. Not this time. When we got the house we had to deep clean the carpets, 4 rooms total, the stove and the fridge. Apparently it had already been clean. I also deep cleaned the shower. I was confused when I saw everything because she mentioned it was move in ready and had been deep cleaned. Anyways on the last day we just had to clean and we're waiting on her in the morning to go through a walk through and she came and said she didn't want to be in our way and will do it tomorrow since her son was the one moving in and we could finish tomorrow not to worry. I called her when we were done and she said she was with another client and would look at it the next day. Didn't hear from her until I reached out. Funny thing was when they sent me a new lease Agreement I didn't sign it because the lease agreement was absurd. They were asking for a fee of $250 for deep cleaning from our security fee and other crazy things. If I didn't sign the lease agreement am I still liable for absurd fees?

    I rented month to month (only a 4 month lease), they never gave me a copy of the lease I signed and now they are ignoring my requests for the security deposit. I have all of my payment records and the conversation about how much the deposit is. I also have footage from when I lived in the unit. Can I fight this?

      Hi @gravijiga Return of the security deposit is usually specified in the lease or in the state law or sometimes in both. Suit to recover the security deposit can often fit within the shorter time frames (and so quicker process) of small claims court. Check with the clerk of that court for the limitations of amounts so you file in the correct place.

    It's better to make a video perhaps. I moved in to an apartment and didn't realize that the toilet was rocking and had a broken bolt. I had to fix and some other stuff myself. I scrubbed the apartment bunch loads and made over a dozen videos and pictures. They said we will mail you the security deposit reimbursement in 30-60 days. I had to drop off the keys in a drop box on Sunday. But I have a bunch of videos and photos of damage and repairs. It they tried any thing funny it seems like I will win in court for sure. 😊 What is the time limit on the security deposit reimbursement?

      The lease should have the timeline. If it doesn't then most states have a law on residential landlord and tenant matters which specifies a deadline. 30 days is a common outside date.

      Ok, thanks. The woman that did the walk around was pregnant and that was a couple of months before she went on leave and I never saw her again. So the person that did walk through at first didn't even work for the company 4 1/2 years later when I got a non lease renewal.

      Section 8 helps pay the landlord the rent as a subsidy but you should still have a lease and it provides for the security deposit return just like everyone else. At the very least send a written request. If Section 8 has counselors who will help you please call them and ask for help.

      HI @Maura- give them a written notice of the date that you will be vacating and the days/times you can meet for the final walk through and to deliver the keys. if you are getting out before the very last date that is best because then you have a couple of days to play with to arrange a time to meet and do the final walk through. Read your lease and if there are any provisions in there follow them to the letter. Let us know how it goes. Just make sure you have written confirmation that you 1. gave notice you were moving 2. offered dates/times to do the walk through 3. complied with any particular things in the lease and 4.that they refused or stonewalled etc. Also take pictures/video and have another person with you at the joint walk through or if they refuse then do one on your own.

      @@FinelyRevealed so they did and I had to resort to emailing. And I ALREADY handed in my keys. I took photos at the time I turned in the keys... they wanted to do it 5 days post... then wouldn't call today to reschedule for tomorrow. So I just wrote them an email explaining I have tried on several occasions... I have work order copies.
      All and all I have a terrible feeling.

      You've done your part Maura- check your lease for any sections there for (1) ending the lease (2) moving out (3) giving possession back to the landlord/owner and (4) getting your security deposit back. Also- In what state is this property located?

    What she didn't say and I can't believe most lawyers/solicitors do not say this on videos when doing these videos is....the Landlord must put the deposit in a deposit scheme if it's a shortheld tenancy, i.e. if it's 6 months to a year tenancy, and same if the tenants live another year or more, the statutes still implies even if no tenancy agreement has been signed again for the other years to just roll in.
    Before you sign the tenancy, ask for the deposit scheme certificate and if the Landlord hasn't got one, they are going to screw you with your deposit. The statute was put in place due to Landlords who were withholding deposits and using any kind of excuses. Now the Tenant can ask even if you're a tenant right now, and do it by email, everything by email, that you want to know if the Landlord deposited your deposit in a deposit scheme. They cannot ignore and must comply in answering. If they do not answer this is against the law, if theythey didn't put your deposit in a scheme, same thing. The tenant can win and get their FULL deposit back plus, 3 times as much added and the landlord pays for cost fees.

      Thanks so much for this @OneDarkAngel - here in the US the individual states have separate rules- some require the deposit to be held separately and some not and in other situations the contract of the parties can determine the rule so we try not to give specific info and call it general so as not to confuse anyone or lead them astray. This was so helpful!!

      Thanks for the information. Very helpful. In USA I feel there are bigger problems. Increased rising rent. I was surprised how much Landlords can bump rents really high. My friend who moved to USA is struggling there, trying to study as a doctor with ever increasing rent. Interesting the difference between usa and uk. I can't imagine the craziness if studying statues or laws of different countries. Thanks for extra information, helps a lot.

    What about this scam :
    There will be these actual apartments for rent and I did get to take a look at the unit. There was about 24 units in the building. So I turned my application into their office and gave them half my security deposit. All this was done in their office. Their office is right in the same building as the units. Well turns out they deliberately sat on the paper work and never bothered to rent out the new unit to me. They let this go for about 3 weeks. I called them and asked for my sec dep back as they were not serious in renting to me. Well then they fired back saying I forfeiting my sec dep because of this unbelievable reason " well we were holding the unit for you" WTF.
    So im trying to get them on check fraud charges because they took a check from me for that deposit.
    Is there any other legal recourse for this new type of security deposit fraud?

      HI @Lextacy2008 there are some criminal complaints regarding bad checks etc that you might be able to explore. If those don't work or aren't applicable where you live seek an attorney's assistance or if the amount is small enough you can sue by yourself in small claims court if the money should be repaid to you. First make sure that you can't cancel the check with a stop payment if the check was never deposited.

      @@babydoll6280 Filed small claims and won by default. They never showed up to court, OBVIOUSLY they were committing a crime so they never wanted to be in front of a judge. That was a good day! And they sent me check right after being informed of the default judgement.

      Hi @Nicholas Section 8 covers who pays the rent- there should still be a lease setting out the rights for the return of the security deposit and the same process described in the video would be what you do.

      Hi @FfMm If you have a security deposit simply video the place after they vacate if they won't walk through with you and then settle up on any damage or refund in writing. Hope I read your comment correctly- if not please clarify.

Heis running from payment after damaging the premises and I have to get the sale deed from my family who has been dealing with him and have put my child under this misery. He is pulling a fast one, and should pay before he leaves,as this money is my survival. I have lodged a complaint with the police..waiting for their support

      Yes Punkin a camera will work but make sure that both sides agree on the date and condition that is represented! The written signed checklist is usually easier to keep track of.

      I have a resident threatening to sue for her deposit. She took a grainy video and neglected to open drawers and cabinets in the process. I took pictures showing she left tons of drinking glasses and liquor bottles. Also, a lot of grocery bags silverware and debris in drawers and lower cabinets. Also dozens of Mardi Gras beads tangled in a chandelier. Not to mention a sofa I have to hire someone to come move and dispose of. She claims this is all included in general cleaning. Should I worry about losing this case? It's only a $200 deposit.
