@@redrambler2000 yes they do. All buildings have them. For personal living space, they aren’t something you post, but they exist on file with the city, even if it’s as just a note in the computer. It’s basically a catch all term that says people can live there. It can come in any form these days. And yes I own a house and yes, when I moved in, I was granted an occupancy permit. It was in the closing material I signed.

Renting a room is typically long term primary residence, Airbnb is much more overnight/transient. People typically run background checks on room renters, the owner is often living in the home as well to supervise, etc. Airbnb... Not so much. Really not much of a comparison.
The former owner has no rights to the property. He sold it. The new owner can do as he pleases, as long as it is within the bounds of the law. So, it's really not the old owner's business.
airbnb is a commercial business and the surrounding homeowners in this residential neighborhood do have the right to demand adherence to zoning restrictions and threats to their own safety that a commercial use may infringe on them.

While I agree with your general statement, you are incorrect about one thing: Code enforcement DOES have business going in there, regardless of zoning status. It is a residential home and even if it becomes akin to a short term rental complex (Which is essentially what the new owner is doing), it is still zoned as residential. Code enforcement is there to confirm that there are appropriate measures taken to ensure safe housing, EVEN if it's "short term". i.e. Fire exits, closet space (In many states it MUST have a closet attached to be considered and therefore rented as a bedroom), etc. There are a lot of residential codes that must be adhered to even for the standard person, which is why apartment complexes often have "inspections" to verify these codes aren't being broken by tenants. (And if they are, to allow the landlord to evict said tenants before they get in trouble themselves)
Well, there are ordinances. You can't just change a single family home to a hotel. The insurance company will also require commercial insurance versus a regular homeowners policy. And even the bank may get involved if he has a mortgage. Bcse there are different requirements for a sfh vs if the home is a secondary home or business. It's going to be hard to just pitch it as an airbnb if he's creating a parking area w lines. And that neighborhood is likely not zoned as mixed use. This was obviously done by someone who has never owned property. In my area airbnbs or any rental < 30 days are not allowed.

There is no housing shortage. There is government intervention and regulation which ends up increasing prices. There's also government mandated 'rent control' which prevents landlords from raising prices to cover costs, thus repairs don't get done in any timely manner and once-decent apartments become slums.

It is a Single family home, no matter if it has 12 or 2 rooms. NC does not call it a Multi family dwelling unless it has multi[ple entry doors and apartments. The "Rooms" without a shower, kitchen or toilet, can not be considered apartments, so, the rooms in the house, are just, rooms for rent..

NC is a Right to work State. This is not only aimed at employment. As a homeowner, I can make any changes to the interior as I deem fit. Any work done inside the home, "Under the direction of the owner" is legal so long as the Owner resides in the home for 1 year after changes. Additions and changes to building footprints on the property are the usual factors that require a permit.

Well, since they are family homes turned into Airbnb, they almost all are LoL Some states require that they are lived in full time to be able to rent out rooms
This homeowner is screwed, you can't just convert a single family dwelling into what is essentially a boarding house without city approval and some areas are simply not zoned in a way that allows it. The contractors are also at fault for not getting the permits or allowing required inspections. Now the city will get a warrant and any chance of an approval to redesignate the property from single family dwelling to a boarding house even if it was possible is pretty much toast.

This is a single family home being converted into a multifamily residential. You not only require permits to do that but the zone the structure is located in needs to be zoned commercial or dual zoned commercial/residential because multifamily residential properties are viewed as commercial properties. If the area the home is in is not zoned commercial that area would have to be rezoned in order to convert the home.

is this neighborhood not zoned as limited to single family homes or is it a commercial zoned area? We are also dealing with a similar situation but in a rural area with few zoning restrictions. Our issue is that the new owners are currently renovating the old log home for airbnb use and using our driveway (former owner had a right of way but new owner did not contact us and right of way is not grandfathered) and our beautiful and scenic farm acreage surrounds the 5 acre parcel they own and perhaps the possibility of hiking or hunting may be the draw the new owners are hoping for to attract customers. . We have had trespasser issues in the past during hunting season so we will paper our acreage with No Trespassing signs, and perhaps need to hire a lawyer to settle the driveway issue. Airbnb is a commercial use of a property and should be treated as such and not jeopardize the safety and rights of neighbors.
I live in a college town. Rentals are the norm. Everyone rents out rooms in their homes, converts garages, ...parents buy property for their son or daughter to live in while going to college...then sell it when they leave. During Commencement week, homeowners rent out their homes for big bucks and stay with friends or relatives!

While I agree with your general statement, you are incorrect about one thing: Code enforcement DOES have business going in there, regardless of zoning status. It is a residential home and even if it becomes akin to a short term rental complex (Which is essentially what the new owner is doing), it is still zoned as residential. Code enforcement is there to confirm that there are appropriate measures taken to ensure safe housing, EVEN if it's "short term". i.e. Fire exits, closet space (In many states it MUST have a closet attached to be considered and therefore rented as a bedroom), etc. There are a lot of residential codes that must be adhered to even for the standard person, which is why apartment complexes often have "inspections" to verify these codes aren't being broken by tenants. (And if they are, to allow the landlord to evict said tenants before they get in trouble themselves)

It's going to be hard to just pitch it as an airbnb if he's creating a parking area w lines. And that neighborhood is likely not zoned as mixed use. This was obviously done by someone who has never owned property. In my area airbnbs or any rental < 30 days are not allowed.

There is no housing shortage. There is government intervention and regulation which ends up increasing prices. There's also government mandated 'rent control' which prevents landlords from raising prices to cover costs, thus repairs don't get done in any timely manner and once-decent apartments become slums.

NC is a Right to work State. This is not only aimed at employment. As a homeowner, I can make any changes to the interior as I deem fit. Any work done inside the home, "Under the direction of the owner" is legal so long as the Owner resides in the home for 1 year after changes. Additions and changes to building footprints on the property are the usual factors that require a permit.

In short, the Right to choose, to work, live and exist, in the Privacy of our own home, is a fundamental Constitutional Right.

you can't just convert a single family dwelling into what is essentially a boarding house without city approval and some areas are simply not zoned in a way that allows it. The contractors are also at fault for not getting the permits or allowing required inspections. Now the city will get a warrant and any chance of an approval to redesignate the property from single family dwelling to a boarding house even if it was possible is pretty much toast.

There are single family residential or multifamily residential classifications for the structure itself . This is a single family home being converted into a multifamily residential. You not only require permits to do that but the zone the structure is located in needs to be zoned commercial or dual zoned commercial/residential because multifamily residential properties are viewed as commercial properties. If the area the home is in is not zoned commercial that area would have to be rezoned in order to convert the home.

Our issue is that the new owners are currently renovating the old log home for airbnb use and using our driveway (former owner had a right of way but new owner did not contact us and right of way is not grandfathered) and our beautiful and scenic farm acreage surrounds the 5 acre parcel they own and perhaps the possibility of hiking or hunting may be the draw the new owners are hoping for to attract customers. . We have had trespasser issues in the past during hunting season so we will paper our acreage with No Trespassing signs, and perhaps need to hire a lawyer to settle the driveway issue. Airbnb is a commercial use of a property and should be treated as such and not jeopardize the safety and rights of neighbors.
Sadly air bnb is legal and if that driveway has been used for a certain amount of time you're screwed

I live in a college town. Rentals are the norm. Everyone rents out rooms in their homes, converts garages, ...parents buy property for their son or daughter to live in while going to college...then sell it when they leave. During Commencement week, homeowners rent out their homes for big bucks and stay with friends or relatives!
I would be scared for this neighborhood! Can you imagine all the druggies and prostitutes coming in and out of this place. $23 a night screams trouble.

I have to side with the new homeowner. I do understand the concerns of individuals that may or may not move in. We have the same problem in low income housing. We do not say; “ We do not want the person you just released from a decade prison sentence in our neighborhood”. I understand those people paid more not to have that problem. When you paid more it left those in poverty with that problem. Besides fighting poverty. They also have to fight crime, food deserts, immigration, low pay, job opportunities, eduction etc… It’s time we all take part in this American Dream!!!
