Why doesn't the prosecution support the motion to remove the judge? Any conviction is going to get overturned on appeal. The government has a duty to make sure that any conviction survives appeal and this is one of the very few rare cases where appeal is likely to eventually be successful.
They don't care so much about the appeal because an appeal means they got a guilty verdict. They only care about the wins. Same with the Judge. He's elected so it looks better on his record to show "convictions", and then blame the appeals court for overturning it. Not to mention, both the Prosecutors and the Judge get paid anyway, so recharging and having another trial is fine with them. There's probably misappropriation of some funds along the way, taken from the funding of this case.
Because this trial is taking up a significant amount of money and it might result in a reduction in their pay if it has to be retried. And they probably only have to focus on one case because this is taking up all their time. Thats way less stressful than juggling multiple cases
