  • Alec Baldwin's attorney in his involuntary manslaughter trial for the shooting death of Hannah Gutierrez-Reed on the set of the movie "Rust" is seeking to have the judge dismiss the case after prosecutors presented surprise evidence on Friday.
    Judge Mary Sommer dismissed the jury early on Friday following a hearing outside the presence of the jury, which raised new questions and prompted additional testimony.

      You certain… the state/govt. can’t retry? Seemed fishy from the start ruling Baldwin could only be considered an actor, jury not to consider his role as a producer with any role in assuring a safe work environment.

    Deliberate non-disclosure of exculpatory evidence is grounds for dismissal, but how would these similar cartridges serve to exculpate Baldwin? That's the real question, and no, I don't know the answer. And were they "concealed" by the prosecution or police for a reason? Plainly the trial judge thinks that at a minimum they may be relevant, and she's walking point for We the People.

    there is no way that alec baldwin is responsible for what happened. period. he did not bring the live rounds in, or load the live rounds.

    Of course she’s not happy with the prosecution. They ran rough shod over Gutierrez-Reed when it was obvious that Kenney tried (successfully) to throw her under the bus when there’s a dang good chance he was responsible for the live ammo making it on the set. Popple allowed him to orchestrate the narrative and just like a typical state worker doesn’t like it when someone questions their job performance AND points out their various and sundry shortcomings and shoddy (if not nefarious)work.

      He would have never been convicted either way. Besides the ammunition issue, there are issues with the gun in question, having been destroyed by the FBI, and then the tests done by the DA prior to that, proving the gun could indeed be fired without pulling the trigger, because it had been modified.

    Far as I have read and heard in interviews.. When you're shooting in a movie you NEVER point a gun directly at actors or anyone off camera for safety, you point it so it LOOKS like you're pointing it at the target while not actually pointing it at anyone... While the prop master is responsible for live rounds, the actor is responsible for following basic standard safety guidelines on a movie set... It's literally part of their job..

      OK. If so then the failure of that actor hardly rises to criminal conduct. Its a civil wrong for which the insurance company has or will be paying a very large settlement given the girl has already been convicted and that is one of the covered risks. Baldwin can be a tool at times but this has been more a political prosecution than anything else. And by this I mean prosecutors are so often motivated by the limelight than truly doing justice.

      I'll try to explain. Alec Baldwin's team claims they didn't receive all the evidence from the crime scene before the trial ( they have a right to see it). The crime scene technician who collected the evidence turned it into the police with a case# for the case against the armorer (Hannah guiteriez) but didn't indicate it was also related to the Baldwin case. So when Baldwin's attorney went to the police for all the evidence, some of it wasn't provided. The crime scene tech tried to say the evidence wasn't related but then the judge herself went through it and found bullets that were involved.

    DISMISS THE CASE ....?? I knew this was coming. Baldwin IS guilty of shooting that Cinematographer, plain and simple. That six shooter did NOT fire itself. The charges in this case need to be re-worded, but Baldwin still "pulled the trigger" ....

    Who was holding the gun? Who should have checked the gun to make certain that it was properly loaded? Who pulled the trigger? Answer to all of these questions is the same: Alec Baldwin. Now a woman is dead because of his action. You decide his guilt.

    I watched the hearing... That's not entirely true and nothing was mishandled... Someone with a motive to mislead in the case came to the police station (more than 2 years after the shooting) and turned in some ammunition supposedly related to the case and that was documented but not put in with the evidence in the shooting cases. The "evidence" is logged and still with the police. The problem with the police/prosecution using or investigating as part of this case is the amount of time that has passed, chain of custody issues, and the questionable source. That doesn't mean the defense couldn't get access and investigate. They didn't do that because they know it won't matter for an acquittal so they are try to make some sort of inference that the handling of these rounds were improper and therefore not disclosed.

      they are not the most common brass , but they are by no means rare. I like how they tried to get 3 year late evidence into the record. edit I just checked and they are a very common brass my dad has like 500 of them in his safe right now

      If you watch the video, exactly the same type of bullets that were from the set "suddenly" appeared in a box a witness brought to the police and were filed under another case number. No disclosure to the defence about it, which is weird. They mess it up and try to cover up their mess

    The obligation to turn over exculpatory evidence is a broad one. Anything that could possibly tend to show the defendant may not be guilty is required to be turned over. No cop or prosecutor can make that call except at their peril and that it was put in an unrelated case file kinda reeks of intentional misconduct. The court has already determined Baldwin was an actor and not producer suggests even less responsibility for independently determining the rounds were not live. I think he skates on this and the young lady armorer simply made a grossly negligient mistake. Its a shame a life was lost but I'll bet the insurance carrier has already paid a substantial sum or will be soon.

    This trial is absurd. Gun saffety is not the actor's responsibility. It's the armorer's. They're literally hired to take the responsibility off the actors. Some people are method actors, if they're playing someone ignorant of guns, they're suddenly supposed to break character to be a gun and ammo expert? This is insane. he did absolutely nothing wrong. The armorer did, and whoever tf brought live ammo onto a movie set. That is clearly negligent.

    Okay, throw the case out WITH prejudice. Let all the evidence be made available to the defense.
    Bottom line is if it's thrown out, we know it's based on a technicality.
    Doesn't change the fact he lied about putting his finger on the trigger of a single action revolver that was in the fully cocked position.

      All evidence has to be turned over to the defense, period. It doesn’t matter if it’s irrelevant or ruled inadmissible, defendants have a constitutional right to every single piece of evidence the prosecution has in their possession. Moreover, a judge can’t just rule something is inadmissible as a way to sweep the fact that the prosecution violated discovery law under the rug AND there has to be a motion to suppress evidence. Did either side do that here? Nope.

      Everyone is entitled to a fair trial, procedures on both sides have to be followed. The prosecutors messed up which is a violation of the defendants rights. We still don't know what the Judge will decide.

    Criminal Charges should be dropped against him... he's not the person responsible for this shooting, the armorer was.
    HOWEVER
    The family should bring Civil Charges against him... I can see him being responsible for the negligence on this set.

      @@scillyautomatic I try not to judge the entire population based on RUclips comments. I think as far as commenters go this is like everything else and relates to politics. Conservatives think he is guilty, and are correct in this case, but only follow the case because they are anti Hollywood.
      Liberals want him to go free, and are wrong in this case, not based on facts but because they know conservatives are against him.

    He is guilty he publicly admitted he pulled the trigger more then once and blamed the armor for it but he did and is also responsible to check the weapon and he did not.

      The armorer's job is to ensure safety around some props, that's literally their job.
      The armorer has been charged and convicted.
      The actor has had his trial dismissed.

      I'm entirely convinced you won't find any because it doesn't exist.
      He was not required to do so, because it's literally not his job. He was not even qualified to check it, he wouldn't be able to tell the difference between real ammo and blanks, so it's not even within his competences but it'd be useless.
      Him pulling the trigger on what was claimed to be a cold gun is not enough to warrant criminal charges, whether you like it or not.

    If the ammo is different and not from the set. What are they worried about. The prosecutor isn't using them in the trial so it irrelevant. But defense attorneys have to play the game and put doubt in the jury's minds.
