      Nothing will happen to them and it is very hard to prosecute someone under 18 U.S. Code § 242. There are several boxes that need to be ticked and the hard to prove that they had a full understanding of the rights they violate. To prove it, the attorney would have to point to some specific training on civil rights that covered this, even though everyone should know the first amendment freedom of speech, but that is not how it works. They have to prove in court that the cop understood that what the victim was doing was legal but chose to violate his rights anyway. The cop can be sued because that is a civil action, but even here, the cop won't pay any money out of pocket. Small cities usually have insurance that will pay on behalf of the city (which the taxpayers pay for), but in this case, the amount being asked is small enough that they city would pay it directly out of the general fund, to be reimbursed by taxpayer dollars. (Also, the DOJ would not touch the criminal case unless there was some more serious issue, such as the use of force when the officer knew that no force was called for. For these cases, the DOJ rightfully believes that the civil court is the best place for the victim to receive relief under 42 U.S. Code § 1983, which is the code that Jeff will sue under, and that case will be a slam dunk. The city would be crazy not to pay and comply because taking the case to a jury could mean that they have to pay a settlement and all of the legal expenses that the plaintiff incurs. Because he only asked for $1700, it is likely that this is all he would get, having expressed in the intent to sue letter that he thought that this was what the damages were, but again, the cost of a jury trial would likely be more than the $1700 being asked. City would be stupid not to settle. But nothing will happen to the cop.

    PLEASE keep filing lawsuits against these tyrants! It's the only way they will be held accountable for their illegal actions. Personally, I would go after them for much more than the symbolic $1791 you're asking, so the taxpayers in those cities can see how much of their money is being spent to pay for the wrongdoings of ego-driven narcissists, but anything is better than nothing!

      Maybe a final stipulation in the intent would be to add $1791 for every item in there that the city does not intend to honor.. otherwise there’s no pressure on them. Dunno if that can be done or not but better that the city knows up front the cost of denials…

      Officers/officials have been known to say Jeff is only doing things for himself, like getting more likes or money. They think that not citizens but officials and clergy should handle helping the public cause or people because.... they know better.
      But back in 1791, they added the Bill of Rights to the constitution because the British used similar excuses to undermine revolts. Jeff insists he's not after money for himself, even though he could be.
      When Jeff suggested the city of Forrest should help the cause they were fighting against, it was a smart move. It's like saying, "Hey, instead of wasting money on lawsuits, why not pitch in to fix the problem?"
      Cities that pay big money to settle rights violations don't seem to learn. Even if they pay millions, it doesn't always make people angry enough to push officials to do the right thing. Bad press, public shaming, and teaching people about their rights can make more of a difference.

    Here's the DEAL, if cop's had to pay out of pocket for the mistakes they made, they would educate themselves to make dam sure they do the job right. But with the whole qualified immunity and let the courts sort it out mentality and the taxpayers paying the bill, nothing will ever change.

    I can understand you not wanting to punish the community financially for the corruption of the leaders and LEO, but in a government of the people, by the people, and for the people, aren't those same people responsible for allowing the corruption in the first place?     You should be suing for more money to contribute to the Homeless Vets. There's a lot of them out there and more money could go toward making them not-homeless or providing more resources for them. Take a salary out of the budget for these locations and they'll take it more seriously.

      I believe you’re asking the wrong question friend. We should be asking…why does our gov continue to allow these blatant violations? There are literally thousands of videos such as this one uploaded to the internet. The Officer even admitted he knew what Jeff was doing…and he still violated Jeff’s Rights. Why? The Officer knows at most he will get a reprimand of some sort. He is a shielded agent of the local gov. If there’s a lawsuit…it will come out of the public coffers not his pocket. The system is set up where the public officials (including LE) are protected with little to no accountability. That’s why you rarely see and jail time nor will you see it anytime soon. The actions of this Officer are exactly what those in power want. What other rational conclusion can one come to? I once believed it was due to a lack of training or ignorance but it isn’t…as the trespassing Officer demonstrated first hand. Thanks for taking the time to read this. Take care

Thank you so much for letting us know what’s going on and for sincerely trying to bring change to our communities without seeking monetary damages toward the communities. Of course, I understand for a lot of auditors, there is a lot of time, effort and money, put it into their efforts to bring about change, and sometimes monetary damages toward those communities have to be imposed or some of those communities will never learn.     Hire a surveyor if it matters or if it might help. The sidewalk is most likely not part of City Hall property. It’s probably part of the road right-of-way.
