The times on the BWC and dispatch logs don't match or make sense, especially the supervisor who literally arrives in 2 seconds according to the logs and officer 1 BWC shows him walking 10+ seconds before he arrives. This isn't trivial, these are legal records and it's inexcusable to have time discrepancy

While I am not American, I am Australian but I enjoy RUclips videos and Jeff’s are amongst my favourites, but the thing I noticed about these and other auditor videos is the complete lack of knowledge that police have in regards to constitutional rights and the Constitution is the cornerstone of their democracy. @@garyholt4445 exactly. law enforcement training here in the US is short - weeks, not years. And most of the training is physical - wrestling techniques to gain control immediately. and then verbal 'do what I say' regardless. Training in the law itself is simplistic and mostly on-the-job. Individual rights protected by the Constitution are skipped over completely in favor of the officer being in control at all times for 'officer safety'.
This is not poor training, it is the training that law enforcement agencies want. For example, the will train officers to get the ID of everyone they interact with , even though it is a violation of the 4th amendment to compel someone to ID unless there is reasonable suspicion that the individual has committed a crime (in some states ) or has been lawfully arrested. The theory behind this policy is that the more IDs they get, the more likely they are to find people with open arrest warrants. You will see cops threaten to arrest people telling them they have to ID, but that is actually a federal crime, though no cops are ever charged for it, but there is federal statute that allows you to sue the cop and the PD if they force you to ID under threat of arrest under color of law that is an easy lawsuit to win and cops do not have qualified immunity for this (42 U.S.C. § 1983). The police don't really care if they get sued from time to time because the city almost always pays the settlement and it comes either from insurance or from the general fund, so nothing really happens to the cops and they believe that having the policy is tough on crime. That is what is happening with police training. It is the way it is because police leadership is tough on crime, even at the expense of breaking the criminal law, 18 U.S. Code § 242, to achieve their perverted goal. So the taxpayers pay for a system that breaks the law to serve them in the goal of finding the occasional bad guy.
I wonder about that. It should, without doubt. In this instance at least those two officers should know now that panhandling can't get you trespassed from city property, but I just wonder if they would eagerly violate the rights of someone the following week, someone not as knowledgeable as Jeff.
Cops dont care and arrest lawyers for following the law simply because the cops disagree. We dont hire intelligent people to do these jobs we hire morons that follow orders without thinking.

There's not a single cop in the United States that takes their oath seriously. If they did, you'd see cops standing up to those who violate the constitution daily. There is no qualified immunity for violating clearly established constitutional rights. Carrying a sign, even with profanity on it, on a public sidewalk was ruled a constitutional right long ago. The cop doesn't know this because they were not trained on it, and there is no incentive for them to be trained on it (sometimes there is, but that is a different story and is the result of a DOJ assessment to see if it is systemic in a department). If they were to have arrested Jeff, Jeff would have sued and won, but the cops don't care. The city taxpayers pay for the insurance or the money from the general fund to pay the settlement (and this would be a slam dunk case). This case had nothing to do with qualified immunity because qualified immunity does not protect a cop against violating clearly established constitutional rights. Jeff said he would lose it, but in this case, he would never even have had it, It was already lost in previous Supreme Court Rulings.
I suspect the older cop has a decade or two serving in law enforcement, so the fact that he doesn't understand the First Amendment is scary. He will, I'm sure, continue to violate the civil rights of citizens, mostly fueled by his ego.

Jeff said the cop would have lost his qualified immunity, but the fact is that there is no qualified immunity when it comes to clearly established constitutional rights. The thing though is that had the cop arrested him, Jeff would have sued both the cop and the city, and he would have won because the Supreme Court long ago ruled that holding a sign in a public forum, even with profanity on it, is protected under the 1st Amendment. The thing though is that the cop and the PD would not pay a penny out of their own pockets. In this case, my guess is that the city has an insurance policy to pay out in the event of city employee misconduct and the settlement would come form that and not the police officer's wallet or the PDs budget. In other words, the taxpayers are punished, not the wrongdoers. Since there was no lawsuit (and even if there was) there really is no incentive for the PD to get all of its officers in a room to do civil rights training, and they continue to do what they have always done. This particular cop may have learned something, but it is unlikely that the lesson would reach the entire force, and even if it did civil rights violations would continue because the only way to stop that is when the DOJ has to audit the city and prescribe civil right training. They can't force the city to do the training, but they can cause the city to lose federal funding, and it makes it easy to get criminal convictions for civil rights violations in the future, so the three things that fix it are the public getting fed up and getting civilian oversight, cities losing their insurance, or the DOJ dropping the hammer on them.
Usually the cops have ZERO repercussions for them breaking the law, ignorance of the law is never a defence unless you wear a badge or know the right people.

Beyond the threat of arrest for a protected activity, what I find most disturbing is the lack of contrition on the part of either officer... that's a pretty good indicator that they don't take their oath seriously

There's not a single cop in the United States that takes their oath seriously. If they did, you'd see cops standing up to those who violate the constitution daily. City attorney only advises, does not make ordinance. Board members are the ones that should be gone after, but good luck with that because they have qualified immunity as well.

Speaking of time... the times on the BWC and dispatch logs don't match, especially the supervisor who literally arrives in 2 seconds according to the logs and officer 1 BWC shows him walking 10+ seconds before he arrives. This isn't trivial, these are legal records and it's inexcusable to have time discrepancy

There is no qualified immunity for violating clearly established constitutional rights. Carrying a sign, even with profanity on it, on a public sidewalk was ruled a constitutional right long ago. The cop doesn't know this because they were not trained on it, and there is no incentive for them to be trained on it (sometimes there is, but that is a different story and is the result of a DOJ assessment to see if it is systemic in a department). If they were to have arrested Jeff, Jeff would have sued and won, but the cops don't care. The city taxpayers pay for the insurance or the money from the general fund to pay the settlement (and this would be a slam dunk case). This case had nothing to do with qualified immunity because qualified immunity does not protect a cop against violating clearly established constitutional rights. Jeff said he would lose it, but in this case, he would never even have had it, It was already lost in previous Supreme Court Rulings.

Jeff said the cop would have lost his qualified immunity, but the fact is that there is no qualified immunity when it comes to clearly established constitutional rights. The thing though is that had the cop arrested him, Jeff would have sued both the cop and the city, and he would have won because the Supreme Court long ago ruled that holding a sign in a public forum, even with profanity on it, is protected under the 1st Amendment. The thing though is that the cop and the PD would not pay a penny out of their own pockets. In this case, my guess is that the city has an insurance policy to pay out in the event of city employee misconduct and the settlement would come form that and not the police officer's wallet or the PDs budget. In other words, the taxpayers are punished, not the wrongdoers. Since there was no lawsuit (and even if there was) there really is no incentive for the PD to get all of its officers in a room to do civil rights training, and they continue to do what they have always done. This particular cop may have learned something, but it is unlikely that the lesson would reach the entire force, and even if it did civil rights violations would continue because the only way to stop that is when the DOJ has to audit the city and prescribe civil right training. They can't force the city to do the training, but they can cause the city to lose federal funding, and it makes it easy to get criminal convictions for civil rights violations in the future, so the three things that fix it are the public getting fed up and getting civilian oversight, cities losing their insurance, or the DOJ dropping the hammer on them.
If ATTEMPTED murder and ATTEMPTED robbery are a crime, why isn't ATTEMPTED violation of civil rights under color of law ALSO a crime?

The report said he was requested to sit on the bench and refused. The bench wasnt even referenced til the engagment was concluding, and only as a suggestion that he was able to use the bench if he wished to take a set. The officer lied on a sworn document to try to make him look worse than he actually was. I do believe that florida has a brady list that this clowns name needs to be on.

Ignorance of the law is no excuse but if there is no punishment or no incentive to actually learn the law, then they tend to continue to be ignorant of clearly established constitutional rights. Cops don't care about your civil rights because even though qualified immunity does not protect them from violating clearly established constitutional rights, if you sue them, the city or its insurance pay the settlement (assuming that you sued them both, which the lawyer would know to do) and the PD and cop pay nothing. So, it is low energy to stay ignorant.
