How to fill your tax information W8BEN on Upwork in Nigeria II What to do if you don't have TIN

In this video, I will show you what you can do if you do not have your TIN and how to beat the December 31st, 2022 deadline! I will discuss what you can do if you do not have your Tax Identification Number as a freelancer in Nigeria.
I will also show you how to fill out the W8BEN form for non-US persons (i.e Nigerian freelancers).

Upwork announced a few weeks ago that all non-US persons are required to review their tax information by filling the new W8BEN form. Any non-US freelancer who fails to do so before the 31st of December 2022 will be liable to withholding U.S income tax deductions from their earnings on Upwork.

Useful information thank you. Upwork now has the vat tax too, does this mean you are taxed 3 times? Vat, Upwork 10% service fee and the 30% if you are hired by a U.S. company on Upwork?

To address your query, Upwork now includes VAT charges due to government regulations in each freelancer's respective country. For instance, in Nigeria, the VAT rate is 7.5% of Upwork's fee. So, if you charge $100 for a project, Upwork will deduct 10% ($10) and remit 7.5% VAT ($0.75) to Nigeria. It's important to note that not all freelancers are subject to a 30% VAT charge; this is applicable to US freelancers only. In Malaysia, the SST rate is 6% of the service cost that is being taxed. In Serbia, the VAT rate is 20%.

A content creator is an individual and you need to fill the w8Ben form if Upwork pays you as a freelancer/independent contractor. But if you run an agency, for instance, that's a business. So, you'll need to get a w8BEN - e form.

Great question Akinola. If you don't have a TIN, Upwork accepts NIN. Your address matters because this exercise aims to prove that you are a non-US resident. However, the fact that you have a NIN is proof that you are a Nigerian, which is what Upwork needs to prove to the IRS that you are a non-US resident.

Thank you for reaching out @hauwauibrahim9425 Filling out the W-8BEN form on Upwork is a requirement for non-US freelancers to ensure compliance with US tax regulations. So, yes, it is mandatory that you fill the form even if you don't have a TIN. Upwork says you can use your NIN.
