- A Pasco County woman said more than a year after she was shot by her neighbor while standing on her own property, she’s waiting for restitution and justice. Jessica Orlando was hit with dozens of pieces of birdshot after her neighbor shot her with a shotgun. The suspect claims he was shooting at her dogs.

Seems like a really half assed investigation. How many rounds were fired, what size bbs in that particular ammunition? How many wounds were there actually and was there other property damage from the shot in her vicinity? For instance if the story is one shot and it’s #2 bbs resulting in 97 wounds it would mean the entire load hit her and that would seem very deliberate if not impossible from that distance. If it was smaller bbs used in 20 gauge birdshot it might be more plausible.

That shot gun bird shot has a determined spread/ft. It should be easy to determine the distance of the shot by the radius of impacts on her body. If the distance was as far as stated, then he had to shoot almost horizontally, not downward at a dog. Seems to me the police are not doing their job

This is crazy. The cop said he couldn't prove it was intentional so he didn't arrest him. Is that his job? She was shot and he did it. The rest is up to the courts. Assuming the shotshell was loaded with #8 shot and the 20-gauge shotgun had a modified choke, the density of pellets on the victim would indicate a fairly close distance. I would contend that this was a deliberate act in shooting her, and not an accident from shooting at her charging dog.
Since I don't know anything about the specifics of birdshot and shotguns, I had to look up some numbers. Going by your theory, I found this:
"A typical 1⅛ ounce load of #8 lead shot has around 460 pellets."
She got hit with just over 20% of the pellets. At what distance would you say he would have to be to ensure that type of density?
So the 2nd search I did came up with 40-inch spread at about 35 yards with a modified choke.

If he had aimed just a few inches higher her face would have had more than just few shots that she did get, if it had hit her left eye she would have lost her eye and be blinded in that eye, if it had hit her around her ear she would be deaf in that ear. Bird shot is designed to kill small birds, it’s designed so that the shooter will get its targeted bird, but what it will do if it is used on an animal larger than a cat is to damage mostly damage, it might kill a cat out right if close enough to the cat to far away the spread of the shoot will only do damage and maim what it hits and cause a lot of pain.
Way was he sitting in the middle of his driveway on a chair with his shotgun pointed at her property. To say he feared for his life because of her dogs is bull shyte, if he was that scared then why sit that close to her fence line why not sit on his front porch. If he was that scared for his life why is his gun using birdshot that will not kill the dog unless he is firing from 4 feet away, he should be using a larger sized pellet shot that’s designed for larger animals.
No his use of birdshot was a deliberate choice to cause pain and damage only, he was not aiming to kill the dogs he was aiming to cause them as much pain as he could but he changed the direction of his gun and pointed it at her.

He didn't prove the dogs were on his property even with so called witnesses, The preponderance of evidence is in his court to prove the animals were dangerous and on his property. The evidence shown is the animals weren't hit, but the neighbor lady was hit multiple times. I'd find this as attempted homicide.

Personally, I hate people who let their pit bulls run loose, but did ya ever stop to think those pit bulls possibly got loose from an enclosure? Regardless of the circumstances, he should have called the cops or called the lady and informed her about the dogs being loose instead of blasting away like a psyco nutjob.

Are the cops supposed to issue a shelter in place order every time someone's dog is on the loose? What you are suggesting is far more impractical than just being a responsible dog owner.

"brandishing" He had pit bulls on his property coming at him, he had every right to shoot the dogs, just not her. This doesn't appear to be in city limits, so he can walk around with a shotgun all he wants. I wonder how many times he asked her to keep her dogs off his property. He definitely was in the wrong for shooting her direction, but maybe he was trying to shoot the dog, birdshot spreads.

I highly doubt it. That man had every right to protect his property, and life, if in fact his life was in danger. All shotshells will spread, the dude might've been jumpy, and overshot at the dogs, none of knows. I see most of the comments accusing the old fella, but it's out of emotion, not facts.

Not really, especially with #9 birdshot. You have to be very very close to do any damage with bird-shot because the pellets are so tiny that they can't gain enough velocity to penetrate very far into the skin. #9 will barely kill a squirrel at close range, to give you an example. #7 1/2 or #6 is ideal for squirrels but still barely penetrates their skin at close range. #9 is basically rat shot, tiny little grains. Definitely more to this story.

Similar incident happened to me in 1974. I was mowing lawn for about 45 min. When I shut off mower, I started hearing shots. And hearing strikes/seeing chips flying from bricks of house. My wife was working in garden. I yelled @ her to get inside/stay away from windows!! I jumped into my vehicle(w/ my firearm) drove around block to neighbors house, jumped out...and deputy slid into driveway behind me!! Told me to put gun back in car. Meanwhile shots kept popping off. Deputy went to back-deck, drew down on the man. The man was stunned, claiming "I was only shooting @birds in a tree!!!!" When deputies investigated my house, counted 68( sixty-eight) bullet impacts!!! I had been walking back and forth, like a carnival duck, for 45 min while 68 .22cal bullets hit my house, yet missed me!!! Angel hadda been looking over me. Neighbor was scared straight/ said he didn't know bullets would travel that far( less than 100 yds) paid fine for reckless handling. Never apologised/never paid damages. Following weekend, he was back out, shooting again!! That time, I dont know exactly what happened to him immediately, but did see his surly face a year later, but never heard him shooting again.

That's America. I recently spent 4-5 hours in an ER, and later got a bill for $27,000.00.
Yet she can afford to feed two pitbulls and cause her neighbors problems because she wont put up a chainlink fence. Pure ignorance in my opinion. I have pitbulls but I also have a CHAINLINK FENCE. I also don't teach my pitbulls to jump on people and knock them to the ground like she was seen doing in this very video. If an old man gets knocked down, it can lead to a serious injury like a broken hip that he will never recover from. one time a single birdshot pellet hit me in the lip while I was pheasant hunting. It didn't break the skin but it burned like fire! I can't imagine the agony of 97 birdshot punctures.
