I mean, technically I'm pretty positive any kind of reaction, song cover, etc. is illegal under copyright law. Fair use is way more limited than people realize, and rarely would hold up in court. We're just protected from the enforcement of that because of platforms like RUclips. Copyright law is pretty terrible, it needs a massive rewrite, but I doubt it will ever get it.

If I recall, copyright law only works if someone tries to create the same product in the same “subgroup” of products. For example, someone can’t create a new app called “Facebook” BUT someone could easily create “Facebook dish soap”. However, most companies don’t do that because it would be confusing to customers. So I believe you could easily create an original song about a brand of wet wipes. But someone should correct me if I’m wrong.

RE: Fan Product Songs While I'm definitely not a lawyer or legal expert, I have a hard time believing a company could successfully go after someone who wrote a song about their product - as long as they: 1) Make it clear it's unofficial and unsponsored 2) Don't include lyrics that could be considered libel and 3) Does not make use of specific jingles or iconic sounds And even then, I'm not sure they'd be successful in challenging it. Though, that doesn't mean they wouldn't attempt to intimidate someone via legal threats

There could be a difference with pocket full of Hawthorne's in that the actual product is shown, referenced and used in the video clip.
