What To Do If You Are Being EVICTED (Eviction Notice) - Don't Just Move Out!

  • How To Not Get Evicted from Your Apartment?
    All of the options are hard. This video is about how to understand whats going on so YOU can think more clearly.
    Some people will comment that theres a way you can remain in the apartment (for another month), including asking a local church for money, or taking on a high interest loan. Yes, but then you will need a whole additional plan again shortly. So please try to understand what the terms mean, then think about your plan.
    Eviction moratorium (meaning temporary suspension) was a federal government thing during COVID. That's over. Evictions are done by local governments anyway. There are thousands of ways they are doing this. This is a tough situation.
    DO THESE STEPS:
    -Hang In there, this will take some focus
    -Don't just move out
    -A court date is NOT an eviction date. Eviction date/lock out date will usually be decided in court
    -Don't just ask for more time in court without a plan. Make a plan
    -Try to pay and get the court case released BEFORE that date if you can
    -Get a calendar out, write down all important dates (Court dates, lock-out dates, dues dates)
    -Write amounts needed on that calendar, and other things you'll need to pay
    -Is there anything ELSE you're doing in violation of lease? (unauthorized guest, pet, junk on patio, etc?) If there is, STOP that
    -Do the difficult math
    -Can you offer to leave voluntarily to avoid the eviction? This will greatly help you in the future
    -If you can't avoid the eviction, go to court anyway
    -If the court/sheriff has given a lock-out date, MAKE A PLAN for your things in your apartment, you will probably not get time to move your belongings, on that day they lock it, and usually they plan on calling a trash-out company later to empty out everything, and send a bill to YOU for it in collections.
    -If you owe $3000, but only have $1000, it might be unavoidable to get the eviction. In that case, think about finding a storage unit for $100 for your things, so you can make the next step from there.
    -Breathe through this whole thing, remember you can live through it

    1 extra bill hit, had my rent on auto pay so i didnt pay attention to it until the office sent me a notice. Theyre filing on me regardless but i can have everything paid way before the court date. Hopefully i can get out of this

      It really sounds like you can if you can have it paid before the court date. They will be adding legal fees and a court holding fee to you so be prepared to pay a little extra. Ugh hate doing that.

    I can't be evicted, I own. Never had to evict my renters. They are all happy paying $300 a month for a unit in Hawaii.

    I am happy you brought up communications with the landlord being used against the tenant ie writing the the landlord that you are ceasing all communication, you are not going to follow your responsibilities in the lease, you are not going to allow entry for inspections or maintenance. Taking an aggressive, defiant position. I am dealing with that right now.

      Thank you again! Wanted to ask one last question if I may. I spoke with the management company who does not agree to accept half. She was very pleasant, however I have $2,000 and the total is $2700. She advised not to pay this amount or they would need to “resend” what does this mean? I want to pay the $2,000 in spite of what she advised… any further advice you can provide. Grateful for your response.

      @@nicolebrinson3981 I think she means "recind" which means to withdraw or cancel. In Ohio and some other states, if a tenant has defaulted by not making proper payments, if the LL accepts a full or partial payment then the "non-payment" aspect goes out the window for the LL. The LL would then have to serve you papers all over again and start the process all again. Costly and troublesome for the LL.
      I'm a LL and I've had this a couple times, I just send the check back and do not accept the payment. It hurts me not to accept a payment, but I figure it's the cost I have to pay to get rid of a troublesome tenant.
      They might accept $2000 if you'll get out without causing them any more trouble. It depends on how much you owe. Offer that as a negotiated settlement to end the lease, and that way you don't get a judgment against you that would go on your credit report if they accept.

    I made the ultimate mistake.
    *just venting*
    I thought I’d be able to work remotely. So I moved like 3 hrs away to another city. Got a cute loft and uhhhh. I’ve had to be back at my job in DC 90% of the time since I signed the lease.
    I’ve had to pay for a $$$$ sublet up here and then also try to pay for my nearly 2k rent down there 💀
    And well, when it rains it pours because it seems as if all that driving I’ve been doing did a number on my car and my check engine light came on. Turns out it was a pretty bad leak. So I’ve had to pay for that.
    I communicate this with my landlord. I tell her I should be able to pay by the 6th.
    Welp, two of my front veneers attach to the sour patch kids I was eating so I’m sitting here now with raw barely any enamel nubs for front teeth contemplating should I wear a mask and wait to get them fixed so I can put that money towards rent or should I fix the issue. 🤓
    And yes, I tried the dental glue and they keep falling out
    So I’ve kinda gone ghost bc I’m trying to figure out what I can do. I’ve come so far from my “sugar baby” days but it’s times like these that tempt me into considering going down that road again. It’s funny how the only times I’ve struggled financially have been when I work regular 9-5 vanilla jobs. 🙄😑
    Anyways, she ends up messaging saying if I don’t pay by the 15th she’s going to evict me…. Even though I already signed an agreement to break the lease when I found out I needed to be based in DC still.
    Like can we just somehow come to a settlement where I can pay the 60 days I have left and that’s it. Can she just use my months security for one of the months. Idk. I’m embarrassed this has never happened but it’s my fault. I made a impromptu stupid decision and now I’m paying for it…literally 😩
    I’m going to respond to her email tomorrow and also look for emergency assistance in my area.

    I’m trying to sell my motorcycle car and belongings as quickly as I can to meet the total amount I genuinely cannot be homeless again I don’t know if I’ll make it this time around. Doing everything I can.

      Good luck doing that. It would really help to avoid having an eviction on your record. Doing the math like you’re doing is really important to make your strongest move. Clear out time each day to think about the best thing you can do with the math of it all. It is frightening to think about but you have to spend time with that. You also may want to ask if you volunteer to leave by a certain time, could they drop the legal eviction. Chances are no, but it is something to ask.

      @@NotJustNinjas this all came about because of the accident I got in. I’ve never missed a payment until I was in hospital for a month missed a lot of work and money because of that. It’s all dominoed from there it seems man.

    I am getting evicted by the building manager..........Been here 3 years.......Never late on rent. I asked the manager for the owners contact information. The manager moved these meth heads into our building and it is horrific what they have done. When I asked for the information. 2 minutes later he said he is terminating my month to month lease and evicting me. Gave me 90 day notice. Retaliation

      This is way too common, ive read others report the same situation to the letter and same happened to me recently. Moved in a meth addicted couple, have had them break the law on property, smoke meth in the common areas and break doors and windows. Meanwhile they want to evict me for "clutter" that was rectified in minutes and are holding to it.

    I just got one today only because I'm 1 month late. I get it landlords have to pay shyt too but you can't compare apples to oranges. I even gave extra for bein late. Once a landlord do that tile of thing it's all about money for them. They don't care about you. All they want us the money.

      Good luck, that is a huge thing to have to deal with. Yes they usually don't make an investment like that for any other reason than financial success. And it is the structure of collecting they try to keep intact, that's why it is so unflexible. It takes grit beyond belief to navigate to the other side of that, whether you end up being able to stay or leaving. Please let folks know what state that is and anything else that may help.       If you have stiffed him on rent, he might cry that you don't care about him! You are two adults that have entered into a business agreement. You say you reneged on your end. Don't think he's mean because he wants you to honor your contract.

    We had a lease option the house was hollowed due to damage from a former tenant. The lady was desperate for help. We told her we would fix up the house and she would give us 20,000 in a credit to apply toward the house well she became incapacitated and her lawyer grandson allowed the house to go into default. He came to the house telling us and then a day later handed a revocation of our contract telling us we have to move out. He made a lot of threats. I told him we did 20,000 worth of upgrades and since he revoke our contract we were entitle to the 20,000. He didn’t know we were informed the house was in default. He kept asking for the lease which I gave him and said he didn’t know about the agreement. Then he slipped up and corrected me saying you only agreed to 20,000. I couldn’t believe it. He knew he screwed up he capitulated allowing us 60 days to move and giving us our 20,000 back when the house sales. I am going to an attorney to make sure we are not screwed. Are we entitle to the 1500.00 we paid during the default period?

      That's a complex situation. It sounds like you maintained an understanding point of view of the rights and difficulties of each side. With that attitude you will find the wisdom to get into a better situation before long. Not sure about that 1500. But it doesn't hurt to request it if you find your request 100% rational.     Our landlord (my father in law) is evicting us because we’re two weeks late. We’ve been a couple days to a week late before but he’s always got his rent. Even offered it to him and he refused it saying “I’m just done with it” even tho us being late this time was a reason we couldn’t help (wife’s bank card was locked and had to be replaced). He’s giving us until this coming Saturday to be out. He thinks he can just show up Saturday with a cop and throw us out but we have two kids and he gave us literally four days to leave. Can’t wait to hear how this goes with a judge.

      No landlord is responsible for your kids. You are responsible for them nobody else. But how every he does have to file an eviction.

      If there's nothing wrong with the structure of where you live yes you have to pay rent they can't be two weeks late when they have to pay the insurance or water and sewer so you owe the rent. Other people cannot sit back and wait because you don't have because then when you don't have they don't have. He's basically letting you know don't be late put money away for your rent.

      Landlords can't be late on the bills to that place. I think every landlord that has to evict the tenant should have to pay the landlord when going to court extra. like 100 dollars

    Sorry to bother you but what if we were never notified of the court date? We didn't know about the eviction until the sheriff showed up after the locksmith. The sheriff was very nice to us but mad because he couldn't find anything that we was or were to be served. What can we do?

      You're not bothering us, this community is here for people to read comments of all types of situations and learn 👍🏽
      But can you elaborate? It doesn't compute that a Sheriff would appear at your dwelling without the documented reason to do so. He may have just not known how to respond to you. It's probably a Sheriff's least favorite thing to remove someone from their home. But the good ones know they can still be an important presence at the precise moment of most stress for some people.
      Additionally we aren't familiar landlords, property owners, or locksmiths that would take the enormous risk of an easy lawsuit by executing a lockout without having signed, sent, and saved copies of the needed docs.
      It sounds like you have to be ready to make your next steps, as informed and confidently as you can. Great difficulty, but you can get through, good luck.
      If you really think that law enforcement, property, or locksmith changed your locks without any procedure, you should google tenant or real estate attorneys in your state.

      Thank you for all your snuggly warm thoughts. So just to clarify a few things, First the locksmith showed up and talked to us. After our conversation he said he would not lock us out that day but he would talk to the sheriff. Second, when the sheriff came he said our "Due Process" was violated. That there is no documentation anywhere that we were notified of a court summons or notified of the judgment OR given a copy of the eviction. He said nothing was mailed out or delivered by his deputys. Nothing.
      Now since I last messaged you I have reached out to Legal Aid and talked to a handful of law firms. They all say I have a case but no one is willing to take it. So I have accepted the fact that I have to move out by 10/07/2024. Again thank you so much for all your advice and thank you for your video. I strangely don't feel alone. God bless ☺️👍😎😍

      Leroy first of all please keep in mind that it does not simply get resolved by getting before the judge. Some judges and some cases will say "Money was not paid, therefore you must leave." And they will give you anywhere between 7 and 90 days to leave. But other judges might ask "Do you want to pay? Is there a reasonable way you can get enough money?" And then they might ask the property owner "Are you willing to make an arrangement for the renter to pay?"
      And this is not to say that some judges are nice and some are mean. it is more accurate to say that the details of each case have a surprising number of differences: State, City, Length of Residency, Amount Owed, Timing, Type of Lease, and many more. Some of these details could possibly allow the judge to get more involved and try to reach an agreement. That would be good. But we don't want you to think the court will always be helpful, so please be prepared for both the worst and the best outcome. BUT, not showing up in court, or to be a no-show, gives you zero chance, so please go. (Or better would be paying all amounts before then and getting it canceled). And if given the chance, explain your case in the best way you can.

    Hoping i saved myself. Fell on hard times and got the notice to vacate because i owed $1600 didn't see the notice till it was a week past due but have them $2,000 to pay some of this month's rent but im gonna be behind again because i don't get paid till the 8th and rent is due by the 3rd

      Yes it's not your place, it was your place to rent and if you were unable to pay your rent you should have spoke with your landlord and try to work something out or start making arrangements to let your landlord know that you can't afford the rent anymore and just leave instead of sitting there and expect money to fall from the sky😅

    I have to say some landlord, are just Evil as it gets, and some are the nicest people you ever meet, I had both of them during 32 years of being tenant.

      Don’t know if any property managers or property owners want to chime in here.
      But it can easily happen that the tenant and the landlord fall on competing sides of an issue, especially when there is an expense involved, and the owners’ property being involved. It takes care, balance, and sensibility for these competing sides feel fine with it or at least accept.

    Well my landlord is harassing me and threatening to evict me because the rent was late by 3 days
    I always pay rent on time for the past four years and the reason the rent was live is because the United States Postal Service do I have any legal grounds or Am I in the wrong?

      It certainly can feel like harassing when you are issued a pay or quit notice or a late letter, but that is the way they have to operate in order to conduct business. If you end up having to fight an eviction, and the only reason is listed as non payment of rent, it usually would help that they have since received payment. We hope that's all it is. As far as it being received late, it usually makes no difference when you sent it, it is only documented when they receive it. Some renters pay in person/online to request a receipt of payment, or if mailing they send it 'certified' from the post office so at least they can show a date of mailing it for their files should they need to argue in court.     I got the letter and immediately moved out. My thought process was, i could at least get an apartment without an eviction on my record and it actually worked lol

      Yes it’s the best option is to find a new place asap get approved and then move before the eviction hits your record you have about 10-14 days

    I’m being illegal evicted in NC because the office manager send me an illegal rental lease with the wrong dates on it. There is what I’m trying to tell you, The beginning date of rental lease is August 1, 2023 and ended on February 28, 2023. My rent is current and I’m looking into getting legal representation to fight this issue. The eviction notice told me to move out of my residence in two weeks. I received this eviction notification on Saturday, August 19, 2023. I tried to discuss this issues with the landlord’s property management and she refuses to correct her mistake. Just sharing my story.

      Thank you for sharing. Please contact an attorney and housing organization in NC to start looking into options. Also keep in mind that a letter from the landlord instructing you to move out is different than an official government (city, county, state) order that you will be removed on a specific day. Example: landlord letter says you will be evicted and you must vacate in 2 weeks, but in most states an actual eviction comes after a court date - at which you should definitely appear. If a court date passed and you did not go, the possession (writ) of the unit would usually be given to the landlord for your failure to appear. At that point typically a Sheriff would then post or serve a very official looking document to you with an exact date on which your locks will be changed. Please look into your specific state/county/city procedures to decide your best actions. Do not stop learning and improving your situation no matter what happens. Good luck ✌

      @@ondreavaldez760 It all boil down to greed and my landlord is well known in the county I live in. He thinks he is above the law in North Carolina and he has bride judges, police officers, political leaders and anyone who would take a bride to keep him out of trouble.

      In some states the landlord is allowed to state what forms of payment are accepted. It is not a law, but it is pretty universal that they do not accept cash. They are not equipped to keep and protect cash on site. In some areas, landlords are stating that all payments must be online, and in full. This may or may not be protected legally, but it is becoming more common as a practice. Thank you for your comment!

    My landlord sold the property I'm renting to his friend . Less than twenty four hours later the new landlord put a letter on my door saying I'm being evicted. Turns out though my old landlord said not to worry I would remain as a tenant six months ago, the new landlord wants to just flip the house.

      Something like this similar happened to us. We were at a house for about 12 years... They sold the property and told us we would be fine...
      Few weeks later they came back and said the new owner wanted to sell everything and we had to move. Pissed me off so much

      In most states, a new buyer has to honor the terms of an existing lease. Of course, that could only be a m2m lease.

      @@johnye2210 Best think to do is buy your own place. When you are renting the landlord can sell their own property. Nobody has to be a landlord. Nobody is garneted a place to live. And most landlord are getting ride of their rentals if they had trouble during the pandemic. They are saying I don't want to take a chance on this happen again. And you can't blame them.     I’ve got such a corrupt landlord who moves under 15 alias multiple one year leases under espérate wife’s names illegal contracts i wish they had more help for obviously some sort of scams

      We don't know all details of this, but it does feel powerless to renters in most states. The Ninja way is to find what the source of empowerment is, even if this situation is a lost cause and you can take learning forward. For a lot of renters, this empowerment comes from gaining the real understanding about the relationship between landlord and tenant. Because when that is realized and accepted, it can guide the entire process in a healthy way.
      As renters we really are making an agreement with someone's personal property - which will serve us by having the location we have chosen, and a shelter to be our home.
      But that is also someone's investment and property. They don't invest in order to provide happiness, they invest because it seemed like a good use of money. And they have to put things in place that protect their property, like the way you would with your own things.
      But they need renters. When both parties clearly honor the other party's position, it is a good outcome. As for the company names, this is very common, each property usually gets incorporated under a different entity name for purposes such as taxes, liability, and finances. If you own one building that you bought with person A, then you buy a different property with person B, those loans, expenses, taxes, etc have to be kept separate. So vague company titles are usually chosen, often like the way you described with relatives' names, or sometimes the address or street followed by LLC.

    What if it’s a Bank that sends a Notice to Vacate after foreclosure. What are the tenants rights if the lease isn’t up? My brother is going through this now. Does he have to leave after the Notice or will they have to go to court?

      To get more info, are you saying that the owner of the rental property defaulted on mortgage and foreclosure gave the rights of the property to the bank? And also that the tenant is not the owner? If that is the case it truly varies from one state to another. What state are you in?
      For example, in Virginia, a tenant should be protected to stay until the lease is up in this case. Given the details above. And as long as they continue to pay agreed rent.

If the successor in interest acquires the dwelling unit for any other purpose, the successor in interest shall acquire the dwelling unit subject to the rental agreement and the tenant shall be permitted to occupy the dwelling unit for the remaining term of the lease, provided, however, that the successor in interest may terminate the rental agreement pursuant to § 55.1-1245 or the terms of the rental agreement. The successor in interest shall provide written notice to the tenant, in accordance with the provisions of § 55.1-1202, informing the tenant of such.
      The terms of the terminated rental agreement remain in effect except that the tenant shall make rental payments (i) to the successor owner as directed in a written notice to the tenant in this subsection; (ii) to the managing agent of the owner, if any, or successor owner; or (iii) into a court escrow account pursuant to the provisions of § 55.1-1244; however, there is no obligation of a tenant to file a tenant's assertion and pay rent into escrow. Where there is not a managing agent designated in the rental agreement, the tenant shall remain obligated for payment of the rent but shall not be held to be delinquent or assessed a late charge until the successor owner provides written notice identifying the name, address, and telephone number of the party to which the rent should be paid."

      In most states that would not be ok. If a court grants a writ, there must be someone who filed it, that's important information. If someone works in apartment management now may want to chime in? Some people claim they never were served a court date, when it turns out they were. That is not what we assume here, but it has happened that the summons was served in a manner permissible per state yet not discovered by the defendant for one reason or another.

      if you feel you were never notified of a court date on the day of lock out you can go to the court house and request a "writ of stay " due to the fact of not being served. Once received you would give it to your landlord and be given access to your apartment. A new court date will also be given to you .

      It is surely taking all of your mental space and causing stress. Our minds will go negative and keep revisiting the negative, but remember to think about what you can do now. We may not be the same after something like this. Make that a good story not a bad one when you reflect on it later.
      It absolutely sucks there is no way around it except through for many people.
      The fees they added are probably within their rights and not illegal. But it is no harm asking for clarity on that, or mentioning to judge.
      What is very common is to be evicted for un paid rent, but then when you actually leave, they will add everything else the lease contract allows for (aka, returning apt to as-received condition, late fees, attorney fees and court costs, money through end of lease term, junk hauling, and more.)

      That’s something renters can be faced with at any time, given legally required notice to vacate :(
      It is more common when renting from a smaller operation or a private owner. Sorry to hear about that but hopefully leads to the next good thing for you.

      @@NotJustNinjas yeah Rick wiegand is his name, crazy thing is after researching, the building had been sold over 2 years ago. Ive only been there for 5 months (since September 2023) and this was my first apartment alone. They did give notice to vacate. I have to be out by March 31st 😔

      That is so uncomfortable and challenging. But we do think it is important to still document your write down all significant dates and amounts you're dealing with. For example court date, etc, so you can make your best decisions for your situation. Also be sure you clearly state your intent to pay the money owed and remain in the rental if that is your intent. And even if they are rude, ask them what they will do if you DO pay, and if you don't, so you can know what to do. If they are not providing answers, that indicates the answer has already been given to you on documents you've already received, so please make sure you review each thing closely in case you've missed anything. Also please read as many of the other comments as you can because some people have experienced that as well. Remember they are people doing their job in most cases, and they don't have many options for you. Thank you for commenting and good luck with all this 🙏🏽

      @@NotJustNinjas Thank you so much for your detailed answered…I called and I was told that the eviction was files 3 days before the actually date that I was supposed to leave…so should rush out to leave..or wait for court since they filed before the date given? I was told if I leave on the August 22nd I would avoid eviction then I called on the 19th and was told it was already filed 😐

    Hello there, I have a bit of an unusual circumstance. I am taking my landlord to court and asking for a cash to keys resolve, since there has been so much neglect, abuse of power, mold, and recently a flood. I have a feeling that he’s going to try to evict me, but not tell me that he’s doing so! He has a couple of friends that would themselves in court and say that they gave me the three day notice. I am just wondering is there anyway that I can call the courts and find out that if I am being taken to court? he is a very shady, Creepy, above the law type of attitude, landlord. So I’m wondering if they can evict me without me knowing it? Thank you.

      there may be details we are not aware of and evictions really do very state to state as far as the timing but if you are in the states, we are not aware of any state or locality that allows an eviction without formal notice, including a court decision. it is far more common that you will first be served by a sheriffs office with a court date. Please keep in mind that if there is any way, you can come up with an agreed move out time so that it does not go to eviction court that will be so much better for you in the long run, although it may suck in the short run. good luck

      There is a chance it would not go on your record as an eviction, because in that case they would not 'need' to continue filing with the court. However they still might do that depending on their own procedures. We recommend communicating and trying for an agreement that would benefit the landlord by saving time and or money, and seeing if they can agree to do anything if you help in that way. But in most cases it's a no, because as a landlord we learn to follow strict processes regardless of how that may inconvenience you, it is business, not personal, remember that. And good luck 🙏🏼

    I’m being evicted… the judge wouldn’t even let me defend myself in court if I didn’t pay rent to the courts, but I’m on housing and the government pays my rent and my housing case manager was confused as of to how she would submit my rent to the courts… so I lost because I could defend myself by default… the government didn’t know how to submit rent to the government and I was defenseless and got kicked out…. Help me… I’m going to appeal the case but idk what’s going to happen

      You took the first step and began contacting people and studying how to look into it. A big tip of the cap to you for that.
      It sounds like a nightmare for you that it’s happening at this time of all times. Awful.
      Which government are you talking about? Even though it seems like everyone in the government of any kind is all working together in a government building, they are not, and chances are they don’t even know eachother. Can you be specific as far as office/branch/jurisdiction/county and so forth?
      -Courts (judge has already given dates? You’ve already appeared in court)
      -Government paying (state? City? Country?)
      -Government getting (which?)
      -Case Manager (Is there a case, meaning a court case?)
      If you add details (without giving names or anything) someone may be able to understand more and look for opportunities.
      Again, awful thing happening, hoping for any good or positive thing for you.

    I was given a 14 day notice to pay or vacate. I learned today that this is also called a summons, and you need to reply before the 14 days are up, or you can easily be kicked out. I simply replied; Received. Thank you. Is that a sufficient reply?

      If it is a summons, that usually means it will include a date, time, and location of court you are being summoned to. It sounds like the document you got allows you to avoid court if you pay within the 14 days. In the video we suggested replying with your intent and plan - either that you intend to remain there and when you will pay, or that you will be vacating. Each state may have differences, and we don't know your situation so these are just general informative suggestions. Good luck with this difficult situation! Please read all documents carefully, and perhaps read the pinned comments of this video.

      @@NotJustNinjas well I did reply with the fact that I am trying to come up with the funds to be able to vacate, and I cannot. So I will await the eviction notice. However, I’ve noticed a bunch of things about this building, like, for example, on my stove, they order generic burner pans, and they have bent burner placement guides, and none of my pans will sit flat while I cook. They informed me that I couldn’t move the washers and dryers to clean around and underneath that hadn’t been done in 10 years, nor that I could chemically clean the interior of the washers because they stunk so bad. when I spoke with the company that leases, the laundry room and leases to the machines, he said clearly that it’s in the contract that they must clean the exterior around and underneath, and it is their responsibility to chemically clean these machines periodically. So I am having that contract sent over so I can prove to them they are wrong. The management company is rather neglectful, and I am just going to tell the truth as much as I can and contact the different government agencies that need to be contacted. I have the cat killer blinds with the strings that come down, and from what I understand, you must not have those in an apartment, and replace them with the ones that you use your hand on the blind itself to adjust the level without the side string. What’s the law? I’ve tried to find it on Google and different various Seattle/King County websites and I can’t find a particular law on what type of blinds they must provide. Although I saw the blinds before I moved in, and they were changed out to some of the nastiest most bent blinds I’ve ever seen. And I think the other blinds were the newer types where they would go up and down by the movement of your hand from the bottom of the blinds without the strings, the property manager is devious, as well as rather ignorant. What to do? what to do?

    My lease is up so now I'm on month to month in the same apartment because I didn't renew my lease. But now my landlord is saying it's a lease violation for failing to maintain electricity in my apartment knowing that I'm about to move, I got fined $103 and tood if I don't pay it in 3 days and they'll need possession of my unit and will proceed to evict me...can they do that when I continue to pay rent on time to this day?

      Yes, if it is one of the written agreements within the signed lease contract, even something like that, it can be a ‘violation’ of the terms of the lease. Most successful landlords structure their operations to treat even $.01 the same as $1000.00 - meaning if it is due, it is due.
      But the NOTICE of eviction is to give required warning that they will be filing for the eviction. People think that means they must move out. They have to move out when the court says they must. Always find out when they will be sending your file to the court and try to pay before that time. If you are able.

    Well my landlord refuses the eviction prevention fund or even if it was out of pocket expense so my case is close. The reason was I signed up the Month to month lease within two weeks before new rent due but I've been in my apartment for four years from June 19th 2019

      Landlords should refused the eviction prevention. Its hard for them to evict a tenant if they take it. Landlords don't owe nobody a living. If I would of had the problem with eviction somebody I would of not been a landlord no more.

    What should one do if being evicted for failure to cure or perform covnent, wich were absured to say the least, for example, it stated i needed to remove ALL personal belongings ffrom front/back porch and outside, remove all wood debris from property, kinda hard when the only means of heat is a wood stove, no trampilines, no tarps and remove broken down vehicals, so i have a running classic, 1965 fastback gt mustang that only needs paint, so regardless how stupid i think these terms are i complied exactly and still got a notice to quit, any suggestions would be great, thanx

    In Colorado, Governor Jared Polis just signed a bill into law that landlords cannot evict a tenant, regardless of whether they're on a lease or month-to-month WITHOUT CAUSE. Now, I've been residing in a single family home for 8 years. My rent is $600 per month. I'm renting a 2-bedroom single family home, it's pretty big, all by myself and my only source of income is SSI. 2/3 of my check goes to just rent alone. I also pay electricity and gas. I am not on low-income housing by choice, their rules are childish and ain't nobody gonna tell me what to do in a place where I'm paying all or the majority of the bills. Anyhow, I am disabled. Under Colorado law, a landlord cannot evict a tenant on public assistance such as EBT, Medicaid, SSI, SSDI or TANF. Now, here's the kicker: My landlord has dementia, he's pretty old, so his daughter took POA over him and now she thinks she has the authority to boot me, just because she wants to sell the house. Well, since I'm disabled, there's a law that states that landlords have to do mediation with the tenant if they fall under the categories I mentioned above, as I do fall in those categories. She's been harassing me daily by phone and text, asking me if I found a place, then got pissed off at me for not allowing showings after it became too much of a nuissance to my personal life. The realtor started demanding that I let a showing go on after 5 pm, to which I specifically said hell no. I find it rude and uncouth to show up at someone's house after normal business hours. She says, "It's not after business hours for buyers and realtors". I said, "I don't give a shit. This is MY house so long as I'm renting it, and if I don't want motherfuckers over here after 5 pm, that's my fucking right, and if those buyers can't wait to tour the home at a more decent hour, then they can go fly a kite. I'm tired of telling you this. Get it through your empty head that I'm not allowing it, ok?" Realtor replies, "No, it's NOT ok." I said, "I'm not on YOUR time. I'm on MY time. I'm tired of cleaning up after these careless motherfuckers coming through my residence and tracking dirt everywhere, and touching shit that doesn't belong to them. NOBODY is touring the house after 5 pm. That's the last time I'm gonna say it." So, the rest of the night went quiet. Next day, realtor at 6 am says, "buyer wants to view the house at 5:30. Let me know if this works for you." I rolled my eyes, and said, "NOPE." Later on, about 4:30, she texts me, "Are we still on for 5:30?" At that point, I quit replying altogether. I didn't answer my door when she trespassed without notice, and so the landlord's daughter took the house off the market and gave me a 90-day notice to vacate. So I consulted a local landlord who knows his stuff, and he said, "NO. You don't have to move out until or unless you get a court summons to appear. Until then, you are not required to leave. It's just paper at this point. The only way they can throw you out is if a judge demands such." So, landlord's daughter isn't even my landlord, and I read online that just because you take POA over your parent who is the original landlord, yes, you have the right to sell the property, but it does not mean you just automatically play landlord, so no, you are not allowed to evict the current tenant. So, attempted illegal eviction is going on in my case. But I sent a text to the landlord's daughter and told her she can't evict me, that her dad has to be the one for one, and for two, a landlord cannot evict me without cause. Look it up!" And after that, remained quiet on my end. When she tried to call, I blocked her number, and blocked the realtor's number. Because this incessant harassment has been going on since the first of the year. Might I add that my mom died 3 years ago and due to all this BS, I have not had the chance to properly grieve my mother's unexpected death. I also just lost a parakeet on May 9th, but neither one of them had any respect for that, so no more talky talky from my end. And that's when they proceeded to stick the 90 day notice on my door. I just took it off the door, threw it on my kitchen table and laughed. I will not be bullied out of this residence, especially since it's not even being done legally. Unfortunately, I have been unable to get any legal aid here because the resources for tenants here are slim pickins. My mental illness has been exacerbated by this entire thing. I'm sick of it and want to sue for mental distress and get justice for myself. There's black mold in here too, which the landlord never addressed. So, yay. How fun. NOT.

    Just received an eviction notice. Didn't realize it was so serious and so fast but I guess it makes sense. Will a mere notice stay on your record ? Or is that only once they begin filing the actual eviction? Also, if you are going through this too just be calm. Nothing helps with freakin out, most landlords I would assume are going to help you work through it and they empathize with you .

      @@missedges3082 Some will say if a tenant has an unexpected bill, the LL should "understand", and be willing to accept less than is due, or a late payment, to be nice. What if the LL has an unexpected bill? Should the tenant "understand" and be willing to pay more than is due to be nice? Or do you see it as a one-way street?
