Thank you again for your work! It is priceless, especially for cases that are not the fault of the tenant. Are there low fee experts to hire to amend the answer to the court that are available short notice? The answers are all written out, just don't know how its to be formatted Also,, the landlord did many things wrong (ie: the 60 day notice was incorrect + it was improperly served). Plus, he failed to notify that he had his Lawyer open a new management co as an LLC in another state (Wyoming) two days before filing for the eviction, it seems he has a lot that would that render the eviction notice invalid. That's where your local legal aid office should be able to step in and help...let them know that you've been served the unlawful detainer and need help ASAP. This should move you to the front of the line for help.

Tough to tell exactly...worth asking the court if they have an idea. It also depends on the how the tenant responds. Rough estimate would be a month or so before court date, if tenant loses, then maybe another 2 weeks to month for the lockout.

Question:: In OC and I received a 3 day notice but I have about half of what is back rent…a large chunk to give them….I want to work out a 90 day for the rest….if they deny me and want it all in full, will I be able to go to court to buy myself 60 days at least to find a new dwelling? They want to evict me when I am willing to pay. Court would take them forever to get the back rent back from wage garnishments if that’s what happens. I just paid them $8500 2 months ago I’m back rent and it should show I am not a freeloader and have every intention of meeting my obligation.
Hire an attorney to help (lawhelpca.org). Yes, you'll have time to find a place if the unlawful detainer is filed and you respond....this is not a quick process. You can negotiate with them potentially...BTW, I've seen tenants who have negotiated so that all back debt is forgiven if they are out by a certain date...

Hi I had a 60 day notice on January 10th and on March 13 the landlord told us the attorney messed up on the papers and we have till April 1 to move out and he'll lock us out but just yesterday March 20th he gave us an unlawful detainer after telling us we can stay till April 1st I have everything recorded.

I notified my landlord I vacated the unit 5 days before they filed the ud and summons. They also attached a pre judgement claim of writ to possession. Today when I went to drop off the keys I saw all these notices and dates I missed. I had already signed a lease and established utilities weeks before they filed. Since I turned in the keys before the notice to vacate will this still go on my credit as an eviction?

Thanks for the sub! Once possession is surrendered the eviction case will be over...that's technically what the trial is for: possession of the rental.
I had a process server say under oath that they server me a summons and complaint in march 2022 first then posted a 3-day notice on my door 4 months later in July 2022. Isn't this wrong? Should've the judge dismissed this case instead of letting the plaintiff file paperwork saying they serve me right?
That does not seem to be a valid reason for eviction (unless you've done this multiple times and have been told not to), but definitely offer to fix the damage.

Ozzy’s mum is still having trouble with her landlord, they are trying to say that she agreed to the new owners rent increase of 300% back in June. Yeah 300%. Who in their right mind would agree “verbally” to that rate increase! 🤦♀️ She hired a totally useless attorney and she’s not getting anywhere with “Stay Housed LA”. As usual they are always too busy to help. I told that a verbal agreement in CA isn’t won’t work and that the owner had plenty of time and could have gave it to her in writing. She just paid October rent at the beginning of the month and they sent the check back saying that there is an eviction in place, but there is no current eviction!!! Any ideas for help for her? Hi Paula, sorry she's going through this! The rent increase needed to be in writing with a minimum of a 90 day notice (and it's debatable whether it could be increased that much). Document everything and tell her to keep sending her rent in for the first of the month...if and when she does get an unlawful detainer, then make sure the attorney helps her answer. However when I went to the self help office at the court, the legal aide helping me with the case said the UD-100 was optional and not required. The complaint was typed in the attorney’s form. Doesn’t one need to be served personally before the timeline begins? I mean, it’s not as if I’m evading service but the mailman seems to lose and mix up mail often, smh 🤦♂️ and to top it off I don’t check my mail bc I lost my mailbox key , I know. What happened? I got a 3 day and want to offer a large chunk of the requested amount and start a repayment plan. If it is rejected how long will I be able to drag it out before a sheriff physically evicts me? If I can buy myself 90days I will be fully caught up $7,000
Can a landlord serve me with a 30-day notice to pay $10,400 equal to 3months rent which reason for collecting this is stated as being a “deposit” that was never collected at the beginning of move-in because everything was completely verbal all the way up until literally 2months ago. We are month-to-month and have resided at the property for just under 2years and this is the 1st time anything regarding a deposit has been brought up. Due to the request of the Rental assistance program wanting supporting documentation of a rental lease he backdated a month-to-month lease dated from the time of move-in going on what is now two years ago. Can he request this large amount of deposit 3X our rent which is @ $3,400 monthly when never stating or ever any talk of a deposit overall after so long? We also reside in the jurisdiction of what is considered to be “the City of Los Angeles” as you know currently still holding their own local city ordinance. The short answer is maybe and you'll need to discuss with an attorney ASAP. As for collecting a 3 month security deposit, this is only allowed if the unit was rented with furnishings, otherwise the max is 2 month's rent. This tactic is a loophole in the eviction moratorium...
I’m aware of the 3 month deposit that can be collected if furnished. My question is more so about the timeframe that we are now in which is 1 year 7months from he time of moving in and never had any lease until recent months for program reasons of rent assistance one was created. However; no deposit has ever been collected or asked whatsoever or even mentioned in the lease that we recently created just months ago nothing was asked and nothing was given. Can he collect a deposit randomly after 1 year & 7months later out of nowhere? For $10,400 knowing we did housing is key he was paid but our situation still faces hardships unfortunately and reside in la city where eviction moratorium has still not lifted and remains in affect as of now. Obviously if we are facing difficulties paying rent how would one effect a $10,400 deposit to be made this long after residing at the property abs being up to date until recent months. Can he kick us out for not following through with paying this large amount even with the la city moratorium still in place? Thank you, I look forward to your response.
What's next, how to get away with a hit and run, cheat on your spouse without them knowing, or jump in front of slow-moving cars to get a claim??? Most of the people that are getting evicted are people who were rejected from the assistance program because they were working, among similar reasons. Maybe do a video that gets money from people providing online legal advice, the simple disclaimer that you mention does not hold up well and there are loopholes especially when you say this is the form that must be filled out.... best of all this cant be erased once on the web. Why should someone else pay for other's choices/responsibilities? Why don't you pay for people that don't day their rent?

Tenants should not answer evictions, it will be on their record for the next 7 years, win or lose. They should seek legal assistance and explore filing a Demurrer.

If the 3 units have one Assessor Parcel Number (APN), then no it's a triplex and owner-occupied triplexes are not exempt from AB 1482.

Hey there Christian!! Thank you for posting this video. Ozzy’s mum is still having trouble with her landlord, they are trying to say that she agreed to the new owners rent increase of 300% back in June. Yeah 300%. Who in their right mind would agree “verbally” to that rate increase! 🤦♀️
She hired a totally useless attorney and she’s not getting anywhere with “Stay Housed LA”. As usual they are always too busy to help. I told that a verbal agreement in CA isn’t won’t work and that the owner had plenty of time and could have gave it to her in writing. She just paid October rent at the beginning of the month and they sent the check back saying that there is an eviction in place, but there is no current eviction!!! Any ideas for help for her? Hi Paula, sorry she's going through this! The rent increase needed to be in writing with a minimum of a 90 day notice (and it's debatable whether it could be increased that much). Document everything and tell her to keep sending her rent in for the first of the month...if and when she does get an unlawful detainer, then make sure the attorney helps her answer. You know I went down to the court and tight as I was talking to the lawyer the owner called I put him on speaker I said why did he lie about I owe 3 months rent wen I'm paid til Oct he said he wants to pay me out to move I said if you woulda handed me a 60 day I woulda done it I go you committed fraud he goes I know but I'll pay you the rent and u can move I go that's fine the lawyer said I jave a solid case and now a recording of hi. Admitting I. Paid up

Yes, courts are busy in LA. Sheriff isn't involved until after the court case...so you have some time, but discuss with an attorney ASAP.

What if you didn’t get the UD-100 form and only received the summons?
Sounds like maybe it was done incorrectly. Use the attorney resource links in this video ASAP.
@@WIREassociates thank you for responding. I spoke to legal aide today and the attorney suggested I complete the filing of my response answer and to also file a dismissal. However when I went to the self help office at the court, the legal aide helping me with the case said the UD-100 was optional and not required. The complaint was typed in the attorney’s form. I mean, it’s not as if I’m evading service but the mailman seems to lose and mix up mail often, smh 🤦♂️ and to top it off I don’t check my mail bc I lost my mailbox key , I know. Also who really knows if they left any paperwork on the door surely someone must have stolen documents as I noticed a small ripped corner left on the door but nothing else. What happened? I got a 3 day and want to offer a large chunk of the requested amount and start a repayment plan. If it is rejected how long will I be able to drag it out before a sheriff physically evicts me? If I can buy myself 90days I will be fully caught up $7,000

Can a landlord serve me with a 30-day notice to pay $10,400 equal to 3months rent which reason for collecting this is stated as being a “deposit” that was never collected at the beginning of move-in because everything was completely verbal all the way up until literally 2months ago. We are month-to-month and have resided at the property for just under 2years and this is the 1st time anything regarding a deposit has been brought up.
Due to the request of the Rental assistance program wanting supporting documentation of a rental lease he backdated a month-to-month lease dated from the time of move-in going on what is now two years ago.
Can he request this large amount of deposit 3X our rent which is @ $3,400 monthly when never stating or ever any talk of a deposit overall after so long?
We also reside in the jurisdiction of what is considered to be “the City of Los Angeles” as you know currently still holding their own local city ordinance. I’ve kept up with your videos and appreciate all of your helpful information & guidance throughout this process and clearing up so much confusion that you have done great job in making clear to myself & I’m sure so many others! The short answer is maybe and you'll need to discuss with an attorney ASAP. As for collecting a 3 month security deposit, this is only allowed if the unit was rented with furnishings, otherwise the max is 2 month's rent. This tactic is a loophole in the eviction moratorium...
I’m aware of the 3 month deposit that can be collected if furnished. My question is more so about the timeframe that we are now in which is 1 year 7months from he time of moving in and never had any lease until recent months for program reasons of rent assistance one was created. However; no deposit has ever been collected or asked whatsoever or even mentioned in the lease that we recently created just months ago nothing was asked and nothing was given. Can he collect a deposit randomly after 1 year & 7months later out of nowhere? For $10,400 knowing we did housing is key he was paid but our situation still faces hardships unfortunately and reside in la city where eviction moratorium has still not lifted and remains in affect as of now. Obviously if we are facing difficulties paying rent how would one effect a $10,400 deposit to be made this long after residing at the property abs being up to date until recent months. Can he kick us out for not following through with paying this large amount even with the la city moratorium still in place?

Most of the people that are getting evicted are people who were rejected from the assistance program because they were working, among similar reasons.
Maybe do a video that gets money from people providing online legal advice, the simple disclaimer that you mention does not hold up well and there are loopholes especially when you say this is the form that must be filled out.... best of all this cant be erased once on the web.
Why should someone else pay for other's choices/responsibilities? Why don't you pay for people that don't day their rent?

Tenants should not answer evictions, it will be on their record for the next 7 years, win or lose. They should seek legal assistance and explore filing a Demurrer.
Tenants should always seek legal assistance in situations like this. BTW, an eviction record can be sealed and not show up.
