Neighbor surveyed the property line to prove us wrong! What is even our land?!

    My mom had a survey done, property line was larger to her benefit. Still have a neighbor on one side that removes the markers to illegally hunt. Always get a survey.

      That's good it was in her favor and it is annoying how people are sometimes, is the land still in a state forest program yet, is so they still have some rights to hunt the property, we took ours out to prevent it as much as possible along with posting trail cams in the choke points to catch people

      @@RostiboisADV I don't see it as annoying if it has need been satellite surveyed. My mom's property records were 100 years old, bought from the ancestors of the one neighbor who lost some land, like just poor measuring skills. I've also seen real estate agents fudge it to their customers favor. The hunting neighbor is simply disrespect and trespassing.

      It is my understanding that it is a crime to remove survey stakes and subject to fines and penalties.

      Place a couple cams out there catch them trespassing call the cops have them trespassed and if it continues have them arrested and get a restraining order against them

      have them concrete in a deep an set up cameras an paint your line with purple paint an have the cops witness this an if you catch him have him arrested also call your local game warren show him or her where you line is an they can sneak up on him in the act

      @@RostiboisADV GIS stands for get it surveyed. The GIS maps are developed by putting surveys together. The more surveys in an area the tighter the the GIS is. In some area we work the maps are good to within a few feet and in others their good to within 20 feet. The app your using is only as good as the county GIS/Tax Map and we're still running into a lot of properties not drawn correctly.

    You could have gotten a survey yourself. It's always a smart thing to do when you buy property.

      Yea, it was in our best intentions but we were having a hard time getting a forester on contract and it went to the wayside

      I've had that problem too. Now my biggest problem is meth heads and trespassers stealing everything out of my cabin.

      @@RostiboisADV I'm curious why you would be using a Forester to identify property boundaries. Unless the forester were also a Licensed Surveyor or Registered Civil Engineer could their findings be relied on ? Perhaps there are differences in terminology in my area. Anyway, I hope you can resolve relations with your neighbor. It sucks to have enemies for neighbors. Best wishes !

      @@noyopacific If I may, I've had both a registered land surveyor and a forestry consultant survey my forest boundaries. The land surveyors are essential for locating and flagging the property corners, any buried irons, and generating a plat map suitable for recordation. When I walked the property boundaries with the forestry consultant though, it was an education. He pointed out the original axe blazing on the boundary trees, from generations ago, that I had never noticed and explained their meaning to me. So for the legal side of things, a land surveyor, but the forester has unique skills as well.

    Set T posts right next to the wood makers while they are still up. Maybe paint them bright yellow. If you can get GPS coordinates on the posts as you put them in that wouldn’t hurt incase they get moved for some reason.

      You can also put some witness markers in the ground nearby, measure like 5' or 10' away at about 90 degrees apart, then you can always reference the spot back in if someone... "moves" the original marker.

      @@sicsempertyrannis1849 You stretch a string between the witness posts which are set in concrete so that they cross on the survey marker. Then you ask the surveyor to come back out and set a permanent iron marker in concrete. On the corners of my land, I stretched string on pins in an X in the 4 directions along the boundary lines, then measured 3' from the survey mark and used a power auger to go down 4', inserted a piece of white 4" perforated plastic drain pipe level with the survey pin, poured in concrete and set a 2' piece of 3/4" galvanized pipe flush with the top. If the pin is disturbed, it can be properly relocated by inserting rods into the pipes in the witness posts and stretching string between them, making an x where the marker should be.

    Unless your "Forester" is a licensed surveyor, his/her markings will not hold up in a court of law to the metes and bounds description on the deed (the title to the land). You should have a GIS photo map of your county and the property lines marked on that photo at the courthouse and can access that by either contacting the courthouse or through the website. Type the county of the state and GIS - your search engine will load the site and you can locate the tract by either the map or the owners name. County employee at the Clerk's office (where the deeds are registered) can help with instructions The lines will be too big on the photos to zoom in but you can get a real good idea of the limits of the tract. Hope this helps.

      We have a gis of the and the coordinates on the deed and what was marked matched our records and was in line of the corner markers. But if anything continues I will keep it in mind.

      I don't know what a "forester" is, but surveyors must be licensed by the state and only their work is valid. And probably violates law. Get a copy of that survey and the license number of that "forester" or you may learn too late if his work is faulty. Don't fool around with surveys.

    We had someone that went to city hall and changed property lines . The lady working there said “ I dont know “. We brought in original paperwork from 100 years ago . They still said “ i dont know .
    I put up the fence on the original line from 100 years ago .

    We hired a surveyor and had our 35 acres marked along the lines between the corner markers. Then I bought a County Line auger at Tractor Supply. It runs of the tractor PTO and makes setting posts easy. I am putting in H braces at the corners and every 100 feet. T posts between. And lots of signs. Good fences make better neighbors. We are in sw Colorado.

    Congrats, but do yourself a favor and put some more permanent markers where the survey stakes are. One season and they will start to be gone. T posts or something painted bright work well.

      Thank for that we plan to walk it multiple times a year and mark it with blue paint, I'll have to keep the t posts in mind for the sparce areas

      Absolutely agree and save you thousands of dollars on a future survey, paint some rods and pound them into the ground and you can even pour some concrete powder at bottom of rod it will solidify with moisture of ground, for future reference, believe me on this will come back to haunt you if you don't, I've been through something very similar

      @@RostiboisADV No dude, now before the marks start moving. Also, take a string and set up accurate lay lines across any BIG rocks. Chisel lay lines into the rocks. Stakes move more than big rocks or hidden marker posts.

      Yea it happens almost way to quick at times and if you are an outsider they try to use the way it is against you. I am happy the other neighbor kind of warned us with them.

      Real Estate salesmen are simply that... Salesmen. Buyer beware. If a real estate person assures you that some utility pole or cable pedestal or tree is a property corner, ask them what their state issued Land Surveyor license number is....

    I gained 2 feet when I had a survey done. One corner is now under the corner of the neighbor's garage. I am not asking them to demolish it, and they sure are nice to me now.

      Either tear the garage down, move it, or sell them the piece of property that the garage sits on.

    We had a large forest fire in our county a few years ago. It burned down quite a few homes and cabins. Since trees were destroyed and assumed property lines were now gone, a few folks got a survey which lead to the discovery that many of the houses and cabins were on other people's property. Ouch! Get a survey!!

    A forester marking your lines isnt a survey! It should be close but don't think it is considered a leagle survey. I would get some galvanized pipe and drive it on your corners. I have a painted pipe sticking above the ground and also drove some into the ground in case someone pulls your painted markers out. The ones flush with the ground can be easily found with a metal detector if needed!

      We are able to locate the corner markers and as of now I am good with the line markings since all line up but we definitely will add more permanent posts to mark the line

      We are definitely on the side of at least gating the old logging trails that connect the 2 properties and we are in the works of a real survey

      Yes I've set up with the loggers to cut a 16ft wide path all way around my property boundaries. I'll put the fence in at 8ft that way I always have 8 ft road both sides of the fence for keeping maintenance up. Which my brush hog is 6ft. But I'll be able to keep it mowed

    After my land was surveyed, I painted orange and purple circles around the trees every 75 to 100 feet along the property line because I’m not arguing about where my neighbor thinks his/her property line is years down the road. That was a tough 2 mile hike but worth the trouble to prevent any BS in the future. Only one neighbor got mad but I don’t care. He can get over it or under it.

      Definitely is worth the extra effort memories fade and so does the paint. We will eventually get that as a yearly thing to paint mark the trees

      I'd be marking more trees.... and running fencing as soon as I could, and clearing a narrow walking trail 100% on my side to allow me easier annual maintenance. Those little mini chain saws and bush wackers do a quick and efficient job and the little bit of clearing provides shelter to wildlife.

    In many states if a licensed surveyor not a forester. Places corner stakes they have to register them with the county. It is illegal to move or remove them.

    Sir now that you know your legal boundaries with certainty, you've won a portion of the battle of securing your property and title. Your biggest threat is use, maintenance and possession claims by others. If someone claims they have been using your land or improving it or traveling through it going back many years, the survey is moot. What can you do about it? Become a strong, present, obvious land owner. Do things that people will see and notice and they will see you as someone not to mess with. It doesn't take much. Recommend some gates on those trails for starters. I recommend some discreet cellular cameras placed where they are not observable from off property but will cover likely routes in and out. That way you can always pop in virtually to see what is going on. Congrats on the new land.

      We definitely make our land use obvious and have unfortunately came to no trespassing signs taken down which were clearly on our side of the line. Us and the neighbors need to meet and gain an understanding.

    Drop t posts in asap so you can avoid any “accidental disappearing tags and markers” cut a 3 ‘ line along each boundary line and put posts w bracing in on the corners so you can maintain going forward

    You might consider offering to pay 1/2 the cost of his survey. It could serve to build good blood between neighbors. Good neighbors are priceless.

    In our state, purple paint is one of the legal methods for marking woodland property lines. Check your state law and if it's a purple paint state, paint your trees in accordance with the legal standard for minimum length of paint lines, height from ground, and distance between the paint markings then of course, video and photograph document it. Sounds arduous but you could do it in conjunction with one of your videos and it doesn't take long to do and could be part of your regular property inspections. Land is one of the most pilferable possessions so you should be doing this to guard yourself from adverse possession and prescriptive easement from neighbors or others. Also post No Trespassing signs as well but I'm sure you're all over that.

    Take a piece of rebar with a large washer welded to it an set them in concrete at different points so you can relocate the property line later in life. Make sure to mark all corners.

    I owned my property for about 5 yrs before we built on it. I never paid attention to any survey stakes and didn't really know what was mine other than by looks. When we drew up plans for the house and shop, we walked it out with my builder and did all the planning.
    Next thing we know, the bulldozer had taken out the fence and trees by the neighbors house and going over where he parks next to his house. The neighbor got home from work and threw a huge fit saying we tore up his property. I looked at my builder and he said wait a minute. Looked at his phone at the plans and said, "No, we tore up ours." The fence was about 30 feet off.
    The neighbor was pissed as he had been parking there for 10 yrs and assumed his property went to the fence. I wasn't trying to make an enemy so we had the surveyor go back and mark every 8 ft. That way, I'd know exactly where the fence post would need to go with 8ft sections. It went within 15 ft of the neighbors house and my shop was 15 ft from the fence line. I originally thought the shop would be about 60 ft away from his house but ended up being 30 feet away.
    We ran out of funds and could not afford to pay for new plans, new permits, etc, so we kept forward with the original plans. Now that it's been 4 yrs, I get along with the neighbor, but I always sense animosity between us. He's told me several times that he understands, but it really spoiled his plans of putting an enclosed garage next to his house. Plus, now my shop is close to his house, and I'm sure he hears me beating things though he claims he doesn't. Not to mention now he looks out his bedroom window to a huge wall, being the back of my shop.
    We live on acreage but we didn't realize an acre really isn't much when you build a house and a shop along with driveway, parking, etc. My shop sits on the front acre, the house sits on the back acre, and we feel cramped.

      That's unfortunate and it seems like he would have built on your land if you didn't build first. So the issue would have been reversed. Property lines are sadly a source of too much conflict.

      I have found that people will buy 3 acre residential plots and immediately try to expand it into their neighbor's undeveloped boundary areas. I always tell people moving out here that three acres is not three miles and if you buy 27 acres then someone will want a portion of it.

    A proper survey will place permanent markers in the ground.
    It will be up to you to keep up where the markers are.
    My brother sunk a pipe in the corners where the markers are placed on our land so you can see them from afar.

    Just because a survey shows property lines in your favor, a neighbor can still be right due to adverse possession laws. The only 'winners' at this point will be the lawyers.

      That would be a shame if they would pull that, previous land owners were a logging company so they probably didn't pay attention to boundaries since no one would be present

      Fences fall under the law of acquiesce, similar to adverse possession. If the fence was there long enough and always recognized as the property line, your neighbor has a quiet title claim against you.

    In Canada when theres to much property line to fence we just clear cut a strip off the property line so its easy to see

    Need to have licensed surveyor perform boundary markings. Also need to have a title search and update to the property. Then a letter needs to be sent out to neighbors to be notified and let you know of any disputed boundaries. The laws need to be updated in all states because encroachment or homesteading is a problem and allows people to take possession of your land. The lawyers have built cases stating if someone uses a piece of your land for so many years they are entitled to that section. It's how crook neighbors and not honest people along with our government screw law abiding people over. The adverse possession people know what they are doing which is a crime.

    My suggestion is to contact the surveyor to see if you can have them replace the wooden stakes with pins set in concrete. Since the surveying has already been done, it should not cost much if you drill the holes with an auger and mix and pour the concrete.

    Spending money on a surveyer is MONEY in the bank. Once the surveyor sets the flags and pins, go back and drive rebar (Yes, 1/2 rebar) into the ground to make sure your markings will last a long time! Good luck!

    Perhaps in an attempt to “mend fences” with the neighbor you could offer to pay a small percentage of the survey? If your able. You may not owe him anything but creating good neighbors can pay off big! Glad you are correct.

      I understand your reasoning behind it but all of this was engaged by them with marginal hostility, this fence will end up a wall unfortunately. Thankfully we have several other neighbors that we have good relationships with.

    Alot of old surveys done before or at least recorded before 1950's where done very primative and can be disputed by a license surveyor, seen this many times where a land listing, recently seen plat from the 1940's on a so called 10 acre tract turned out to be a 14 acre track! Though it could have easly went the other way too!

    I had a neighbor who had always used part of my yard before I purchased it. His wife came over to tell me they always used it and would continue to use it. One day several years into ownership, I found the land staked off and fenced preventing my entrance. I confronted the neighbor who told me it was always their land (they changed their story over time). I told him to remove his fence and posts and that he was able to use the land as always but not to ever put up any posts/fence on it. Neighbors can sometimes get quite squirrelly over boundries. Once you get a proper survey put up your own fence with enough space on the outer side to maintain it. Don't be a fool.

    Its always necessary to get a surveyor, not a forester to do a proper title search and survey done when buying a piece of property so it eliminates any unnecessary squabbles with a neighbor who knows their lines, and someone who doesn't. I have been through it and had new land owners move the survey stakes.

      Moving the stakes is highly illegal, it was a mis read of their property map and both theirs and ours lined exactly the same over land features.

    A GPS will get you close and if the corners are staked with steel a mimers compass or metal detector will find them. We have remote off road property that was surveyed by the state and this is how I found all the corners.

    I've owned the land I live on for 30 years. During that time our neighbors have surveyed their side 4 times. Every time our land gets smaller and theirs gets larger. At this rate our home that has been here for 50+ years will be on their land by the next survey.

      That's a damn shame! I have seen from another comment of a guy stating a potential GPS shift of the lot lines which you would assume they would resort to the geographic marks they physically place.

    With the new technology millions of land owners are finding out lines are off by a lot. Some are loosing cabins and buildings or working out land swaps to make it right. Lots of heartaches arguments till you can get a new survey done.

      I can definitely see that happening, thankfully this wasn't that. He showed us his property description and it looked like he was using wrong land features to navigate. And was bullish when we corrected him, which lead to this.

    I was having problems with neighbors on both sides of my property when cutting their lawns . Of course they thought they were correct but they were wrong . I went to the city and got a copy of property lines and I found the survey stakes in the ground . I marked the stakes with fiberglass driveway markers on my side of the property . Problem solved .

      We have found the survey stakes on our land and thankfully everything lines up, it really sucks they they were getting you from both sides and good you had an end to the issue

    Foresters are not surveyors, so those are not legal boundry markings. Sadly this means you are no further ahead. Ironically, it seems a legal survey isn't much more costwise than a Forester.

      Well at the very least it wasn't any of my money that went into the survey and we have located the original survey markers and everything lines up with a pinned track so we at least have that

    Follow up an put in some steel post on the line to make sure you can reference in the future. Might be a good neighbor and offer to cover some or 1/2 of the survey expense.

    Take photos I've seen were a Nambour moved boundary markers and claimed the surveyer marked it even though the GPS Coordinates were yards a way from the moved makes lucky the surveyer took pic,s and Coordinates on the pic,s

    Surveys on large tracts aren't cheap. If you plan to build near any line get it surveyed. If you and the neighbors can agree without that expense all the better, especially for recreational property.

    Always get your own survey! I had a boundary issue and had a survey done, found a large chunk of my land was being claimed by a neighbor and they freaked out and did some measuring to see my survey was correct.

    Had a land broker with a corrupt surveyor steal land. They did it to all three abuttors. The other two and the guy who bought the land sued and won. Markers went back to where they were. When the land buyer showed me the map, I pointed out that the giant oak tree that was used as a reference on the maps had been cut down, after a town snowplow hit it, in the seventies. Found a few photos of that were used in court.

    I had a new neighbor that decided to have the property surveyed. They were told the old elm was on their side by the seller and planned to have me take down electric fence for the cattle but when the land was surveyed it turned out they had built their fence 6 feet over the line. So since it didn’t go their way, they told the survey company to send me the 1800 dollar bill for surveying their land 😂. I couldn’t believe it when the survey company called to ask when I was paying their bill. The new neighbor wasn’t welcomed to the neighborhood by me. Happy they sold after 3 years ago and the new neighbors are Great.

      Wow I can't believe they tried to send you the bill after they were proven wrong! My neighbors haven't sent anything to us yet and hopefully they keep to themselves after all this. But we still want to survey our land itself to have a better understanding to the public land and the other private property by us.

      No we have documents showing the legal corners and boundaries of the land, it is a neighbor that is unable to read a map of his own property. Unfortunately this sounds common of them according to other locals.

    That new survey may not be correct if they're using the old markers for a reference point. The old surveys were done using chains and weren't that accurate. I used to do this for a living and in one case the Union Gap the survey markers were off by 100's of feet. Yakima and Union Gap ended up going to court to see who owned what. The court decided to leave the wrong survey in place because several hundred houses had been built since the original survey and fixing the issue would have required 100's of homes to moved and the city would have to redo the sewer, power, sidewalks and roads.

    Get your own survey so you have an official copy of what you own. Go to a junk yard and get a few truck axels and pound them into the ground at each corner, you will always be able to find them with a metal detector. Also use T posts painted (top 2 foot) with a bright color (I use international orange) at corners and along property line.

    a friend went out one day and let a balloon on a string go up from one marker. and his friend went to other ones, and viewed the balloon. (calm day) and got a GPS direction and walked it out, by one person going in the direction that the person holding a compass could see. stop and flag and keep going. they even did one at night with a flashlight that shown up into the start of the fog setting in. to get a bearing. On property disputes, usually whoever paid for the survey, wins..

    Assuming you can get an accurate GPS, go to each marking and take a photo and GPS mark. Photograph the image of the GPS marker on the pin so you can't be accused of false recording. The go to your local bureaucrat's office and have it recorded with update data.

    Why wouldn’t you do your own survey of land before purchasing? I found out my road was a private road after purchasing land and I had to get an agreement for the life of the property. The owner had to allow us access to our land on his Road. Pleased to have a survey before investment.

    Because im having to pay to mark it for the forester.
    I ask him whats wrong with the new survey i gave him a copy of.
    He said surveyors only marked the corners. And for the loggers to do the thinning ill need it marked every 100 - 200 feet. I called the surveyors asked if they could mark property boundaries every 100 - 200 ft and he said yes for $7000.00. Im like i just paid $16,000 for a survey . Smh...

      Some of the factors in considering the cost of making boundary lines is the length of the lines, what the terrain is like, and if using survey grade GPS to measure to the line, what is the tree canopy like. It's also pretty labor and time intensive to mark up those lines. At least you have the boundary corners marked already, which is what you would need before any line marking can be done.

    Forester's marks are probably only accurate within 25 feet so don't treat it as a hard line.

    We bought almost 9 years ago.....chain link and barbwire fence existing .....HUD property....
    Got a survey to mark the rest of the property since old markers were only on corners.
    Existing fence "grandfathered" per surveyor. The fence ran "right along the property line" per our surveyor. Neighbor even told us that he had "helped" previous neighbor "improve and repair" parts of the fence. Chain link fence rusty with trees growing up through it - had been there so long. We estimate its been there over 25 years, since it was reported to be there by other neighbors who had been there this length of time.
    About 7 years ago, crazy neighbor had a survey done that put markers several inches inside the existing grandfathered fence, on our side. (He's been a jerk since day 1).
    He finally took them down after about a year. We just mowed around them.
    People are CRAZY!!!
