15:42 According to my gov. class and textbook, Miranda Rights don’t have to be read until right before the questioning/interrogation begins. So, she didn’t actually make a mistake. Movies have just made it a habit to read them when the arrest is in progress.

You forgot to sin the fact that Claire didn't know what a "flash drive" is called (referring to it as a "sticky thing"). Given her line of work, you'd think she'd eventually know that the thing you stick in your laptop to save info is called a flash drive. Like, what happens if she needs to buy another one, does she just tell the Office Depot employees "I need another... I forget what it's called, that thing you stick in your laptop to save stuff", and the employees just get it for her without explaining to her what it is? (ding)

It is a common misconception that cops have to read Miranda Rights when a suspect is taken into custody. The trigger for a Miranda Warning is being in custody and interrogation or questioning. So the police officer in this movie is not in the wrong. Just thought I'd put that out there.

15:40 well you should know that you only need to give the Miranda admonishment if there is custody + interrogation. The detective character wasn’t asking him any questions related to the crime, she was just reading him his charges. Therefore, the Miranda rights didn’t have to be read

15:45 didn't forget, just isn't actually necessary right now. Miranda rights are only necessary prior to questioning, given they're getting carted straight off, based ona pre planned bust, they aren't going to questioned at the scene about anything, and will be questioned later at a police station/precinct. As long as they give him the miranda rights before they question him, nothing is wrong there. Miranda right do not need to be read immediately on arrest.
Fun Fact: if you're ever told by a cop not to go anywhere, then technically you're "arrested"
@@michaelgoodwin80 Fun Fact: Not always. Look up the difference between a detention vs. an arrest. While they may appear to be the same thing, they are actually very different.
@@harpoonist123 is correct. An arrest is made when they suspect you of committing a crime. A detention can be done when they want to question you about about a crime but you are either not a suspect or they don't have enough evidence to formally arrest you. There are other difference like time limits and other things as well. Also if you are a mental health suicide risk they will detain you to take you to the hospital. They cuff you etc if needed but don't formally arrest you.

I will say, even when a couple has been together for a long time, they do sometimes miss obvious nonverbal cues. No matter how many times I've used the squeeze hand signal (and then later had to explain it when we resorted to finding another way out of a situation) my partner will probably never get the hint... love him, but some guys are actually that oblivious.

15:40 or so-- An arrest isn't invalidated by the lack of Miranda. It's just the information you get from the arrestee that can be compromised. You only need to give the warnings if you need information from them that you plan to later use in court.

Disclaimer: Miranda rights are not typically read at the moment of the arrest. That doesn't come until later if they need to question the suspect in custody.
The arresting officer is the one who's supposed to read Miranda Rights, not the cases detected, unless the cases detective IS the arresting officer. In this case, she clearly isn't.
Cinema Sin Sin at the very end. You made the common misconception that police have to read the Miranda rights when arresting someone. The only really need to read them prior to questioning them if I'm not mistaken.

15:40 She's arresting them, not charging them, and you don't need to Mirandise someone when you arrest them.
funny thing about miranda rights is, not being read them is not a get out of jail free card. It is the law that the suspect must be advised of his rights but in cases where it's obvious that they already know the rights, such as if they are a government official it's not necessary. It only ever comes into play if one of those rights are violated such as they did not know and were not advised they could have an attorney present during questioning.
I'm surprised he didn't sin the part in the beginning where a clip of Carrell is played in reverse and the steam behind him goes back into the ground.

You don't have to be mirandized unless they are questioning you. Per my lawyer when I was in trouble. The Miranda is read when a person is in custody and the officer is what's referred to as interrogating-is questioning an individual about his crime or criminal activity.

Fun fact: you DO NOT have to be read your Miranda Rights. If police don't read them to you, it is not a magic "get out of jail free" card. I found that out years ago when I was arrested and not read my rights. My lawyer said that's a fallacy and police are not required to read your rights, they just have to provide you a lawyer if you ask.

also in the scene where their cars car attached about to hit the police blockade, she’s in a manual car and she shifts from neutral to 5th gear. This is going to stall the car almost immediately. Even with the added momentum coming from the Crown Vic pulling the Audi R8 the opposite way of where the cops blockade was set up, she definitely stalled the car doing that . there’s a time gap where the power from the engine goes from reverse to any forward gear in manual cars. In short going into 5th gear would have most likely resulted in her stalling the car. Not to mention If the goal was to not hit the cop cars you’d shift into a lower gear from neutral for more torque/power (gears 1 or 2 max) to counter the previous direction’s momentum you were being propelled by, not by putting into 5th gear where although the high end speed is greater than the lower gears, the torque is low when the car is almost at a standstill in a situation where you need torque. ...So ... *sin bell*
