And Slayer may not be a Dream Theater, but they know how to pour every ounce of themselves into a song and fill it with passion & emotion...something all the technique in the world alone cannot do. It is easy to sit back and be a musical snob- picking apart 90% of what you hear, but what good is a song if it doesn't move you?

Ummm! if you think either artist/group was the first to play that pattern of arpeggiated triads your mistaken... its very common all the way back to chamber music, classical eras and a whole load of other places. Finally, it slightly follows the pattern but its articulated differently and the tail of riff is quite different. End result... Not a rip off and certainly nothing that infringes on copyright or anything like that.
Why dont we go over the similar notes in a Megadeth song that is similar to some notes in the national anthem while we're at it?? Jesus christ, coldplay was sued because the chord progression was exactly the same for MANY bars. This is TWO broken triads played in different ways, so there is no reason to sue:)
James wrote a lot of the material too. Don't go saying they stole shit when most of RTL, all of MOP and AJFA were totally aside of Dave's writing. Those were Metallica masterpieces and they made them without Dave.

I don't really care either way, because the best part of Kill 'Em All is the melodic solo in The Four Horsemen, which is 100% on-the-spot Kirk Hammett improv.
