  • Florida man faces trial for a catastrophic school shooting, but before he does, he must face jurors for a battery case. Prosecutors say that’s Parkland School Shooter, 23, on footage rushing a Broward County jail guard in November 2018. Jury selection is scheduled to start Tuesday, Oct. 5 at 9:30 a.m. ET. Opening statements are scheduled for Oct. 18.
    The Shooter is the person facing 17 counts of first-degree murder, and 17 counts of attempted first-degree murder for opening fire at Marjory Stoneman Douglas High School in Broward County, Florida on Valentine’s Day 2018. Then 19, he was a former student there. While awaiting trial at the Broward County Jail, he attacked one of the guards, say, prosecutors. In the Nov. 13, 2018 incident, the guard told him not to drag his sandals on the floor, prosecutors said. The Shooter flipped him off, and, as clear from the video, rushed him and struck him. He initially had the upper hand, but the guard regained control, and The Shooter eventually gave up.
    17 people died in the high school shooting: 14-year-old student Alyssa Alhadeff, 35-year-old teacher Scott Beigel, 14-year-old student Martin Duque Anguiano, 17-year-old student Nicholas Dworet, 37-year-old assistant football coach Aaron Feis, 14-year-old student Jaime Guttenberg, 49-year-old athletic director Christopher Hixon, 15-year-old student Luke Hoyer, 14-year-old student Cara Loughran, 14-year-old student Gina Montalto, 17-year-old student Joaquin Oliver, 14-year-old student Alaina Petty, 18-year-old student Meadow Pollack, 17-year-old student Helena Ramsay, 14-year-old student Alexander Schachter, 16-year-old student Carmen Schentrup, and 15-year-old student Peter Wang.
    Officials arrested The Shooter shortly after. Interview footage showed him insisting a voice in his head told him to carry out the shooting. He called it the “Demon.”
    “Personally, I think you’re using the demon as an excuse,” said Broward County Sheriff’s Detective John Curcio.
    The Shooter’s defense has not disputed that he is responsible. They have been trying to save him from the death penalty.

      I'm not sure about Florida, but in Virginia, they can only suspend your gun rights if you're involuntarily hospitalized. At that point you can go to court and request them back, but that depends on the situation. They can take them if you're found incompetent, insane, or convicted of a felony.
      It's not easy to take someone's constitutional rights. We definitely need better gun laws, because this kid should not have owned guns.

    I never comment but I literally cringe every time the assistant state attorney cross examines. I don’t see why she has to literally argue with every single witness including the professionals. I’m sorry but she is extremely belittling and rude, yuck!

      This young man came from a drug and alcohol fumed womb and thereafter certainly fell through heaps of cracks in the school, health, mental health, foster and adoption systems in later life.
      Sending Nikolas to a mainstream school was perhaps also not wise - He did not have normal development in the womb and does not seem to have learnt any valuable life skills after birth and as he grew up. He, therefore, no doubt, must have felt inferior to his school mates and certainly built lots of inward anger. Who knows, he could possibly have flourished in a school for disadvantaged children?
      Various people made him feel incompetent - Neighbors and peers called him "weird", "off", etc in his presence. Absolutely scandalous, the harm that causes a young mind.
      Why is a scan of Nikolas' brain not made available to the Court? What Nikolas did was truly unheard of, he murdered and wounded people after much planning, ie predetermined. His mind was certainly in a very dark place and he had so much anger driving him! Despite that I would hate to see that Nicholas may get life imprisonment or perhaps even the death penalty, whilst society failed him in so many ways.
      Perhaps this is also now a very good time for the USA to realize that the existing gun laws are not working but instead are causing unnecessary deaths.

      @@jx14aby actually no! Let us refrain from victimizing him too much. Hundreds of thousands of children are born to drug addicted mothers every year. While they struggle with early withdrawals, mood swings and developmental delay…they usually don’t shoot up schools. He was adopted by a loving and wealthy family. He was better off than many.

    In a nutshell, this was not a good day for the defense. Their witnesses testified that NC was a bully and that "he made bad choices", the last witness, a pharmacologist testified that he stopped taking his meds in August 2017 at the age of 19.

      We already know he knew what he was doing his focus whether ADHD or not was razor sharp, he had enough organizational skills to make a plan, carry it out , and analyze the amount of horror he was capable of. He had complex thinking and abstract perception of himself in that situation, and did his own reporting and analyzing

You know a man drove miles away and killed his parents in law with an axe and went to sleep. He was freed because he was sleeeping whilst doing it. He could plan it at sleep! He was ordered medication and help. You do know that brain is complex. You can have brain damage and be able to plan things without understanding consequences or having no empathy. Where is this line exactly? When he talks to his brother in prison , he seems normal to you? His texts seem normal to you? You need to have no observational skills to notice he is nuts. Someone you would not want to play in playground, go on a date, invite home or maybe give a gun to.

    The attorney with the dark hair & glasses, who has been doing the cross examinations is very good at his job! Easy to listen, follow along, and polite to the witnesses. On the other hand, his colleague, the firey red head, has been playing mind chess with the witnesses, and I don't believe she's winning at all. Her demeanor and tone is so rude and unpleasant, not to mention unprofessional. She should take pointers from her colleague.

      @@christianjward I'm glad I'm not the only one who sees it lol She just seems inherently angry and continuously on the defensive from her initial question to the defense's witness at the conclusion of today's day of trial. She has exhibited the same behavior twice before with other witnesses and the judge has already reprimanded her about her line of questioning and interrupting the witness answering the question as the stenographer could not keep up with two people going back and forth simultaneously.

      @@lisadee9279 she isn't though. Her cross examinations are full of misunderstandings. Aside from that, she's just rude. None of the other prosecutors are rude. Even the judge was getting fed-up of her towards the end and had to tell her twice to move on.

      During jury selection, in a case like this one, those who are 100% against the death penalty or 100% want the death penalty are vetted out. Each juror who is there has said they would give death if the evidence showed it is warranted and life behind bars if that is what the evidence convinces them he deserves.

    Don’t know what the defense is trying to prove with some of these witnesses. They just proved he was a bully who was capable of regulating his behavior when a “strong man” was in the room.

    The prosecutor hounding an elderly woman on oxygen is disgusting. She tells him she hasn't been in their lives since 2010 and he goes on and on about 2013. That woman was patient - I wouldn't have been.

    Good for the last witness for standing her ground to the state attorney. She tried to pick and choose pieces of information and this witness checked her and said No, she was discounting a lot of information. Good for her.

    interesting how much the Judge effects the tone with in the Courtroom as those writing both fiction. & non fiction often remark . As those of us who become intrigued by these contentious cases of whom I am one the atmosphere that pervades frim.the bench & encompasses even more expensive witnesses leaves me miserable. Yes THIS IS .A very serious case but that means the Judge should attempt to ease the difficulties facing all involved with a certain warmth in her approach but rather she comes across as sanctamoniiysly cold .This phase is actually harder to watch than the Prosecution because as the friends & family members told often with such a raw sense of loss & love the reactions between themselves spoke of that commerarderie & sense of their support toward each other one knew that there had been , however hard this public telling of loss was that seeing so many standing besides them WAS a firm.if Healing . They provided a warmth BECAUSE they all .realize how an encouraging smile gives courage . The Judge has sat there like Medusa .allowing the lawyers to badger several witnesses never stopping the uncessary repetitive harassing even when it us the 6th time that particular individual has been asked the same question .Begin to wi Der how many of these officials also have ' learning disabilities ' Does this equal a new meaning for " inadequate counsel " on appeal & questionable Judging by the judge ? Something truly seems terribly incongruous ..The Jury must be absolutely miserable as they file in facing this cold atmosphere no wonder there are so many breaks . Maybe it is a surfeit .of " superfluous " from the .breaks to.repetious questions

For all you know her face could have been disfigured in an accident, from birth, etc. This trial is about a heartbreaking mass murder that destroys so many lives not about witnesses physical appearance.     Nikolas Cruz was dealt the worst hand in life. He did not choose to have a drug addicted mother. He was not born with the same faculties the rest of us (most of us anyway) were born with so he was incapable of dealing with the complexities of life the way society expects us too. Nikoals did not choose to have his father die when he was five. Nikolas did not choose to have a psychopathic younger brother who made his life miserable. Mrs. Cruz, God bless her heart did the best she could with an impossible situation. As a mother, I put myself in her shoes and I just cannot imagine what she went through, and if she was alive to see this, my heart breaks for her and Nikolas. Nikolas had nature and nurture going against him. All of these are mitigating circumstances, whether you like it or not. I am not making excuses for Nikolas. Nikolas Cruz should have been in a locked down in-patient facility. But these do not exist for patients like Nikolas Cruz. It is tragic how all the teachers and therapists and doctors each had their own experience and knowledge of Nikolas, but there was no communication or coordination to adequately address the condemned soul that is Nikolas Cruz. No one had a complete picture of Nikolas, just pieces to a puzzle. If they had the whole picture, they should have Bakered him. Then he could not have purchased the guns. The victims and their families deserve justice, but what is justice? I had to look it up: Justice is a concept of moral rightness based on ethics, rationality, law, natural law, religion, or equity. It is also the act of being just and/or fair. Certainly the victims did not deserve what they got, nor do the families deserve the pain they are suffering, but is Nikolas’s death is just retribution. It is not justice. It will not bring them back or make them whole. Nikolas’s death will not make anything better for them. Nickolas is guilty and he should be punished, but is death a reasonable and just punishment?

      Yeah but he understands death as he lost his Dad then his Mum. He knew how hurt he was. He thought it through, and with complete excitement he went to hopefully kill at least 20 kids.
      He knew he would probably die, knew it was wrong, he still did it anyway. I only feel sorry for all the kids that have permanent damage as a reminder for the rest of their lives. Also the families who are left behind to suffer.
      If death is not a big deal to him, then give him the death penalty.

      This was her deposition which they weren't planning to use as testimony in this trial. She was not able to testify now due to health reasons.

    Have to say, state/prosecution won today, did a great job retargeting and highlighting the real issues, and showed that NC really was a manipulator, and obviously could make good/dbad decisions mindfully when it came down to it. Very effective, up until the red head attorney came to cross, really? again? pivot your approach lady...... SMH.

      So far, I personally think the defense has done a good job of showing that Cruz was damaged before the day he was born. That is just a fact. Once this is over, it'll be up to the jury to decide what they want to do with that information. Personally, I'm grateful I'm not one to have to make that decision. I have no clue what I would do. I really don't.

      Ummm no , it does not . Because noone gives them gun. Go to special needs school and give them guns and check after a month. This is what i have seen in ADHD ( properly diagnosed not hyperactive child as so many people now are diagnosed as adhd and autistic)
      - hit teacher in the head
      - punched teacher and started pulling hair while shouting
      - shouting spitting saying everyone should die at age 13, banging school bench , had to be restrained and sent to hospital . Was back Im a week them transferred.
      Autistic 14 year old
      - kicked a 2 year old in the stomach like a ball . Toddler flew onto the wall.
      Difference is none of those kids had guns neither any sharp objects could be stores next to them.

      You are reading too deep into this. The defence is trying to prove that his childhood life was horrible and that he deserves a second chance in life be it in jail. They don’t want him to face the death penalty. Whereas the prosecutors are focusing on the crime itself and for Cruz to die because of it. It’s up to the jury to decide what is the best option.

    Help me understand, he pled guilty, it was horrendous, he has obviously been a misfit since a young age, again, he pled guilty - what exactly is the prosecutions objective here - he pled guilty, he has been a misfit since a young child, what is the prosecution trying to prove, what he did was awful, nothing will take away the pain of MSD victims, but I am at a loss here, what is the point of the prosecution.

    It was during Jessica Flournoy’s tesitmony when she was reading aloud all of the behavior problems for referrals that it shows without a doubt he played the system, is a con artist & is a manipulator. He knows right from wrong. He had a mother who tried to get so much help from therapists& counseling. He knew when not to act up, what to say to not trigger flags in therapy. I feel so bad for the teachers & students from this point 7th/8th grade until the murders. The defense can try to spin this story. But evil is evil and I don’t think we’ll ever figure out his mind or why. It’s as simple as every thing he writes and says.

      The defense doesn’t call people always in their favor, those people on the defense were subpoenaed to appear to court and they’re supposed to give their unbiased outlook. It’s more so a collaboration between his lawyers and the judge to make sure that both sides of the story are portrayed accurately.

    I really don't understand why tax payers in the US have to pay for such an incredibly loooong and insanely expensive trial, just for a guy whose guilt is not even disputed, who killed 17 people. Whats the point really? Whether he is gonna spend life in prison or be executed? in both cases this is not going to bring the victims back, and in both cases the murderer will never walk out free again, so the major concern has already been solved for a long time. The trial could last 10 minutes to be honnest. Even the defendant doesn't care if he gets life or death.

    It is INSANE...that NC has so many glaring mental health issues that were documented and was still able to purchase a gun. Insane....
    And whyyyyyy were all of these violent and aggressive actions in school (7th/8th grade) not escalated beyond the school staff!
    NC should have been in an in-patient center and there's no way he should have been able to purchase a rifle.

    At long last we have witness testimony to coroborate what I have been thinking from Day 1 of this Sentencing Trial.
    Lynda Cruz's best friend (at the time) saw with her own eyes how "The Coward" would manipulate (its) mother if (it) did not get (its) way. (It) would throw tantrums but most of all.....(it) would sit at a table slouched in his chair. (It) would pout; often times looking "sad". Now..... Lynda loved her son more than anything in the world & would do anything for (it). When she looked over at him, she would see how "sad" (it) looked & then would relent & no matter what (it) had done, all would be forgiven. The Defendant knew this ploy would work & would use it again when the urge would hit.
    Lynda would seek out the best "At Needs" schools in Florida that would adhere to her son's progress through the years. However.....(it) had many problems such as acting out, biting other children amongst others. The Defendant would be penalized that included suspensions. (It) would also know how to get out of some jams by playing the sullen & pouty self & was able to manipulate (its) way into the "good graces" of some of the teachers. (It) knew how to get its way. It) had the where-with-al to formulate a plan to escape possible punishments. (It) used this self-developed program through the years.
    Let's move on to the present day. During this Sentencing Trial, it seems to be that the techniques for gaining "sympathy" is being used by "The Coward" once again. This time?? The target is the Jury.
    When the State presented Audio Evidence, it clearly showed that "The Coward" was up to (its) manipulations. When the Audio was played, the sounds of gunshots could be heard. "The Coward" started to cover his ears & slump in his chair. Was "The Coward" trying to show the Jury that the noise was disturbing to (it)?? Was "The Coward'" upset at what had happened? Fiddle-sticks!!! (It) was hoping to get the "sympathy vote" from the Jury Panel. Let's remember this.....(it) had fired over 100 ROUNDS during the massacre. The loud sounds of the bullets did'nt seem to disturb or faze this Low-Life at that time!! So why now?? As mentioned above, (it) is attempting to "manipulate" the Jury's mindset. Stuff that (it) does to accomplish this feat, must at all times raise red flags🚩🚩🚩🚩🚩
    When the 17 Survivors who had been shot testified, "The Coward" slouched in (its) chair, fixated (its) eyes on the table & started to doodle on paper, the expression on "The Coward's" face sorta read like this:
    "I'm not a bad person. I'm not
    well so please don't give me
    the Death Sentence for killing
    the other 17 people. Please
    feel sympathy for me."
    This "Coward" could not face the Survivors nor the relatives of those (it) murdered who were sitting in the Court Gallery. Award "The Coward" with sympathy? Think NOT!!
    ⚘️Let's all take a moment to remember the facts of February 14, 2018 :⚘️
    1) This "Coward" made a CONCIOUS DECISION in purchasing an AR-15 automatic rifle alongwith an arms length of other artillary items as he marched to his former High-School.
    2) This "Coward" brought an additional 11 Magazines for (its) AR-15 as he PLANNED to kill as many students & teachers as possible. (It) was prepared for a war!!
    3) "The Coward" knew exactly which building (it) was attacking from the multi-building Campus.
    4) Upon finishing his rampage, 'The Coward" made a planned & decisive "escape plan" by going to the 2d floor stairwell where (it) abandoned (its) vest & weaponary. "The Coward" then intermingled with other students as they were fleeing the building with their arms raised & (it) then made (its) escape. (Thankfully, NOT for too long of an extended period of time.)
    5) Before "The Coward" went on (its) devestating attack, (it) sent a text to a few people saying that (its) former High-School was going to get (paraphasing) a "...big event"...That people were going to know that it "...was him..." as the instigator of this "...event..."
    What does this all mean?? "The Coward" had the "where-with-all" & "mental faculties" to carry-out this horrific attack.
    The "Coward's" Defense Team is going to attempt to portray the Defendent as a "victim" from birth as (it) was diagnosed with "Fetal Alcohol Syndromn" which caused a few serious medical problems. However...through time..."The Coward's" medical situation had & has improved. As well, through the years, it has been proven that "The Coward" has used "Manipulation" to aquire a goal of (its) own. It shows that (it) DOES know the difference between "Right & Wrong". The Defendant's Birth-Mother had a heavy alcohol problem as well as a severe drug problem. Under guidance, the Defense is attempting to show that due to the Mental INcapabilities of the Defendant, the "Coward" should NOT be Sentenced To Death as according to Mental Health Guidelines.
    That being said.....the Evidence & Testimony collected to date, seems to indicate otherwise.
    《A foot-note:》 As you may have observed, I refer to the Defendant as "it", " its" or "The Coward". I refuse to recognize this "entity" as a "Human Being".
    The way "The Coward" is conducting (it)self is abhorent. When the injured (survivors) came forth to testify, I was disgusted at (its) refusal to look at them. Slouching in (its) chair, eyes fixated on the table, told me (it) was looking out for nobody else but (it)self. I do believe that the way (it) was presenting (it)self, (it) was trying to hide; a "Coward"!! As well, I think (its ) attempting to gain some "sympathy" from the Jury. "Oh Woe Is Me" are the words that come to mind. You don't have to agree with my views. I just wanted to explain why "The Coward's" actual name, does not appear.

    I wonder if there is a correlation to male vs female authority figures. Like the "4th period" teacher... was that a male teacher? He had experience with his mom who sounds like a pushover so perhaps he treated female teachers like they were pushovers and try to manipulate and walk all over them. He sounds like a manipulative, entitled kid. Im all for 2nd amendment rights but I do believe someone who shows severe socioemotional issues should be closely monitored.

      Bobby I'll will clear that up for you. No matter what verdict is reached, Cruz will likely be behind bars with three square meals, and a bed. Plus he will have access of many items to get by with the time. Your taxpayer money pays for that regardless. What is your point?

      This is mitigation and there’s plenty to consider. Every witness I’ve seen in this proceeding for the defendant has been excellent and compelling. The defense is doing their job, and doing it well. It will be interesting to see what the jury recommends.

    This person was damaged before he was born. The crimes that he committed were truly horrendous and were committed by a truly damaged human being. I honestly don't know what the consequences should be. I would struggle as a juror. I would need to look up what constitutes a death sentence in his state. As a juror, I would have to simply go by that, because from a moral perspective, I just don't know what what to think. If a person is not in complete control of their behavior, what should be done? How should we view this as a society? He's clearly not safe to be out in society. Do some people need to just be put down regardless of their inability to fully understand their own behavior? Or should should death only be given for someone who is in full control, but decided to do such a horrible thing anyway? I honestly don't know what to think. It's human nature to want revenge, but is revenge always right? I think this is why we hand these decisions over to a jury, because revenge would typically be the decision of the victims. Revenge is not always justice. I wonder how I would feel if he were my son and I wonder how I would feel if my son were a victim of his. I'm glad I'm not the one who has to make this decision, because for me, it's not simple.

    I am wondering if the school shooters are the results of fetal alcohol or drug use during pregnancies. The Country needs to start doing studies about these children born to drug and alcohol addicts to see if there is any correlation.

    Now I understand why, atleast in this case, kids that behave this way go on to bring guns to school.
    Why wouldn't they? They're allowed to get away with outrageous behavior in their classes day after day!
    You're telling me that NO ONE became alarmed by this kid?
    And how about the parents of his classmates? There must have been some students in his shared classes that complained to their parents about Nicolaus. Why didn't any of these parents get more involved in the school's, I'll use their terminolgy, "POOR CHOICES" with how they dealt with Nicolaus?
    I'm not excusing Nicholas' actions that day when I say the following.
    This school is as responsible for the events that day as Nicholas. He's the kid! Since when is it ok for 1 kid to control a class and an adult not to act like the adult when he acts like a kid?
