  • For years, activists have claimed that the criminal-justice system is unfair to complainants in rape cases. However, recently, the director of public prosecutions, Alison Saunders, announced her resignation after it was revealed that the Crown Prosecution Service (CPS) was reviewing hundreds of potentially wrongful rape convictions. How could this have happened? Some argue that after #MeToo, a focus on believing the victim has skewed fairness in rape trials. What do you think?

    everything Ella said either made me want to scream aloud or throw up. horrendous, ungrounded and inflammatory statements being made without a shred of real evidence to back them up. she sounds like a far-right plug.

    Being questioned in court is a type of rape? WTF?!? That’s a good way to muddy the word “rape” to the point of absurdity.

      I agree that this lacks precision. These are quite different forms of harm, I am not entirely sure that "rape" is more harmful than interactive with the police. From personal experiece, having my leg crushed and being unable to walk for an extended period was less harmful than the effects of interacting with the criminal justice system.
      Is having your leg crushed comparable to rape. That's a difficult comparison to make, and will dramatically vary from person to person. But we should not undermine the damage that social processes themselves can have.
      Another point is that one interpretation of what she is saying are "some victims of crime find the criminal justice process as traumatic as rape", this may well be the case.

    Rape for children should carry a life sentence with a minimum term of 25 years !!

    The impact on rape varies from one to the next. The severity of the rape also varies from one to another, was the person a stranger or trusted friend or even family member, how long it lasted, how many people, how much physical damage has been caused, how old the person was, what their religion was, what their relationship with other people is, how self confident they are, how long ago was it, forensics or no forensics… etc
    ALLLLLLL are horrific but it’s not as black and white as people think. It’s always rape but each instances is often very complex in its own right - but no means no.
    It’s a vastly misunderstood thing where everyone has an opinion - esp those who haven’t been raped and can only try and imagine how it really feels.
    There is energy in truth. You can tell when someone is speaking truth or lying.
    I accept there are instances where a trial wasn’t fair when someone guilty gets off or vise versa.
    Rape survivors should always break their silence ❤

    I don’t understand how unwanted sex isn't rape. If you don’t want it, how can you be consenting?

    Being falsely accused is horrific no matter whether you are in the criminal or civil courts. Not being believed is horrific. People don't generally lie about being raped any more than they lie about having their car stolen. This debate sadly didn't include the human habit of victim blaming. It seemed to support all the old tropes of the Rape Myths.No mention that marital rape became illegal in 1992. No discussion of what it means and how it affects families. Perhaps you were asking the wrong questions?

      Total nonsense. Rape is a much easier thing to lie about than your car being stolen. They key here is that no evidence is needed when you report a rape whereas a car going missing is required when reporting a stolen car.

    This issue concerning rape is a very serious issue in the society. And the fact that the jury is in support with the victims. Is making the female gender to use this factor as a scam in the society toward much vulnerable defendant. Am a victim of one right now. A young girl move up to me in the street telling me she was homeless and I tried helping. She told me the police could not do anything and that her mother is a drug addict who abuses. The case is in court and this girl has used it as a blackmail on me. She deceived me to a city i do not know and that I have not reached before telling me she is going to take her life or run away from the care home she is in. I am the only survival here in this country. I do not want police coming to look for her in my house or get me arrested. I took a bus to York think is very close. At the end i gave this girl money to go back to her mum or the care home. She seized me, called the cops on me and I was arrested. Since then i have being abuse and harassed by the cops and this girl. My phones are still with the police, she call my phone with unknown number and am the one that was arrested after she lied to the cops that i threatened to kill her. I have lost my job.
    Some time i feel oppressed ,other times i feel like committing suicide. I suffer psychological trauma. I can not sleep at night knowing someone is lying on my head and that am going to court.
    i recently found out she is 18 lying to be 16 and she and her friend were harassed by a security officer that is why they use me as a bait. Will the police go through this studies.
    Worst of all i have got kids to feed

    I have just been through the justice system as the complainant in an historical case, he was convicted unanimously on all counts. Liam Allen had the same judge that I did for my trial. We were both incredible lucky to have had him. I hope Liam is happy, healthy and finds the woman he deserves.

      @@vickitoriana3454 I wasn't referring to your case. I was referring to the Liam Allen type cases. There are hundreds if not thousands of innocent men currently sat in prison for a decade or more based on only the word of their accuser. It's a travesty to our justice system.

      ​@@davidthompson4383I agree. I find it horrific that anyone would lie like that. The damage is catastrophic. It also makes the lives of genuine complainant so much harder. I have a huge amount of empathy for men like Liam.

    The first speaker pointed out that there is a policy that victims are believed. Then the second speaker completely ignored that and played the victim. I think women that have this opinion that a woman in a marriage or long term partnership that initially tells her partner that she doesn't want sex but relents due to some feeling of obligation, is rape in her opinion. That way the man can get a warning that he is married to someone with borderline personality disorder.

    If its not reported how is your data accurate?, it sounds like your angry that a prosecution relies on the claim and EVIDENCE. If i can be dragged though court and have my life ruined based on a claim - im not hanging out alone with women or hiring woman. Some corporate men are requiring a contract or video consenting to sexual activity or not hiring woman at all

    Abolish docks. How interesting, when I was a victim in a criminal case, I felt the dock was unnecessary.

    Wow that woman took some chance specking so logically about what rape can mean to each individual I was about to get on my high horse and start to school that women and then I have learned in life to wait those pressure ten seconds not to react emotionally to the lady with the redhead like myself and being redhead had it’s troubles to me and to others they never allowed them to stay away from a life situation as I would when I was younger

    That lady never said to get over it what I took from what she was saying that emotional perception of a rape victims are completely processed by individuals however I feel that it’s the worst thing that a human being could go through I can’t imagine the pain of it my friends have been victims and went unreported and they knew there rapist
