PAYING A TICKET WITH PENNIES

  • Trying to pay a red light camera ticket by using change. They did not accept my payment, they called the police, and they had me leave after various empty threats. Is this legal? Who is in the wrong here? Am I just being a giant nuisance for no use? Let me know what you think.

    You've got the footage that they are refusing payment. In a court of law that's enough to get the fee thrown out. You DID attempt to pay using legal tender. They refused it. Nuff said.

    If it doesn't say on the back of the ticket that they do not accept coins well-done that's cash they have to accept it. And don't forget she's the one acting like a child throwing it on the floor. Another person that works for the state and treat you like crap.

    That last cop was TERRIFIC! Money is money! It made me happy to see a cop who made sense. That first guy was more of a "feelings enforcer". He wasn't going by any law or policy. Just the fact that the teller didn't want pennys! Too bad it's not a law, and it wasn't a policy!

    It's unfortunate that we live in a society that gas is up, farmers are being destroyed, food is high, and housing is a dream for full time workers and yet a town can afford to call cops to complain he's paying with change. Wtf?

    You shoulda pulled out the Coinage Act of 1965 Section 31 USC 5103.
    “United States coins and currency (including Federal reserve notes and circulating notes of Federal reserve banks and national banks) are legal tender for all debts, public charges, taxes, and dues.  Foreign gold or silver coins are not legal tender for debts.”

    If you do it again, call the U.S. Treasury Dept. and tell an agent to speak with the clerk/deputies.
    Also, bring a printout of US Treasury law that states US currency is legal for all debts public and private.
    Finally, print out the state collections law that states any payment with legal tender refused is the same as a dismissal of the debt.

    This office should know that people are pissed off paying a fine, and I 100% guarentee you he is not the first to pay (try to pay) with penny's. So, like others have said, it is legal tender and should be accepted. They should have a coin counter if they don't want to hand count. Also I would make the guy wait as the coins were counted to make sure it was correct. There really is nothing more that can or should be done. I don't know for sure, but I THINK that they can not legally say "we do not accept coins as payment " so that is why they don't say that on paper, because they can not by law say that, but they can verbally say it. I am not a lawyer so I don't know 100%. My other thought on this is the clerk working in that office has NOTHING to do with the people responsible for giving you the ticket. All your doing is hurting (aggravating) an innocent person to make a point at a cop or judge. It really is not right, simply because your hurting the wrong person. I get it, I have had to pay a fine I thought was bogus as well, and yes it is a way to express your displeasure. But the judge or cop that gave you the fine in the first place will likely never know how you paid, and even if they did, they are not the one who has to count it. Go to court and fight it, that is the only way to right a wrong.

      Adding to my above comments, in the end it is going to be just as much a PITA (maybe more so) to you because you have to get, count than carry all those around. Definitely not worth the aggravation, just write a check and be done with it. A check book is much lighter and unless it is a bad check you won't piss anyone off or have to talk to a cop.

    When paying PUBLIC fees or fines they are required to take pennies and any other denomination of US currency, The Coinage Act of 1965. If it is a private business they can reject any change and tell the person they have to pay in bills. If it's a private business but accepts payments of public debt they have to take pennies. If it's public debt being paid they have to accept pennies and they can't tell you to roll them up but they can have you wait for an hour while the pennies are counted. Most employees don't know the law and many cops don't know the law either. This video, of payment for a fine being rejected will likely hold up in court and a judge dismiss the fine as paid. However, we've seen judges who think they get to make law who will side with the feelings of whoever was supposed to take and count the pennies. The justice system in the U.S. is far from a justice system, it is more a system of whims and feelings.

      It doesn't matter whether it's public or private. What matters is whether or not a debt exists. US notes and coins (AKA: cash) are legal tender for all debts, public and private. When a debt exists it means you owe money. Being fined by the government is an example of a debt because you owe the government money, therefore they have to accept cash as a payment, else the debt is absolved. The same thing applies to a private debt, such as if you eat at a restaurant where customers pay after they eat, you have a debt, so they have to accept cash as payment or absolve the debt. However, at e.g., McDonald's, they could refuse cash if they wanted to, because they require you to pay before they give you anything, and since they haven't given you anything yet when you are offering them money, no debt exists yet.
      The only way for there to be an exception is if a "no cash" policy is plainly stipulated and understood _before_ the debt is incurred. For example, if you go to a restaurant and before they give you any food or even start preparing your order, they say you something like, "We don't accept coins in amounts greater than $5, do you understand?" Then after you get your food, if you try to pay your greater-than-$5 debt with coins, they can refuse and you are still in debt until you give them a valid form of payment.

    They can refuse to accept your currency, but they can't continue to demand payment, unless they have a policy which clearly states what forms of payment are acceptable.
    In other words, if they refuse to accept your pennies, go to court and the judge may very well toss the charge altogether.

    Legal tender for all debts foreign and domestic it is illegal to refuse payment in American currency no matter the done denomination. That's a direct ticket to not being allowed to conduct any business anymore refusing payment.

    @5:10 They are just being lazy. In theory, if he went somewhere to count the pennies, and put them inside paper rolls they would still have to take them out and count them, since someone could easily just stack washers inside the paper tubes with real coins on top and bottom.

    Should have sent certified mail with a receipt signature required... a little more money but THEY would be counting pennies and record the post office transaction for proof of paying. 🤭

    Yea, it depends on what state this is. If this was Minnesota, where I live they don't have to accept it, and the judge will support the clerks even when it's still legal tender. The last guy I know of that tried this was at the Bloomington courthouse and he actually got arrested. This is a trend that people are following and local governments are taking action.

    Just so y’all know it’s technically legal for them to refuse to accept the money. While pennies are considered legal tender, nowhere in the law does it say that the government has to accept those Pennies, and even people from the US Mint have said that cities do not have to accept pennies as payments for fines.
    Also depends on what each city/municipality says that they will accept.

      The legality of the government not accepting legal tender is a bit of a grey area. Technically it is illegal, but it’s not enforced. Many places may have “policies” of not being able to pay in change, however policy is NOT law. Legal tender is still legal tender according to the Coinage Act of 1965. I know this because it happened to me.
      I too paid a fine in change (not just pennies) and they refused my payment because of “policy”. I got it all on video documentation for evidence and ended up going to court over the issue. I presented all the evidence I had to the judge which included the official documentation of the overall amount that had been counted, presenting them with the Coinage Act of 1965 Section 31 U.S.C. 5103, and them on camera and audio refusing to take my payment. I presented all of this and the judge and I even had the payment with me in court lol. The judge ended up throwing out my citation and dismissing the case. Never paid a cent!

    31 USC 5119 is the law. They cannot deny coins as payment. No matter how much they dis like it an they can be subject to a law suite now because they CANNOT DENY his payment. Boo boo count thebfucking money get on with your life. Thats what you are paid to-do. Your paid to count his change.
