    Hi Oscar. Many thanks for this video. One doubt...These 20 months period (average) should be expected by those who apply with premium processing as well or it's quicker for those?

      No, it's not quicker because Premium Processing only affects the I-140 step, not the overall wait time dictated by the visa bulletin

      You can always file an I-140 regardless of the visa bulletin wait times

    Hi Oscar,
    We have 140,000 employment based IV in a year. How many of those are EB1 and do we have a further breakdown by say EB1 India, EB1 China, etc?

      roughly 28% for EB1, it's in the visa bulletin. 7% for each country for the total (family plus employment)

    Whether each VISA category (Say EB1) 7% limit is applicable? what happens if there aren't enough applications from a particular country (example - ROW) to reach the 7% limit for an EB1 category?

      The 7% quota for each country is an overall quota, not a category quota

      Hi, I don't know what "expatiated rout" means to you. Premium processing does not shorten the overall process , only I-140 step

    If you already submitted for change of status based on table B(when that was still possible), does the stagnation or possible retrogression also affect you ? Or does it affect only those waiting to submit?

      It can affect you if it retrogresses past your PD. Then your adjustment of status will be paused

      It’s confusing because I was never current on table A, only on B. Do they process those who submit based on B or just allow them to submit until they become current on A ?

      It depends on the month. Roughly for half a year they accept cases for AOS based on table B. But they wouldn't give the green card unless they are also current on table A​@@OCC3791

    Everyone in ROW, please contact your congressman, and ask them to increase the immigrant quotas. Current quotas is still enacted in 1990.

    Why L1a approved I-140 dont get same treatment as H1B approved I-140? L1A should also get automated renewal once I-140 is approved?

      H visas don't get automatic renewal. They are able to renew beyond the six year limit

      the threads on reddit, that make predictions based on quarterly uscis report, say worst case 4 months (June), best case 6 months (around August), but now we need to see how many weeks or months the retrogression will be

      I think it's pointless to try to predict. In EB2 we had less than 2 years of "not current" for ROW so even if you try to come up with some data, there isn't enough data to sample from (and that's ignoring the fact that things like demand change over time). Focus on what's important: the quality of your case

      @@donimic9276 no discussion. The first phase of i-140 brings much more anxiety than any other. I am depending on VB now, but my anxiety is nothing compared to the uncertainty of being accepted or not. No complaints

      nothing in life is guaranteed but once the I-140 is approved it is very likely you'll get the green card if you have maintained legal status, were trutful, and you don't have any other legal issue

      You are not the one to decide or assume..oh do according to my statistics and calculations I will likely get GC in 2027. Get over with it.. you have no idea about the messed up immigration system is especially when it comes to GC. Be prepared for another 18 yrs..my personal experience.

      NIW doesn't have a separate quote. It's approx 29% for EB-2 as a whole

      @@jonathannaab2887it means the dates will be pushed backwards rather than forwards. That means if your PD is current now it might not be current in July and you can’t apply anymore.

      @@OscarsGreenCard There is one factor that this individual may not be considering why data from 2019-2023 isn't reliable that is COVID. Those years had high FB GC spillover one year had up to 285 K this fiscal year only 161K. So each year the spillover gets less but the demand increases hence longer wait time. So this year it's 14 months back with 161k allotment, we know the demand is higher and If come October there is only 140k then the waiting time must increase.

      Family and employment are different pools that don't conflict with each other, by law
