      don't know how it is in the states but up in Canada if someone isn't fixing the property to the satisfaction (with in reason) of a tenant then they can withhold their rent till the work is done.
      to me this just sounds like their not fixing the issue only trying to put bandanas of paint on it, same with the building I live ink it has four apartments with black mould in them and they paint over it before new people move in.

    • @MidgetPunter
      @MidgetPunter Месяц назад +8

      @jakstrieder it's similar in the US however you have to put that withheld rent amount into an escrow account and if you can't prove you've been putting the rent money aside then you end up on the wrong side of the situation. Just choosing not to pay rent because the tenant isn't happy with something small or major and they decide to use what would've gone to rent as a way to afford a vacation the tenant will end up losing.

      I have a coworker who owns a number of apartment complex both in the city and in other states, in the twenty years he has owned them he only ever opened one up to section 8 once and stated that it was a big mistake and was happy when he was able to get out of that contract and remove those tenants (they were always breaking things, causing problems for the neighbors, and just being a general nuisance, as is the case with the majority of section 8 garbage)
      Now before someone asks why he is still working when he has this property and the income, the answer is simple: why stop doing what you love to do? He loves his job and has stated that he won't leave it until after he turns sixty.

      He's super difficult, no question about that. He wants what he wants, but he doesn't have to pay for it. Owners, however, do, and if the entire ceiling wasn't damaged, there's no need to replace the entire thing, just the damaged section. But he wants the whole darn thing done because he is not responsible for paying for it. Do, no, too bad for the tenant.
      I'm a city inspector and unfort, this is typical, every day type stuff. I cannot count the number of times a tenant told me that all maintenance did was paint over mold. Yet, maintenance tells me, no, they removed the mold and applied Kilz. The fact of the matter is in the very day the reinspection, there's no visible mold. Case closed, just like the judge stated. We cannot deal in what may happen.
      Also, so you know, the tenant pays the $14, and the taxpayers pay the remainder. So, the owner is getting the full amount. It's just not from the tenant. It sounded as though you thought all the owner gets is what the tenant pays, and I wanted to help clarify that. Pardon me if I misunderstood. Just trying to be helpful.

Our government doesn’t regulate Section 8 the way they should be. I used to have to do annual evaluations to determine if you’re still eligible to receive Section 8. And that process wasn’t regulated very well either. A lot of the people had been on Section 8 for years! I’m talking 5+!!! Yea I agree, I completely understand that people have rights as tenants- and no one wants to live with mold nor does anyone WANT you to, but it happens. Sometimes the renters themselves contribute to it by not using their fans or aerating the space properly. I just think it’s pretty audacious to be paying $14 in rent and still try and take your landlord to court and not pay your rent. What judge Simpson said was totally spot on, landlords aren’t going to willingly let their property fall to sh*t so that no one will live in it or they’ll try and not pay rent. If he’s living in a complex where the management is ‘making millions’ then it’s probably a decent enough place that he’s essentially getting for free. It always seems to me that some of these renters that are on all sort of benefits have the physical ability to come down to court all the time, they have the mental capacity to argue their point in court, but for some reason they can’t work, or work like everyone else that have to sometimes work two jobs to afford their rent? It just makes me aggravated sometimes. Furthermore, he stopped paying his utilities but still had full access to them, must be nice.

      We have a housing health and safety system that'll actually do something about repeated issues though.
      If the house is unsafe and you can prove it then it becomes the landlord's responsibly to fix it and rent is suspended until it's fixed(plus you can sue for costs incurred as a result, but they have to be reasonable so no 5 star hotels).
      Landlords hate it, and it's a last resort anyway(you need to move out if they deem it unsafe, and no one wants to do that), but it's an option if everything else fails.

      How can someone pay $14? I can't believe it. I thought on section 8 you pay 20% and the government pays 80%.

      It’s the mold! Not a new pipe, if u don’t kill and eliminate the mold it’s just going to continue to grow. Kill is an anti mold paint you use after you have killed the mold with bleach and water or something else

    The biggest question for me is how in the hayell is this big able bodied man on Section 8??? I was out of the work for 9 years and never received Section 8. He says HE lived with his gf for several months - HE rented a U-HAUL and moved all HIS stuff out. No kids. No old people. Just HIS stuff. So, where and how did he qualify for a 4 bedroom government subsidized unit?!

  • @Raelynfyre2020

    Mold remediator here and mold is extremely hard to get rid of so you can't just cut it out. But at the same time if it is in a bathroom then it will keep reoccurring because the issues of moisture has not been corrected to stop the growth of mold. Often times Mold goes way past the problem area as well. So at this point it sounds like the tenant just needs to go and find a new place to live as he is not gonna be satisfied with anything they do short of a full bathroom remodeling.

    • @Raelynfyre2020
      @Raelynfyre2020 Месяц назад +1

      Mold testing should be done by the tenant to make sure that it is indeed mold and then go back to court with the findings. But if it is in the bathroom then they need to correct the moisture issue or the mold will keep coming back. Painting over mold is not remediation it is a patch job and often makes the problem worse. But burden of proof now is on the tennat or he can just find a new place if he is not happy with how the landlord is handling the situation and then he can also report them to housing as well.

    “Ya’ll making millions of dollars”. Right there is his faulty thinking. He’s not grown enough yet to realize everyone has bills. All he sees is people paying rent. Not that he’s paying full rent but that’s an aside. He thinks money is only going in. The facility has to pay its employees. Has to pay mortgage, insurance, has to pay taxes, has to pay utilities. Has to pay upkeep and repairs. Had to pay for landscaping, parking lot maintenance. The money going out, often proceeds the money coming in from month to month. He’s so blinded by his perception of who his landlords are that he cannot see the reality. Wait till he tries to buy a home and do all that by himself. Guess what? At that point his shortcomings he will blame on the city or the mayor or the city council that sits there and doesn’t represent him. It’ll always be someone else’s fault except his own. He’s a nice young man with a skewed perception of reality. No one is out to get him but his own mindset.
