  • The plaintiff says she bought a car from the defendant. A week later, the sunroof dangerously blew off while she was driving. She’s suing for the amount to repair it. The defendant says the sunroof wasn’t under warranty, and he alleges the plaintiff became belligerent when he told her.

      @@kamoshi.9331 We didn't really find out that they went out. What we found out is that she said that. Whether what she has said is true or not, is a completely different story.
      There's 100% more to the story so there's no point jumping to any conclusion, especially not to the point to call any sides delusional.
      This is a staged court. It has some weight, but it's easily being disputed - and cases like this (when at least one side had other info, claims and proof to add, but couldn't due to the the judge ruling too quick), a re-trial is almost a 100% guarantee.

    He's right about the test drive. We've been to several dealerships and they all had us drive alone and kept our license and keys to our owned vehicle and we drove alone without staff.

    He's not lying about the test drive... I've been to some dealerships where they sit with you... And some let you go on your own. Dealership personal preference... That's why they take a photo copy of your license & etc.

      Yeah, several dealers I've gone to give me the keys for me to go alone. My Audi dealer once told me just to bring it back by closing time. I had it for a couple of hours.

    Why did he play that VM? I think it hurt him more than it helped him. I was impressed with how calm and professional she handled herself when leaving her message. She seems like a decent person and I'm glad the judge ruled in her favor.

    One dealership let me go on a test drive by myself but I only was going to drive around the block. Half way around the car stopped! Although the register showed half full of gas it was actually totally out!!! Glad I had my phone with me!!!

    This brings to mind coming home after work to see my daughter sitting with her coat on watching tv in the living room. I asked her why it was so cold inside and she didn’t know. I felt a blast of cold air and looked up to see the the skylight had blown off the roof! It was sitting about ten feet away on the roof!

    The defendant is absolutely correct about letting customers test drive alone. Car dealers have been doing this for many years now. I remember my first time experiencing this like 10 years ago. It’s low risk because they can easily track the cars, and it saves the dealership time because there is always tons of paperwork to be done throughout the day, test drives take a lot of time out of a dealer’s day. Not all dealerships allow this, it’s primarily used dealers, but it started becoming popular around 2015.

      My husband bought a truck within the last 8 months. No he didn't get to test drive the car by himself. Some do. Some don't. Years ago I got to drive the car by myself.

    Actually on April 5th, I bought a 2022 SUV. And I drove it in the morning with the salesman & when I went back later in the day to buy it, they let me test drive it again, they told me to go take it alone for a longer drive. So the judge is wrong. That isn’t the first time I’ve test driven a car without the salesman.

      Really depends on the dealer. My husband got to drive a truck for a good ways with the salesman. Not by himself though.
      I also want to add, that they usually don't let you go far, especially with newer vehicles because they don't want to put a lot of mileage on it. If they know you're gonna buy it or think there's a good possibility, they will give you a little more range. My dad used to work at a car dealership.

    Usually the dealership will go with you especially if it's a new car. I myself when it's a new vehicle prefer if they go with me. Sometimes I have questions about the vehicle. On a used vehicle they usually just take a copy of your license. The defendant is a complete jerk from start to finish. Must be the owners son because if he had this attitude. He would be fired.

    I test drove a new car once on my own, a lot of dealers now are allowing it. As for the sun roof it must have been very badly fitted, either an after market or or repaired by someone who has no idea.

      @@trekgirl65 Actually my car was parked out the front of the dealership and I kept my keys. It was a small Suzuki dealership in Australia and only one person working in the showroom. I'm sure they normally take your keys.

    I'm 38 and have purchased two cars from reputable dealerships and they both let me test drive the cars that I ultimately bought by myself. I would think it would be strange to for them to go with me at this point haha

    JM. I live in Canada and my Dad sold cars for years, while I was a kid. Rarely. Rarely did he go with people when they test drove vehicles. Big dealership, and it was standard practice because small town and everyone knew everyone.
    Mind you my Dad retired in the mid 90's. Times are different now.
    My Dad was an honest man and never ever did shady deals.
    This guy gives good salesmen a bad name.

    Most dealers do let you take off with the car to test drive it…. They take a copy of your license just Incase but they definitely let you test it by yourself.

    I had a similar case with a similar defense from the dealership. I was also turned away by the ATG's office. It ended up costing the dealership over $100,000 between payments to me and my attorney.

    Every dealership that I have been too have let me test drive the car. A few even let me keep it for hours. My sunroof flew off my car on the highway a few years back. It shot off like a missile. I stopped and still have no clue where it landed. The highway was busy on top of it. Dude was so arrogant and rude at the end.

    Judge you're wrong. Most dealerships don't have time to ride with every customer. Mine scanned my license and handed me whatever keys I wanted. No questions asked. Small dealerships don't have the ability to pay people to ride along on test drives.

    He seems salty that she wasn't into him, even going as far as to try and claim a voicemail about her complaining of her sunroof was some sort of sexy voicemail/indication that she liked him.
    If anything, it was the exact opposite; her repeatedly clarifying that the call was purely about the sunroof sounded like she was trying to get the point across "I don't like you, this call has nothing to do with me wanting to see you again."

    I'm going to defend the judge here because I have never in my life been able to drive a car out of a lot without a car dealer next to me. Knowing that this is common practice in regular dealerships blows my mind.

      it is more to do with you and how they perceive you than anything. I have always been invited to take a car out by myself. I have a Mercedes though and they can see Im successful. I think if I turned ups in a Camry or heap like that they might not trust me to go out alone.

    When I bought a used car, they let me test drive at two different places without someone from the place with me. I even drove one of them home and had my husband take it around the block to get a sense of it because he couldn't come with me that day haha. Maybe not some of the more expensive places like Car Maxx, but smaller local dealers were the ones who did this.

    When I was looking to purchase a car, and I went to dealerships. It went one of two ways. One they just take a copy of my license and let me drive the car on my own. Or two they would let me drive with them first. Then ask if I want to take her out on my own. Some places will even let you take it for the day. And see if you like it.

    Many dealers will just make a copy of your DL and turn you loose for a test drive
