The lawyer should've flagged that right away. It's the landlord's legal responsibility to provide heat, and the baby died from lack of heat, not lack of food, nor from beating.
A good prosecutor could have made an argument that if it was a repeated problem and yet still left the baby alone in the apartment, then she would share partial responsibility as it could show clear indifference to human life, regardless of whether or not it was her legal responsibility to provide heat.
And from the child caregiver being denied access to care for the child. The fact that they did that combined with the intentional lack of heating is why they are being booked for murder.
I love the sense of genuine shock and horror in the lawyer’s voice as she says “the heat was off INTENTIONALLY!?” And the mother’s own reaction of realizing someone basically murdered her baby in the hopes of forcing her to move out was incredible as well.
"Wait, wait, wait... you mean to tell me that they did this on purpose?" That incredulous little chuckle in her statement was awesome, you can tell she's still in relative shock from her son's death as she processes this new horrible possibility.

The judge admits Turner's history of assault against tenants as evidence. However, Turner co-owns many of Corman's properties and is her live-in boyfriend; making it unlikely he will testify against her. Turner is found guilty, but the trial is ruled a mis-trial due to a mistranslation of the statement given by the Spanish-speaking supervisor of the building. If Turner's history is not admitted as evidence in the second trial, he will not be convicted. Schiff tells Stone to offer Turner a deal in exchange for his testimony against Corman. Stone and Robinette further strengthen their case when they discover that Corman has been bribing a housing inspector. The end of the episode reveals that Turner pled guilty to reckless endangerment, and testified against Corman, who was subsequently convicted of manslaughter.

Your mother was wrong and so was mine smh we were kids given adult responsibilities because our mothers had children with men who were irresponsible. You deserved to have a childhood that did not consist of watching small children being a child yourself.
and/or your father was wrong. It takes two to tango. Once you were on the scene, the person who was right was the one who did what they could to take care of you.
People love to judge. They don't themselves like to be judged. In the case of the clip up above, the lady was widowed; but no matter how it comes to be that a mother is single, there's no need to pile on and make it harder. Especially when, as things are tending, no one thinks you deserve help unless you're working, but not enough help to really get on your feet and take care of stuff.
Oh my goodness! Look at this baby grrrrl Bailey!!!! Local girl makes good. She really grew up to be an amazing actress. I love seeing the 'behind the scenes' for Grey's Anatomy. Chandra Wilson, the actress, as a human being is so incredibly different from her character on that show. No type casting there, just great acting. I can't get over her sweet baby face in the clip above. You go Chandra!
Situations like this are so sad. Was that mother negligent? Absolutely. Is she guilty of murder? I'm not convinced. Circumstances for people with babies and no support (partner) who have to work to earn money to feed the baby... it's just so sad that they have to get to work and can't wait for the babysitter. It's just sad when people are under the pump in circumstances like this. :(
I don’t think “negligent” is to the accurate word. It’s true she didn’t give the baby as much attention it needed, but it wasn’t out of malice. The mother is most likely just overwhelmed. A single mother, needs to rush to work, can barely find a sitter, and the fact that her apartment is not up to living standards. She has responsibilities as a mother, but she’s stuck between a rock and a hard place.
But she wasn't negligent. She had the babysitter (the younger girl they interviewed), but the babysitter got stuck on the subway on that afternoon and then another time she tried to get into the building but the landlord's friend wouldn't let her in.
@@RadioWaco Yes, but the mother is still guilty of negligence because she left house BEFORE the babysitter showed up. Legally, you cannot do that. Babies MUST have a guardian with them in the house at all times. But, as I said, given that she had to get to work so she could get a paycheque to feed her baby, it's a tricky situation for people like her. That's why I don't think people who leave babies in the house alone and something happens are automatically always guilty of murder. Even though their actions directly caused the death of the baby. It's a shades of grey situation, not flat out black or white. :(
@@jexelbur6872 Which is why I don't think she's guilty of cold blooded murder, which is what people are often charged with when they are responsible for the death of someone. However, she absolutely was negligent, because she left the house before the babysitter showed up. That was the wrong thing to do, legally. People who bear children have a legal duty of care to ensure they have a guardian with them at all times - parent, babysitter, daycare provider, whoever. But they cannot leave them alone. I know that the detectives later discovered all the stuff about the landlord messing with the heat because he was a dodgy jerk... but IF someone had been with the baby when he got cold, they would have taken steps to warm him up. Blanket or whatever. That's why you can't leave a baby alone... just in case something happens and you need to help them.
the state not providing support to parents, and the employer not paying a livable wage, and the landlord not providing livable housing, are way more negligent and culpable imo.

What I found interesting is when Logan was mirandizing Turner, he said “you have the right to remain silent and refuse to answer questions…do you understand?” Found it interesting that mid way through mirandizing him he asked if he understood. Other episodes ask for confirmation with each part. And still others they get through the entire Miranda warning then ask if they understand.
