    Hello, Jacob, I hope you are doing well. Some time ago, I lost my Colombian passport with my American visa. I reported the loss of my passport to the Colombian consulate and obtained a new passport. I want to clarify that I never reported the loss of this one to the American embassy. After a few days, I found the passport I had lost. I understand that I cannot use my visa in the passport that is reported as lost. I'm not sure if I could renew my visa using the new passport to stamp it, or if I would have to start the entire process again. Thanks in advance for your help.

    • @SanDiegoImmigrationlawyer
      @SanDiegoImmigrationlawyer  6 месяцев назад +1

      Hello! I'm glad to hear you recovered your lost passport. Since you reported the loss of your Colombian passport but not the American visa to the U.S. embassy, your situation is a bit unique. Generally, a visa in a lost and then found passport is considered invalid. However, you don't necessarily have to start the entire visa process from scratch.
      You can apply for a new visa, and during the application process, explain the situation about your lost and found passport. You'll likely need to use your new passport to get the visa stamped. It's important to provide all the necessary documents and information to clarify the circumstances to the U.S. embassy.
      For more specific guidance tailored to your situation, please feel free to reach out:

    I would love a video talking about "expedited removals" and the dangers that procedure has historically held for legal immigrants, even US Citizens, of deportation. Would it be safe if implemented now? Should legal immigrants, Green Card holders and immigrants with US Citizenship carry their immigration documents with them all the time, if implemented?

    Hey there, I'm planning a trip to India in May for 10 days, but I have a couple of concerns. Firstly, I'll be going in the middle of the semester, but I have all the necessary permissions from my college. However, my main worry is about my H1B visa. It was selected in the lottery, but the petition hasn't been filed yet. Do you think immigration officers will ask me about my H1B status, given that it's only been selected and not yet filed?" Please remember I have maintained my f1 status properly with a GPA of 4.0 . And my summer classes starts from 28 may . Please advice

    • @SanDiegoImmigrationlawyer
      @SanDiegoImmigrationlawyer  2 месяца назад +1

      Yes, there's a chance immigration officers might ask about your H1B status during your travel. While a selected H1B doesn't change your F1 status yet, it might raise questions about your intent to return for studies. Be prepared to explain your situation clearly and emphasize:
      You have a valid F1 visa and have maintained your status with a strong GPA.
      You have college permission for the trip.
      Your summer classes start shortly after your return.

    What happens next after f4 i-130 in nvc and how long it takes from this step to immigrate

    • @SanDiegoImmigrationlawyer
      @SanDiegoImmigrationlawyer  6 месяцев назад

      Hello! After your F4 I-130 petition is processed by the National Visa Center (NVC), the next steps include submitting required documents, such as Affidavit of Support and civil documents, and paying the necessary fees. Once these are completed and approved, the NVC will schedule a visa interview at the U.S. Embassy or Consulate in the applicant's country.
      The time from NVC processing to immigration varies greatly depending on factors like the visa bulletin, country of origin, and individual case complexities. Generally, it can take several months to a few years. It's essential to regularly check the visa bulletin for updates on your priority date and to respond promptly to any NVC requests for a smoother process.

    Hi Jacob, 2 questions:
    1. If you have applied for asylum, could you change it to another VISA like an H1B (if you get a job offer etc.)
    2. If you are on assylum, could you still be able to easily travel to other countries other than the country of your origin

    • @SanDiegoImmigrationlawyer
      @SanDiegoImmigrationlawyer  6 месяцев назад

      potentially. While having a pending asylum application can complicate things, you may switch to an H1B visa if:
      The asylum application is abandoned or withdrawn.
      You demonstrate your case isn't based on fear of persecution in your original country.
      You obtain the H1B sponsorship and meet all visa requirements.
      Travel with asylum may be restricted. While some travel during pending asylum is possible with permission, it generally depends on the specific circumstances and can be complex.

      Black Americans paved the way for immigrants to come over here.
      I say as American, we must close the borders ASAP.

    What state do you practice law in ? I have talked to so many attorneys who take the consultation fee knowing there is nothing that can be done for my case.
    I was brought into the country at 5 by US citizens ( not biological parents). I was never officially adopted and aged out. My situation is so different from most DACA recipients, and because I was not exploited ( USCIS only helps victims of human trafficking that fit a specific category) there is no path to legal residency in the country.
    I have reached out to senators and representatives for help and get the run around.
    Is there a way to speak to an immigration judge without being in removal ? I shouldn’t have to commit a crime to stand up and plead my case. I’m at a loss for what to do. I came to the states at age 5 I am now 38. 😢
