You absolutely can (and should do that). Obviously the police will be reluctant to prosecute a fellow officer. Take the video footage to a solicitor and pursue a private prosecution for assault. The police are not above the law and this is an open and shut case of wrongful arrest and assault. If any other person forcibly dragged someone from their car they would (rightfully) have a criminal record. The officer is either ignorant of what "obstructing a police officer" means or is deliberately misapplying the law - either way, this calls for harsh disciplinary action. Whoever the guy in the video is - get legal representation and don't waste your time with the police complaints procedures.

Oram was convicted of assault police...on the appeal it turned out they arrested him for section 5 swearing and he kicked one in the face as they tried to get him in the car. The Court decided the section 5 arrest was unlawful therefore it was assault by the police when they put their hands on him and he had the right to defend himself.

He requested his license etc. You cannot legally detain or arrest someone unless they have committed a crime (I don't mean a traffic offence) or force them to leave their vehicle unwillingly. You may request that but that does not mean you need to comply. This man hadn't committed a crime by refusing to leave his vehicle. The officer should have issued a ticket/warning and been on his way. He's incompetent and doesn't understand the law therefore should not be given the responsibility of upholding it.

Either is speeding but pulling over when requested. The only arrestable driving offence occurs when you fail to comply and pull over after being asked to or flee. Refusal to provide a breath test for drink driving etc. Your under no obligation to exit your vehicle and can't be forcibly removed unless the officer intends to arrest you but an officer can only legally arrest you if they determine you have commit an arrestable offence like refusing to provide a breath test. You can even take the test seated in your vehicle if you see fit. At no point did he request the man take a test therefore he hadn't failed one for drink driving so still hadn't committed an arrestable offence. It's not difficult to understand for most people. The man did everything he was obligated to, provided his license etc. The officer should have issued a ticket or warning and been on his merry way. He was incompetent on this occasion. I can only assume by your ignorance on the matter that your a police officer trying to convince us civilians that your in some way above the law. You are not.

I am not that well read on British law, but that sounds like a made up law. I know in the US, cops may lie about the law, but they are not allowed to enforce a fake law.

Under sections 163 & 165 of the Road Traffic Act the officer does not have the right to order the driver from his vehicle if no offence has been committed. The driver's only obligation is to identify himself and produce his driving documents if so instructed. The officer may REQUEST the driver to sit in the back of the police car but the driver is not legally obliged to comply with a request. That was the point where this officer began acting unlawfully.
Crimebodge : a family friend experienced more or less what this video depicts about a year ago . All her documents were in order her car taxed , MOT'd insured but the " child in costume " who stopped her , for what was discribed as a "random vehicle check" ,felt it more important for quote "his safety" that the female driver leave her vehicle and get into his police car for "his protection" ( the poor thing didnt want to get too wet because it might have made it uncomfortable for him if he sat in a wet seat ) dispite the three kids , all under 10 in the back of the car and her 85 year old mother who had ( she has since died ) dementia and breathing issues (in fact they were on the way to Exeter hospital to see a consultant about her mothers failing health issues ) . The mother was clearly sat in the passenger seat in some serious distress. As stated the vehicle and documents were all in total order but the " child in costume " detained her for over TWO hours by the side A30 in the dead of winter . " the child in costume " claimed he needed a fellow officer to assist him!!! , to assist in what ?!?!?! The family are now sueing Devon and Cornwall police for a range of issues which includes causing their mothers death , theyve also stated the detainment because the " child in costume " would not let her operate the drivers window because he insisted it be lowered then refused to give her the car keys back " for his safety " so she could not wind the window up because he had the car keys and the window was electric theyre claiming this caused their mother to become affected by a flu virus which caused futher issues with her breathing leading to her death . Theyve already learnt the " The child in costume " has already "resigned" due to what theyve been told were "mental stress issues arisinjg from the incident " theyve also learnt the " child in costume " was on his first week on his own following training and he had earlier that day pulled over a fully loaded HGV delivering bricks and building material for "not traveling at the set speed limit of 60 !" ( the HGV driver is also sueing claiming he was handcuffed for no reason and then pushed into the of the side police car breaking a couple of teeth and nose the police has said the lorry driver slipped on wet dirt ) the "child in costume" claimed the lorry was deliberatly travelling slowly to hinder other road users following an area of road works.!!! lorris can not go above 50mph and being fully loaded ...........?
I would've said that the government should bring in an independent board to study officers knowledge of the law and enforce re-training until they are capable of carrying out their duties. Should the standard requirements not be met then like ofgem/Ofcom etc fine them considering citizens pay taxes for this (service).

Plod would first have to prove he was acting in the execution of his duty and that the arrest satisfied the two-part test prescribed under PACE. If not, plod is buggered. Looking at the video, I doubt a half-decent judge would agree with plod.

Agree entirely. I retired in 1990. It was never like this. I think it was because we knew our powers of arrest, criminal definitions and learned them by rote in Training School. Things might have changed since I retired, but not so much as this officer seems to think.

A friend who is in a wheel chair had a similar thing. Ask to get out of the car, kept saying no. We were in the back pissing ourselves with laughter. This dragged on and he didn't notice the disabled badge. Mate comes back, I'm a cripple and unless you are Jesus Christ I'm not going to be able to get out of the car. .... Eventually the copper realised that he might have been abusing someone who was handicapped. That put a stop to him

Ive discovered a local case were an copper pulled out a man out of his car , the driver had a serious back issue confirmed by a doctor the fact the plod pulled him further damaged his all ready injured back ...the man is currently sueing ,i believe its west mids police or might be west mercia, as the "injury" caused to him has put five years back in medical treatment .... O the "offence" he was stopped for ... He was not close enough to the centre line when turning right into a side street

Rob this has made me so angry. I'm a disabled driver and that officer didn't bother to check the drivers ability. If that had been done to me then my recovery would be back 4 years, never mind the pain and suffering and misery that comes with disabilities. He even puts one cuff on and not ready to properly handcuff the uploader - it's done to cause pain and no other reason. The officer in the video knew fine well he was in the wrong - the police/council go for motorists in other ways such as unmarked cars looking for driving errors (Northumbria Police use 18+ unmarked cars and two trucks just for that reason!) because drivers are soft targets anyway. The video clearly sees an officer who isn't ready for the streets and likely isn't ready for that job. Heck I'd go as far as saying he's in the wrong job. He reminds me of those clueless security guards outside the crisp factory threatening members of the public.. I sincerely hope you're helping this guy in the video. The key along will cost hundreds for a replacement due to it needing matching to the cars ECU. On a side note - who made them remove monetisation? It has to be the home office?? They run a business and there's no money in peace and quiet or in a healthy society. The more chaotic it is, the more they like it. That has to be true because they cause almost all of the chaos and refuse to do anything about it except increase it.
Not a great idea, there are specific laws around assaulting police officers I think, plus such a thing could be used in court against you even if you are in the right on the other "charges".

As an ex police officer I am truly grateful for a channel such as this. I joined at a young age and would like to class myself as the "bobbing apples" you described. I was fair, I talked and treated people with respect, so much so I very rarely had to use handcuffs as people were totally compliant. I have stood next to officers such as this and witnessed similar aggressive, needless behaviour and questioned it at every opportunity. Needless to say, the institution made my life a living hell, the culture spreads right throughout and they will bully you mercilessly until you submit to them. I didn't, and resigned. They pushed me into the biggest depression of my life and it took me a long time to recover. I even had a deputy cheif constable involved, who I would like to add was suspended years later for bullying and harressment. I was a good police officer, but they truely don't want this. They want the robots, the yes men and women, the people who aggrivate and intimate. I thank you so much for making this channel and showing this content. I hope that this man pursues this all the way because the damage he could of caused with those cuffs is extremely serious. You can break bones doing what he did. Fight them all the way, the videos speak a thousand words and without them would would cover it up in some way shape or form! They manipulate situations to their own advantage and it is truely disgusting we rely on these people to help us.

Holy shit. They actually held him up for a medical appointment! Health care may be free in this country but that doesn't mean appointments just fall out of the sky, it could take ages for him to get another appointment for what's potentially a very urgent medical issue. Not to mention that when you're on record for missing or being late for appointments they act accordingly and make you a lower priority in future. Alot of people don't consider that people have important responsibilities to attend to and the police stopping people for no good reason, even if they end up without any charges or records could have a huge knock on effect.

Take the video footage to a solicitor and pursue a private prosecution for assault. The police are not above the law and this is an open and shut case of wrongful arrest and assault. If any other person forcibly dragged someone from their car they would (rightfully) have a criminal record.
The officer is either ignorant of what "obstructing a police officer" means or is deliberately misapplying the law - either way, this calls for harsh disciplinary action.
Whoever the guy in the video is - get legal representation and don't waste your time with the police complaints procedures.

Oram was convicted of assault police...on the appeal it turned out they arrested him for section 5 swearing and he kicked one in the face as they tried to get him in the car. The Court decided the section 5 arrest was unlawful therefore it was assault by the police when they put their hands on him and he had the right to defend himself.

The officer should have issued a ticket/warning and been on his way. He's incompetent and doesn't understand the law therefore should not be given the responsibility of upholding it.

At no point did he request the man take a test therefore he hadn't failed one for drink driving so still hadn't committed an arrestable offence. It's not difficult to understand for most people. The man did everything he was obligated to, provided his license etc. The officer should have issued a ticket or warning and been on his merry way. He was incompetent on this occasion. I can only assume by your ignorance on the matter that your a police officer trying to convince us civilians that your in some way above the law. You are not.

Under sections 163 & 165 of the Road Traffic Act the officer does not have the right to order the driver from his vehicle if no offence has been committed. The driver's only obligation is to identify himself and produce his driving documents if so instructed. The officer may REQUEST the driver to sit in the back of the police car but the driver is not legally obliged to comply with a request. That was the point where this officer began acting unlawfully.
Crimebodge : a family friend experienced more or less what this video depicts about a year ago . All her documents were in order her car taxed , MOT'd insured but the " child in costume " who stopped her , for what was discribed as a "random vehicle check" ,felt it more important for quote "his safety" that the female driver leave her vehicle and get into his police car for "his protection" ( the poor thing didnt want to get too wet because it might have made it uncomfortable for him if he sat in a wet seat ) dispite the three kids , all under 10 in the back of the car and her 85 year old mother who had ( she has since died ) dementia and breathing issues (in fact they were on the way to Exeter hospital to see a consultant about her mothers failing health issues ) . The mother was clearly sat in the passenger seat in some serious distress. As stated the vehicle and documents were all in total order but the " child in costume " detained her for over TWO hours by the side A30 in the dead of winter . " the child in costume " claimed he needed a fellow officer to assist him!!! , to assist in what ?!?!?! The family are now sueing Devon and Cornwall police for a range of issues which includes causing their mothers death , theyve also stated the detainment because the " child in costume " would not let her operate the drivers window because he insisted it be lowered then refused to give her the car keys back " for his safety " so she could not wind the window up because he had the car keys and the window was electric theyre claiming this caused their mother to become affected by a flu virus which caused futher issues with her breathing leading to her death . Theyve already learnt the " The child in costume " has already "resigned" due to what theyve been told were "mental stress issues arisinjg from the incident " theyve also learnt the " child in costume " was on his first week on his own following training and he had earlier that day pulled over a fully loaded HGV delivering bricks and building material for "not traveling at the set speed limit of 60 !" ( the HGV driver is also sueing claiming he was handcuffed for no reason and then pushed into the of the side police car breaking a couple of teeth and nose the police has said the lorry driver slipped on wet dirt ) the "child in costume" claimed the lorry was deliberatly travelling slowly to hinder other road users following an area of road works.!!! lorris can not go above 50mph and being fully loaded ...........?

Agree entirely. I retired in 1990. It was never like this. I think it was because we knew our powers of arrest, criminal definitions and learned them by rote in Training School. Things might have changed since I retired, but not so much as this officer seems to think.
I was in for four years but my genetic heritage decided that I wasn't going to be one of the lucky ones in mt family ans developed bipolar. Not being up on British law, I can't say a particular charge for sure, aside of what the cop already stated in this video. But if he tells you to do something, you don't just sit there and argue about semantics then have a tantrum. You do what he says, he gets the ticket taken care of and you're on your way. Give him trouble instead and that's exactly what you get back. This idiot chose to take the difficult path.
West Yorkshire police got sued for this and rightly so. The case is on Iain Goulds website solicitor who takes action against the police.

Ive discovered a local case were an copper pulled out a man out of his car , the driver had a serious back issue confirmed by a doctor the fact the plod pulled him further damaged his all ready injured back ...the man is currently sueing ,i believe its west mids police or might be west mercia, as the "injury" caused to him has put five years back in medical treatment .... O the "offence" he was stopped for ... He was not close enough to the centre line when turning right into a side street

Even by usual Crimebodge standards, this is quite extraordinary.
Rob this has made me so angry. I'm a disabled driver and that officer didn't bother to check the drivers ability. If that had been done to me then my recovery would be back 4 years, never mind the pain and suffering and misery that comes with disabilities. He even puts one cuff on and not ready to properly handcuff the uploader - it's done to cause pain and no other reason.
The officer in the video knew fine well he was in the wrong - the police/council go for motorists in other ways such as unmarked cars looking for driving errors (Northumbria Police use 18+ unmarked cars and two trucks just for that reason!) because drivers are soft targets anyway. The video clearly sees an officer who isn't ready for the streets and likely isn't ready for that job. Heck I'd go as far as saying he's in the wrong job. He reminds me of those clueless security guards outside the crisp factory threatening members of the public..
I sincerely hope you're helping this guy in the video. The key along will cost hundreds for a replacement due to it needing matching to the cars ECU.

As an ex police officer I am truly grateful for a channel such as this. I joined at a young age and would like to class myself as the "bobbing apples" you described. I was fair, I talked and treated people with respect, so much so I very rarely had to use handcuffs as people were totally compliant. I have stood next to officers such as this and witnessed similar aggressive, needless behaviour and questioned it at every opportunity. Needless to say, the institution made my life a living hell, the culture spreads right throughout and they will bully you mercilessly until you submit to them. I didn't, and resigned. They pushed me into the biggest depression of my life and it took me a long time to recover. I even had a deputy cheif constable involved, who I would like to add was suspended years later for bullying and harressment. I was a good police officer, but they truely don't want this. They want the robots, the yes men and women, the people who aggrivate and intimate. I thank you so much for making this channel and showing this content. I hope that this man pursues this all the way because the damage he could of caused with those cuffs is extremely serious. You can break bones doing what he did. Fight them all the way, the videos speak a thousand words and without them would would cover it up in some way shape or form! They manipulate situations to their own advantage and it is truely disgusting we rely on these people to help us.

Holy shit. They actually held him up for a medical appointment! Health care may be free in this country but that doesn't mean appointments just fall out of the sky, it could take ages for him to get another appointment for what's potentially a very urgent medical issue. Not to mention that when you're on record for missing or being late for appointments they act accordingly and make you a lower priority in future. Alot of people don't consider that people have important responsibilities to attend to and the police stopping people for no good reason, even if they end up without any charges or records could have a huge knock on effect.
Health care is not and has never been free in this country it is paid for out of taxation, every one who pays tax pays for health care.
