Pretty big gaps between the top of your party wall and the roof, building control usually like those closed up with bricks and mortar as much as possible to prevent fire spread.
Everything is getting done to regs and under BC so will be built if required. Only one side has party wall and other has chimney which may give impression of bigger gap on camera as wall is behind.
