I remember he posted the video about Billy's lawsuit, then set up a Gofundme, and he was able to raise enough money to counter-sue Billy pretty quickly. And he probably would have won the lawsuit-Billy had no case and Apollo had plenty of allies. Very sad. Hopefully Karl Jobst's lawsuit will teach Billy a lesson.

In this case, Todd actually helped Billy by being the 'referee' that verified his 1.067 million DK score. The one we have no full video of, and only show-off demos from Billy (that reveal MAME screen drawing routines anyway).

The fact that Mitchell was happy is what gets me. I knew about Apollo Legend and basically everything leading up to his death, but THAT is news to me and makes me beyond furious.
Ultimately evil is subjective, so there's no way in hell that sad twat could sue him for defamation. But even if he could Bitchell's remarks on what he thought was Apollo's suicide would fall under most people's definition of evil.
Opinion is not defamatory (with a nod to the pedants who will say "except when it is", but none of those conditions would apply here.) But to be fair, it's still a legitimate concern because it costs money to have lawyers argue in court and get a judge to throw the case out.
Philosophically speaking, I think the fact/opinion distinction is actually somewhat bogus (see John Corvino's article on this). But "opinion" still functions alright as a legal category.

there is a good amount to unpack here. i was similarly angered by karl's video. i have always and will continue to hate mitchell. but the implication that billy was ultimately responsible for apollo's suicide is far fetched and so is the claim that he had to pay mitchell money for settlement (no proof of this yet; mitchell claims he has papers backing up the fact that no transaction had occured, but mitchell is a compulsive liar and i take his words with a grain of salt). unfortunately, mitchell has latched on to the this very sentiment and wants to sue jobst for these 'defamatory' claims which is derailing the entire course of action. mitchell must have most likely seen that a better case would be if he could prove that there was no transaction between him and apollo; hence he wants to proceed with this 'lawsuit' rather than the donkey kong one which he is 100% destined to lose. jobst should have been a little more careful while throwing those words as there was no real proof pointing towards any cash settlement.
I just realized, Billy's new lawsuit against Karl is being prepared a week before his birthday. I know it's most likely not going to happen beforehand, but I would want nothing more than to see Billy's birthday present being shutdown after decades of lying.

To my knowledge Billy would need to mis-place one of his accusations into the wrong state court system for an anti slapp suit to actually apply to him, as antislapp litigation is not at the federal level. However, I am not a legal expert, I've merely listened to a few who have made similar claims as well as survivors of likely slapp suits.

Yep, the fact that someone who wins a lawsuit (either as plaintiff or defendant) still has to pay their own legal fees means people are forced to settle even when they're 100% in the right. Basically extortion and many states lack the anti-SLAPP laws needed to prevent this.

The DJ dared him to sue because of course this DJ had a team of lawyers ready to strong arm my friend into a settlement where he'd have ended up paying money to do the work that was stolen from him. Nah, Apollo killed Apollo. During the whole Billy lawsuit he had massive fan and those who were disgusted with Billy's actions full support. He offd himself due to illness and not being able to do what he said he was going to do when suddenly almost 100 grand appeared in his GoFundMe account over night. He cracked under the pressure and couldn't juggle his health, the lawsuit and his other personal issues. This is why he caved into the lawsuit and removed the videos, refunded (or tried to) the GoFundMe money then got backlash about that on top of Apollo's own shitty online history (he wasn't exactly a good guy himself). Billy or his son now goes around on social media or silly boards like 4chan boasting and bragging how it was a win for them, Apollo had to settle due to defamation and lying on Billy and how Carl is next after a supposed video he had to edit to remove a clip from Apollo's now deleted video. To sum it up all nicely Carl isn't Apollo. And im more than sure he'd have a lawyer paid for by his viewers easily. You know it's all bullshit, the man spends more effort giving out lawsuits then he does proving he can do the score again.

There are different types of lawyers...not every lawyer is a criminal defense/trial lawyer. There are lawyers who specialize in pretty much every area of Law that you could imagine...including for situations like this. I myself am very highly versed in "Bird Law"...so, if any of you need solid representation...
I think it's more sad that they don't care as long as there is money flowing, or that it's even allowed in the same arena as murder trials simply because it will keep a judge and their slimy cronies on vacation twice a year. These lawsuits, whether they win or not, are damaging innocent peoples lives financially, and potentially even ruining them, all for these asswipes ego trips, and lawyers are the POS middlemen that make that happen! I watched Apollo’s videos on Mitchel before they were deleted, it was devastating to hear that he had taken his own life. I just hope Karl comes out victorious out of all this, he is admirable for holding Apollo’s legacy himself, I truly admire him deeply.
Defamation lawsuits are almost impossible, as you need 3 things. 1) the person you are suing knew perfectly well the information was false, like they had evidence it was A and then went around and claimed B. 2) The Person actually caused some damage and 3) you know exactly how much damage it caused in US Dollar. In the first step, the Justice system is going to dig up all of YOUR files, and as the one who started the process, you can't do anything against that. Also, the other party will have access to these files too. Again, the party you are suing must have known it was wrong and they did it anyway, so the system needs to know what is actually true. If you are hiding anything, suing someone for defamation is the worst possible thing to do. Only in step 2 they are going to check if said party knew about it and ignored it.

Guinness reinstated 3 of Mitchell's old records because they were set in live events on original arcade machines. Those records were placed back in their archives as former records. No other scores set by Mitchell were reinstated. He was rightly given back his recognition for his legitimate records because it was the right thing to do, not because Guinness were "strong-armed" or "afraid of a lawsuit".
I'd personally hold Billy Mitchel accountable for Apollo Legend's death. He drove someone else to suicide, and he's no longer a decent human being for it.
Here's what gets me about these two continually going after people and trying to get their scores reinstated: if they actually succeed in everything, including getting all of their scores back up on Guinness and Twin Galaxies, _then what?_ Their records in a few books and websites, and they'd be scores that would be considered illegitimate by everyone they once appealed to. They'd still be despised by any retro gamers, speedrunners, and high score runners that would care to remember them, and the only way newer people coming into these communities would learn their names would be out of scorn, not celebration. They wouldn't be invited to retro gaming conventions or events anymore, and they'd likely be outright barred from most of them. They'd be remembered in minor infamy for the rest of their living days, and after they die their scores would likely get pulled again since I doubt their wives or any of the rest of their loved ones would go to court in their posthumous behalf (if for no other reason than undue stress from public pushback). All they'd have left is false glory and a poisoned legacy.
At the end of the day, that's their legacy: standing proud atop a kingdom they burned to the ground in their desperation to retain their crowns, the earth salted and wells poisoned. But that's not what matters to them. For Todd, this was his peak as a human being and it's all he has to hang his pride on after settling into a life of unexceptional mediocrity. For Billy, his overwhelming ego won't allow him to consider not being the best, probably because he never got over being bullied in high school and remains eternally developmentally-arrested at 16 like most people who behave the way he does. I hope it's all worth it when they're on their death beds and, faced with their impending mortality, realize they wasted their lives and ruined others' raging over numbers on an internet page that collects records on how good you push buttons in a video game.

Twin Galaxies has a no tolerance policy so they stripped him of all his records, but his older achievements are all legit. That's honestly part of what makes him awful. He already had legitimate status in the community. But he threw it all away because he was a greedy asshole who wanted more.

If you've ever watched something like Judge Judy it's probably not so strange. People go to court over stuff like "wind makes trashcan lids fall off" and "I want the olive oil in divorce". I realize it won't be a small claims court this time, but the judges will have seen it elsewhere.

And he probably would have won the lawsuit-Billy had no case and Apollo had plenty of allies. Very sad. Hopefully Karl Jobst's lawsuit will teach Billy a lesson.

Opinion is not defamatory (with a nod to the pedants who will say "except when it is", but none of those conditions would apply here.)

i was similarly angered by karl's video. i have always and will continue to hate mitchell.
but the implication that billy was ultimately responsible for apollo's suicide is far fetched and so is the claim that he had to pay mitchell money for settlement (no proof of this yet; mitchell claims he has papers backing up the fact that no transaction had occured, but mitchell is a compulsive liar and i take his words with a grain of salt). unfortunately, mitchell has latched on to the this very sentiment and wants to sue jobst for these 'defamatory' claims which is derailing the entire course of action. mitchell must have most likely seen that a better case would be if he could prove that there was no transaction between him and apollo; hence he wants to proceed with this 'lawsuit' rather than the donkey kong one which he is 100% destined to lose. jobst should have been a little more careful while throwing those words as there was no real proof pointing towards any cash settlement.
The suicide video cites chronic pain and his friends betraying him as the main reason. Billy laughed about it, but did not cause it.

To my knowledge Billy would need to mis-place one of his accusations into the wrong state court system for an anti slapp suit to actually apply to him, as antislapp litigation is not at the federal level. However, I am not a legal expert, I've merely listened to a few who have made similar claims as well as survivors of likely slapp suits.
Yes I was wondering the same thing myself, if the anti-slapp legislation covers federal court or just State Court? I would think that it is the federal court system which was being abused with these frivolous cases, but I could be wrong because I haven't checked into the actual law itself just see what it says. The level at which someone would be completely culpable for the death is where the person would be in a position of trust or influence, e.g. as a girlfriend, such that them telling the victim to kill themselves would be enough to make them go through with it.

Nah, Apollo killed Apollo. During the whole Billy lawsuit he had massive fan and those who were disgusted with Billy's actions full support. He offd himself due to illness and not being able to do what he said he was going to do when suddenly almost 100 grand appeared in his GoFundMe account over night. He cracked under the pressure and couldn't juggle his health, the lawsuit and his other personal issues. This is why he caved into the lawsuit and removed the videos, refunded (or tried to) the GoFundMe money then got backlash about that on top of Apollo's own shitty online history (he wasn't exactly a good guy himself).
Billy or his son now goes around on social media or silly boards like 4chan boasting and bragging how it was a win for them, Apollo had to settle due to defamation and lying on Billy and how Carl is next after a supposed video he had to edit to remove a clip from Apollo's now deleted video. To sum it up all nicely Carl isn't Apollo. And im more than sure he'd have a lawyer paid for by his viewers easily. You know it's all bullshit, the man spends more effort giving out lawsuits then he does proving he can do the score again.

Defamation lawsuits are almost impossible, as you need 3 things. 1) the person you are suing knew perfectly well the information was false, like they had evidence it was A and then went around and claimed B. 2) The Person actually caused some damage and 3) you know exactly how much damage it caused in US Dollar.
In the first step, the Justice system is going to dig up all of YOUR files, and as the one who started the process, you can't do anything against that. Also, the other party will have access to these files too. Again, the party you are suing must have known it was wrong and they did it anyway, so the system needs to know what is actually true. If you are hiding anything, suing someone for defamation is the worst possible thing to do. Only in step 2 they are going to check if said party knew about it and ignored it.
Judge: "so what's your source on getting these records?"
Todd: "my source is, trust me bro."

Guinness reinstated 3 of Mitchell's old records because they were set in live events on original arcade machines. Those records were placed back in their archives as former records. No other scores set by Mitchell were reinstated.

Here's what gets me about these two continually going after people and trying to get their scores reinstated: if they actually succeed in everything, including getting all of their scores back up on Guinness and Twin Galaxies, _then what?_ Their records in a few books and websites, and they'd be scores that would be considered illegitimate by everyone they once appealed to. They'd still be despised by any retro gamers, speedrunners, and high score runners that would care to remember them, and the only way newer people coming into these communities would learn their names would be out of scorn, not celebration. They wouldn't be invited to retro gaming conventions or events anymore, and they'd likely be outright barred from most of them. They'd be remembered in minor infamy for the rest of their living days, and after they die their scores would likely get pulled again since I doubt their wives or any of the rest of their loved ones would go to court in their posthumous behalf (if for no other reason than undue stress from public pushback). All they'd have left is false glory and a poisoned legacy.
At the end of the day, that's their legacy: standing proud atop a kingdom they burned to the ground in their desperation to retain their crowns, the earth salted and wells poisoned. But that's not what matters to them. For Todd, this was his peak as a human being and it's all he has to hang his pride on after settling into a life of unexceptional mediocrity. For Billy, his overwhelming ego won't allow him to consider not being the best, probably because he never got over being bullied in high school and remains eternally developmentally-arrested at 16 like most people who behave the way he does.
I hope it's all worth it when they're on their death beds and, faced with their impending mortality, realize they wasted their lives and ruined others' raging over numbers on an internet page that collects records on how good you push buttons in a video game.

So it should be noted that while billy Mitchel is a lying cheating terrible manchild, he was in fact...pretty good at Kong. His initial record was legit and something he earned. The one that got him that initial 18 years of solo fame and glory. What he actually cheated on was his breaking one million. Twin Galaxies has a no tolerance policy so they stripped him of all his records, but his older achievements are all legit.

Yeah from his purposefully misleading people about his white supremacist friend, and then sending his fans to harass a guy who called him out for it to his outright slandering organizers of GDQ he really was a genuine guy I miss his videos.

What's craziest to me is how hard these 2 are fighting over their video game records.
The games themselves are very old and niche. Why fight so hard over a record that barely anyone cares about?

Because it really isn't about the games. The records gave them a degree of fame, fortune and power. Their type is never able to handle lose of power or any questioning of their lies. They sue with the intent to harm, not win.
