This reminds me of an episode I had with my elderly mother’s doctor during an office visit. My mother was having a lot of pain for which she was Rx’ed Darvocet 65 mg every 6 hours. When I told the doctor that I didn’t think she was receiving adequate pain control, I felt that the doctor was hinting that maybe my mother was not receiving her pain medicine as ordered. I assured the doctor that she was given the pain med every 6 hours as ordered. Blood and urine samples were collected. The doctor asked how many people had access to my mother’s medications. I told the doctor that I, alone, administered my mother’s meds to her. The pain med was eventually changed to something stronger, but not before my mother had to suffer a while longer and I had to beg that she be given some relief.

Sorry, this woman made the right call. Especially outing that ridiculous Dr K who got Maya on a path of high doses of Ketamine and made a lot of $ doing it.
That child had enough meds in her system that were outreaching and dangerous.
And what was another huge red flag in Mayas med history?
      In 2015 within a 6 week period she's hospitalized for Asthma 10x.
      That's crazy.
Something was so wrong here and it wasn't CRPS.
Nobody wants to believe that this angelic looking girl and this "heroic mom" had severe intertwined psychological issues that were at the base of all of this.
So far the only liars are Jack and Maya.
Maya saying she doesn't go anywhere with her BF. Photo of her in Tribeca? She can't move her feet. Caught moving her feet when no one is looking.
Says she's so modest. Photos say something else.
Jack says SS wore a lab coat. No.
      Didn't introduce herself. She did.
Makes a snippy remark she has a cigarette voice.
She doesn't smoke and that vocal cord issue is not a cigarette voice.
Ok Jack is dumb..but still he was trying to be gotcha.

I believe this woman loves to hear herself talk. She enjoys controlling others especially children. The fact she didn’t feel leaving someone to defecate and urinate in their bed was abuse for lack of care is disgusting. In a nursing home setting that’s considered elder abuse. That is blatant child abuse because they did it on purpose in order to “test” her to see if she’d get up in her own. How awful for a ten year old child to be forced into that situation.

So, according to you, this evil woman has been for over 14 years controlling children by, for example, separating them from abusive "caretakers", perhaps from those "dads", "moms" and "uncles" who beat those kids, sexually exploited them, and - some of them, yes, like Beata - used them to feed their grandiosity and sense of uniqueness in medical settings? This woman has probably saved a lot of kids from a life-long physical and psychological damage, maybe saved lives of some of those kids. No, she does not look nice and cuddly, and perhaps reacts to the plaintiff's lawyer's "below the belt" jabs in a snarky way, but how would you look if you had to deal with child abusers for over a decade?

Breaks my heart how a parent can go to doctors who are experts in their field and is guided by them. See their treatments as relieving their daughters pain albeit short lived relief without continuing medication, as I think that most illnesses require ongoing medications. The to take their child to another hospital to be then believed to be causing medical harm because they themself is mental. Surely those doctors at JH CH should have gone after the doctors who readily prescribed the medications and diagnosis they found so harmful. The parents only wanted their daughter free of pain and listened to.
The Waring medical people should have battled in court and not blame the parents.
Because of ongoing battles between medical institutions regarding what constitutes an illness that no one truly understands can lead to the destruction a family forever.
Plus there will always be exceptions to every illness/ syndrome .
The notion of the God Complex Theory is the major theme running throughout here.
All children need to be safe and I feel that here this family was in caught between the battle already being fought between competing medical theories of what constitutes Regional pain disorder syndrome and the treatments of it .

Just because these parents found an option and went to Mexico to get their daughter treatment does not make them bad parents they were willing to do whatever they had to do to give their child some relief and just because these ass hats don’t know nothing about CRPS does not mean that Maya, her mother and father were lying about her condition. And the last time I checked, there’s side effects to every medication that is FDA approved that they use even in the hospital setting and as far as procedures go, you risk having a procedures done all the time I just had a major facial reconstructive surgery due to an accident that has caused me to have CRPSand the risks were huge but I did it anyways so for people that say her parents were wrong, you guys never been there

To me! Especially the man who was summoned back over the weekend, and stated that he was only there because he cares! Although Attorney Hunter called BS and busted him on a few occasions; for instance, he was making a statement about the hospital’s policies and training as it pertains to the Doctors;(Non of which he had viewed, and he but didn’t want to give a direct answer) an with the other situation, but he finally admitted that he hadn’t seen them. Secondly, he finally stated that his financial gain was based on Pro-bono.

No, SS was operating beyond what should’ve been her purview. The hospital was not being overseen properly. Check out Dr. Corcoran’s 2nd testimony at the end of the trial. I think he was the last witness before the jury began deliberating.
Remember how CB (and possibly SS) kept talking about talking with risk management? Unlike all the other JH hospitals, JHACH’s Risk Management had no oversight from the main hospital department. They didn’t inform the main risk management team about any of the difficult cases that could be liabilities. HUGE problem. Jack and Beata’s complaints/grievances were supposed to be responded to (with input from Corporate Risk Mgmt within 10 days. JHACH didn’t respond to them at all! THIS is one of the reasons JCACH was under Immediate Jeopardy. Some here may say, but that was only for the heart surgery program, Why then did JHACH overhaul their operations for the whole JHACH, having found serious problems throughout the hospital. The first complaints from nurses and/or doctors in 2015, but were not addressed. Myers stay was in the range of time that was being addressed. If it’s not broke, don’t fix it. But if it IS broke, absolutely fix it, even if the state and federal accreditation boards don’t spot it. Eight senior executives resigned or were fired as result of this. Maya Kowalski was the canary in the coal mine for this.

This Smith I wont say doctor because she doesnt deserve that tital thought it was funny that a child used the restroom on herself and then had to lay in it for who knows how long from what we have heard. I wouldnt go to this hospital with my children and if i came across these people that have "resigned" anywhere else I wouldnt walk away with my child I would run..these people associated with this place are corrupt and evil..First the people working at this hospital and yes I say that because defense keeps saying they had nothing to do with it but today Smith herself said she was a "member of the medical staff team" if shes not a member from this hospital then where?? They claim Maya was making up the pain an her mother was the cause..because she was taking her to doctors trying to find out first what was going on then later did but NO even with experts which clearly Smith is not it didnt matter..then after the mother commits succide then they have it in her files she has CRPS..lets just say Maya didnt have this..how this child was done an treated while in their care the hospital is unreal in itself..Smith in her depo said she had known Bedy and worked with her before.. I would really love to know how many other famiies an kids have been done this way but I have a feeling we never will sadly.

If I’m reading your comment right- It is up to the judge to decide what evidence is admissible. If the jury were to get to decide, they would see materials that they are not supposed to, it could potentially cause a bias or mislead, and then a fair trial is out the window. Also, the jury doesn’t have the legal knowledge or authority to decide what is admissible as evidence like the judge does.
      - Deciding which medications (which all have certain administration indications and Rx dates) are relevant to the trial could be argued by the lawyers and then decided on by the judge.

Have you read those emails that Beata wrote to herself as if in Maya's voice?!!! Sorry, but that IS crazy. Beata did have a serious mental disorder; probably a Narcissistic Personality. I am not mocking her: just pointing out that of course she engaged in a Munchhausen by Proxy. Perhaps unconsciously, probably her emotional needs and unprocessed trauma demanded her to do that. But it WAS a case of a MbP. And the standard procedure in such cases is to separate the child and the parent, at least temporarily. Then to offer a psychotherapy to the family. Which the court order and the Child Protection Team did. I am really sorry for Maya... Her mom defined Maya's identity by her (Beata's) mental disorder, and Maya will need a lot of therapy, not this frivolous law suit which will only make her mental healing more difficult.

You should really read the DSM-5 guidelines for Factitious Disorder Imposed on Another (MbP). It doesn’t line up and Sally Smith admitted in proffer to only considering evidence that corroborated her suspicion of MbP in her report to the dependency court. She did NOT include any evidence that refuted her claim because she said it’s “not her job” to do so. Yet the DSM-5 clearly states that when evaluating someone for MbP ALL evidence must be considered, including refuting evidence. She broke the DSM guidelines.

Maya has a rare pain condition where she was taking doses of ketamine to treat it, prescribed by a doctor. She was getting better. Then she relapsed and needed emergency care. Father took her to JH and they told the staff about her condition and the ketamine. The mother came in later telling them to give Maya ketamine so she can stop hurting. The staff felt she was being controlling and suspected munchausen by proxy or medical child abuse. The staff thought Maya was making it up and the mother was making her sick on purpose. There was a court order where the mother could no longer see Maya and the mother could only talk to her by phone only, supervised. After 3 months or so, the mother could not bare not seeing her daughter and being wrongly accused by the court and hospital, and committed suicide. More details but that is the gist. The hospital also said Maya was making it up, but was billing their insurance for the disease they thought she was making up. Dr Sally Smith was one of the top people in the abuse investigation.

Dr. Sally Smith was actually spot on for the entire thing. Everything she said made perfect sense and the hospital saved this girl’s life.

Maya went into the hospital with CRPS, was charged for CRPS protocol treatments, and left hospital with CRPS diagnosis. They did not save her life, they were trying to disprove the CRPS diagnosis, and Dr. Smith was at the forefront of keeping this family separated.
Hospital staff submitted an abuse report, and child welfare officials closed it the same day after confirming Maya’s CRPS with her specialist.
It was only after Dr. Smith filed a second report, against Maya’s Pediatrician’s advice, that she used Munchausens by proxy to get a separation order.

@@dianealarcon8304 Taking ur child to be put in a ketamine coma which gives a 50% chance of death when the child is not even dying of cancer or any other fatal disease says it all. Oh and then to write a blog as if u r the child but ur really the mother. Come on, this isn’t rocket science. The mother was mentally ill. I’m sure she would have killed her child if not for the hospital. As a matter of fact, she asked for hospice to have lethal doses of drugs. Super dysfunctional family and sad the mother put her family through misery and then hung herself.

That’s not what the jury found. JHACH falsely imprisoned, her, battered her, subjected her and her family member to intentional emotional distress that led directly to Beata’s death by suicide, was liable of the wrongful death wrongful death of Beata, was liable for fraudulent billing, and two other issues.
And the family settled with SS and CB.
And terrible news from both of their pasts became public knowledge.
      So, no.

There is also a famous case in Texas who went through something similar with a hospital and the wife had a small baby CPS came in and removed the baby while he was latched on and feeding! It was all caught on tape and it's just heartbreaking and like this family there was no abuse just a system way to willing to take children from good parents... the Bright family in Houston tx there is even a podcast on the case called Do no harm
