What about the How to Paint Landscapes or Seascapes type of books you can buy at art supply stores that feature paintings with instructions on how to paint. I own several books from over 30 years ago that I painted from, and the paintings turned out very well. Haven't thought about selling them but am just curious about this.
You can enjoy painting those lessons from books of course, the issue arises when you try to sell copyrighted images such as those. You can paint whatever you wish at any time, we’re just not able to profit from someone else’s copyrighted images in the US. Each country will vary.
For this reason, we should study technique and apply it to our own work.
Yes indeed, good thoughts here.
I just traced an outline of a watch. I removed all of the branding info as well as changed a prominent word from the watch face. Can I sell the design on tee shirts?
Unfortunately it would be best to avoid this- especially as it’s a direct copy of their watch design, even if the wording is changed.
Does this include sculpture?
Great question, in this video we are focusing on 2--D artworks such as painting. The rules may be different for sculpture so please research that specifically.
Hello I am creating art particularly portraits of models fashion models that I've painted and modified color skin textures is this legal before I continue because paint is so expensive I want to make sure but it's very difficult for me to hire a model right now
Hello- are you planning on selling these paintings of models? If not, these rules won’t impede your art making. These guidelines come into play if you’re attempting to profit off someone else’s likeness, artwork, or specific photographs. If you need royalty-free imagery, try pexels.com
@@AcrylicArtsAcademy yes I want to sale them, what if I simply credit them on the artwork or must I buy the royalty 🤔
@@AcrylicArtsAcademy also thank you for replying
Hello again, you're welcome! So if you want to sell them, make sure you've only use the photo as a reference and haven't copied it exactly. Typically you must make your artwork much different from the photo to make it your own. This could come down to changing the facial expression, the general style, or the clothing of the model photos you are painting. These laws vary by country so you'll need to look up the rules for your particular region. Copyright law can be...complicated and this video is a general guide. If you know the photographer who took the photos, you can ask their permission to be safe. If not, be sure to look up copyright law for artists in your home country.
Is this the same for the UK?
The laws in the UK don’t seem to prohibit the sale of art made from tutorials, but there are copyright issues to consider. To learn more, check out The UK Intellectual Property Office. The UK Intellectual Property Office (UK IPO) is the government agency responsible for intellectual property in the UK. The UK IPO website has a wealth of information about copyright law, including information about the sale of artwork created by tutorials. Thanks for your question!
So what happens when there are say, 5 people who have sat and painted Mount Everest and their paintings are all alike?
Hello Debbie, it is important to note that there is a difference between copyright and subject matter. Copyright only protects the original expression of an idea, not the idea itself. This means that two artists can paint the same subject matter without violating each other's copyrights, as long as their paintings are sufficiently different in terms of their expression. This will only really matter if one of the artists wants to sell and distribute their painting as their own. In the case of five people who have independently painted Mount Everest in a similar way, the copyright of each painting would belong to the individual artist who created it. They each will be inevitably different in style and color palette. However, if the paintings are so similar that they could be considered substantially similar, then the artist who created the first painting may have a copyright claim against the other artists. Please note that copyright laws vary depending on the country you are in, though many of the principles remain the same. Hope this helps you.
