That's crazy that a fast food worker earning minimum wage has to sign a non compete.
Non-compete agreements are a way for corporations to force workers to stay at terrible low wage jobs, and prevent any competition.
They don't even hear you tho

Hopefully this cause companies to actually pay their workers competitive wages, instead of trapping workers to poorly paid jobs.
Non compete is against human rights so it was always null anyway. If I'm a baker, it's my right to work as a baker and blocking that will kill me.

This is a HUGE DIFFERENCE MAKER..I used to work as a manager with CVS & also at Harris teeter under Kroger .I actually had to terminate a few employees back in the 2000's who wanted to were found to be working at rite aid & CVS at same time & also a overnight baker/cook at Harris teeter was let go for also working as a cashier at Wegmans.because it was seen as a conflict in interest..this is HUGE!!!

Tbh, I’ve been having the feeling since I was young that all of this mess is happening because of the 1965 civil rights act. It’s like…as soon as minorities were given civil rights, suddenly systems have been working tooth and nail to stifle the minorities but end up hurting everyone including themselves in the long run.
This country has been cutting off its nose to spite its face for a long time now.
I was made to sign a non-compete clause in my job as a low-level office clerk. I was paid $16.92/hour and had no access whatsoever to my employer's strategic business secrets.

Corporate America isn't going to be pleased
If I have many years of education in banking, and many years of experience in banking, it would be ridiculous and strange to switch to something other than banking in such a short period of time. In terms of salary, in terms of career path, in terms of the time I still have left to switch sectors, and so on, it just doesn't make sense.
I've never been under a non-compete agreement, but they are CLEARLY horrible for workers, employers, and the economy at large. If you can't switch employers in the same field, you can't grow your knowledge and experience beyond what that single company offers. Employers then have far fewer candidates to choose from with everyone locked up, so they are more likely to choose someone who's just "good enough" instead of the perfect candidate. Wages are inhibited at both ends because employees can't allow competitors to compete for their talents and employers get stuck with lower-skilled workers who can't really earn salary bumps as easily, turning into less money from paychecks going into the economy.
The agreements went from a way to protect the company from predatory executives to becoming a predatory way to monopolize people's labor. It should have always been illegal and I'm very glad it finally is. There will be multiple legal battles from fat cat businesspeople, but screw them for their greed!

It still doesnt help most doctors, which sucka. We are the largest group of people with non-compete agreements. Most hospitals are considered "non-profit". Non-profits are exempt from this rule.
The fact that big hospital systems can claim non-profit status is laughable.
First, having a non-compete clause without a high salary is abusive to begin with. It's just an additional constraint without balancing benefits.
Second, I could understand the concept in some specific cases, but they are limited and should still be matched with additional benefits.
Third, I agree with the exception listed by the TFC, which is trade secrets. This one makes sense, although I wonder if a NDA could do the same job.

Lina Khan doesn't fight for the average person. She restricts companies, companies want to make money (that's their entire purpose) they either hire less people (that means fewer jobs) or increases costs (that means average people pay more) with the restrictions she makes. These agreements meant nothing anyways. Bottom line, she makes average people have fewer jobs and pay more for things. I've signed non-compete agreements, my girlfriend signed a non-compete with her old company and she left that company and now works in the same building with ANOTHER company and nothing happened. These agreements held little water in court. This is just a political stunt before an election. If this was so bad, why not do it in within the last 3 years? Why do it right before an election? She only cares about the average worker when she can get political points out of it.
If she fought for average people they would get FAR more than 500 a year in raises.
@@johnchandler6831or the C-suite thins their non-productive employees, e.g. managers and C-suite themselves, decrease their own salaries, bonuses and stocks. I don’t know about you, but cutting non-revenue generating staff seems like a better route than running too lean.
Non compete is a form of blacklisting especially by industry, extremely prominent in the STEM fields
The point of non-compete clauses at most companies is that they're usually the ones that hire entry-level workers and train them to a level of competency. The problem is that higher paying companies that DON'T train will often setup shop close to the ones that do. They'll say they require 6 months experience, then poach freshly trained employees from that other company after they'd invested all that time and money into training them. They can AFFORD to pay more BECAUSE they don't have to train them.

I worked at a tanning salon in my early 20s and they tried to get me to sign a non-compete when I put my two weeks in...as a sales person/tanning bed tech in a tanning salon. I thought it was nuts, the job paid 10 an hour plus commission...I did nothing special. Yet they wanted me to sign a noncompete contract? I told the regional manager that all that does is limit my job options, it helps their company in no way so they could kiss my rear and left. All she could do is sit there with this stupid smile on her face but it was clear i embarrassed her in front of the store manager who felt some type of way towards me putting in my two weeks a couple weeks after she got hired lol she knew she was incompetent.
Many years ago when the IBM PC was the new thing there were companies who made software to run on them (before Micro-Soft). I applied to one company that had a non-compete that basically said I couldn't work on computers. The problem is that they meant any computer, including cash registers. I couldn't even get a job as a burger flipper. I couldn't even get a job as a janitor just because there's a possibility I might run across a computer.
Need to eliminate the federal Motor Carrier Overtime Exemption next.

no, this topic is VERY sexy for those of us shackled by the egregious nature of these agreements. they prevent us from finding better employment and 100% favor the employer with no benefit to the employee. It's utterly ridiculous. Finally the government is looking out for the little guy.

Not only leave for "better paying jobs", but how about "better working conditions". Corporations are increasingly feeling like the worker owes them everything and the employer owes them nothing.
I'm not holding my breath. There are too many business organizations that will fight it tooth and nail with every penny they have. Just to keep workers in their place.
I've seen non competes in a grocery store, spa, and even a martial arts school tried to use one for it's students.
I'm surprised that I never had to face a NCA. My employers periodically gave us classes to upgrade our skills. But they didn't upgrade our pay to match the skills. So many left for much higher pay. In the late 1990s I worked at 3 jobs in 2 years and saw my salary jump 50%.
That will more than make up for all the money I sent overseas this year!

I used to be a personal trainer and had to sign one, so when my boss left and another came in and tried to treat me like crap and take my clients, I wasnt legally allowed to work somewhere else(i did anyways), or within 50miles of one of the clubs... Its everyone, old/young, And its not really that small number they said... a lot of times to be able to switch jobs is in the thousands/tens of thousands. The CNA nursing field is full of these examples...
Crowders former employees signing non-disclosure agreement, not a non-compete agreement. They wouldn't be affected exactly zero by this rule.

If people are allowed to move freely for a job, employers will need to provide better work cultures, benefits and salary to retain top talent. As salaries rise, the median and minimum salary rise. I can see signing an agreement where someone would not reveal proptrietary information, designs (basically trade secrets). My question is there a difference a burger grill at Wendy's or McDonalds? What if the information is public like in a manual that one can download from a website?

I have mixed thoughts on this. While I don't agree with barring someone from continuing to work in an industry, preventing former employees from taking clients for at least a period of time is fair. I once worked for an insurance company that had a medium sized branch of around 30 employees providing various services to our clients. one of the managers of the branch was toxic and a horrible person. After enough HR complaints, he was forced out with an over the top generous severance. His noncompete basically just had it so he could not try to our clients for 2 years. He didn't even wait a month before calling his former clients, lying about our new management, sales and service staff. He took over $600k in revenue from our branch. People would have been laid off if it weren't for the non compete allowing our branch to get money from him and his new company in court.
A non-solicitation clause protects poaching of clients, which I don’t believe anyone is against. For intellectual property and trade secrets, an NDA covers this. The sheer amount of ignorance on this topic is baffling.

This is going to INCREASE churn at companies that train from entry level qualifications to skilled positions, because they'll put all the time and money into training workers, just to have those workers jump ship to a company that would have never hired them in the first place WITHOUT that training for $0.25 an hour more. As a result, there are now going to be far fewer companies that hire workers at the entry level, and result in a worker shortage for the higher paying companies with more selective hiring criteria. It's going to backfire spectacularly. Why would I hire and train someone if they're allowed to jump ship to my competitor as soon as I've trained them to my competitor's requisite skill level?
1, that already exists. You can go to any job hiring site and see that a bunch of entry level jobs require experience as well as oftentimes a degree. And 2, if the company paid well and treated their employees well, then there would be no need to jump ship. If a company can headhunt someone and pay them more in that same industry, that means the industry can afford to pay more, so you should have been paying the employee what they are worth, otherwise, someone else will. Stop shilling for corporations, they are not your friend.
@@alexs1640 It's a lot easier for a company that requires 6 months experience to get in the door to pay higher wages, because they aren't having to shell out the time, money, and real estate to train their workers, so that's not a fair competition.
In my experience, companies don't pay you for training anymore. They provide you with some of the learning material, but the rest is up to you and Google, and you're expected to do this training on your personal time.
@@ayceod That's probably because of how many states have already started banning non-competes. 11 years ago, before I started my own company and got off that hamster wheel, many companies (particularly ones like call centers) would pay you while going through as much as a month long, full time training class onsite.
Companies will no longer invest in workers training. Companies can offer slightly higher wages and take employees from companies that invested in training the worker.
I think these non-compete agreements should stay in boards and Executive positions, but not across the organisation it’s just stupid.

John, in a real capitalist economy workers should be able to move from job to job, with zero non compete agreements. It is who will pay you the most with your experience, and if the company you work for does not want to pay you for your skills and knowledge, then a competitor will.
