One of the big challenges of working in the law, especially criminal law is that most of your clients think they know better than you about, well, just about everything…….but mostly the law and court etiquette.
I am always amazed that ppl get in trouble and arrested then they complain they will loose their jobs, have kids at home to take care of or an elderly parent. Then don't get in trouble and lead a normal life it's not that hard!!
People change. You make 1 mistake and your entire life's taken from you. Once you are in the system it's hard to get out. They want you to pay them thousands of dollars but you can't get a job. It's a terrible system of greed and money. Just like every other part of the government. Don't get it twisted.
If she has to go to court even ONCE that week, she can't get it done. She needs 80 uninterrupted hours. The moment there is an interruption, the clock restarts.
It’s balance of law. Everyone has the right to have their argument put forward by a licensed lawyer. If the law is applied properly and the police and prosecution do their job the alleged criminal is held accountable for the crime they committed, no more, no less. In the final year of law school in Aus around 2000 we were asked if we could do some volunteer time in Baton Rouge as it was determined that one in three black men incarcerated on death row were likely to be innocent upon review of their case. Can you imagine being incarcerated and killed for a crime you didn’t commit because of the colour of your skin and because you have a criminal history? Probably not but it happens. So as long as everyone does their job properly (police, lawyers and judges) then the law is good and balanced. It gets real murky when we step out of that and money and politics get involved……….dont get me started!!!!
All the things counsel says about their ties to community, family, jobs etc. Cracks me up. Like it stopped them from commiting the crime to start with🤦🏼♀️
They do that because it’s apparently more likely they’ll appear in court, if they’re from the area and have ties to the community, as opposed to someone who has no ties to the community & doesn’t actually live in the county they were arrested in. It would stand to reason, those with roots in the county and ties with the community, they have a support system. It creates the illusion they are less likely to fail to appear and are more likely to get a PR bond. It was probably an indicator back before the era of entitlement!
Counsel has a duty to represent client. Counsel has a duty to address these topics. Sometimes you’re just trying to polish a turd. That’s what makes it hilarious!
Pretty sure when they say that, though, it’s not in reference to anything positive or that they do anything for the community - just confirming to the judge that he is from the area and/or is familiar with it enough (usually has family nearby, isn’t a tourist or someone passing through, etc.) to confirm they can and will remain in the area during everything.
These hearings are in regards to bond. They are generally not related to the particular case which is also why the defendant should not be offering any input. Usually bond considerations include (with context being the county in question): current housing, family and associations in the community, criminal history, history of failure to appear, job status, seriousness of the offense
Some people don't realize that the reason the witness may not be able to identify the suspect is that, sometimes, the witness cannot take their eyes off of the weapon that is pointed at them. This happens quite often.
I struggle with face blindness. Unless it is someone who I am close with, I often don't recognize people. I don't recognize an actor from one movie to another. It's a running joke in my family but it is shockingly inconvenient lol I always say, if someone showed me a line up, I'd be useless.
When that guy with the fentanyl deals to someone who ODs the prosecutor should be sued for allowing that dude out with NO BOND. Personal bond means, no bond!
In NY, the prosecution needs to prove that it was definitely that dope that the person OD'd on and that there were no preexisting conditions that could be the reason he died. The charges may be increased later, but, for now, there is a limit to what the court can give for bond on each charge.
So, he travels all over the country doing carpentry & specialized concrete work. Yet he only earns $800 to $1200 a week & can’t afford his own attorney & the public needs to pay for one for him ??? I’ve never been arraigned for a felony, but if this was just a misdemeanor, I’d know exactly how this goes! 😂 Does anyone know if this state can charge a felony after 3 misdemeanors? I live in the wonderful state of Florida, and our state doesn’t play. 3 misdemeanors is charged as a felony, automatic life sentence! Which has actually decreased our crime rate.
Hey I'm in Florida too but that isn't accurate. 3 charged misdemeanors does not become an automatic felony and life sentence in Florida. Our jails and prisons would be overflowing if that were true when you consider how many misdemeanor offenses exist. You're thinking of the 3 strikes law that applies to habitual offenders who commit violent felonies on 3 different occasions. Not all felony level crimes are included in the statute, only violent ones. Three times and then they're required to be sentenced under the 10-20-Life law. You're right that this has improved the violent crime rates! Habitual offenders are responsible for a disproportionate level of violent offenses compared to the general population, so locking them away for good does have a great impact!
@@MayDa-ll7oe Florida is a tough state! Look up a couple of our sheriffs. Sheriff Judd Grady, and my county’s sheriff, Sheriff Gualtieri. 3 misdemeanors is an automatic life in prison! Even non violent!

Somebody raised Mr. Willis right. Be is basically a good guy.
I’ve never been arraigned for a felony, but if this was just a misdemeanor, I’d know exactly how this goes! 😂
Does anyone know if this state can charge a felony after 3 misdemeanors? I live in the wonderful state of Florida, and our state doesn’t play. 3 misdemeanors is charged as a felony, automatic life sentence! Which has actually decreased our crime rate.
You mean they don't get off with lower sentences? I don't believe it?
@@y2ksurvivor ok, thank you. I watch so many court videos, that I probably misspoke. 3 habitual, meaning, at least a year apart, or w/in a year?? I’m in Pinellas.
@@OnlyJalenPhd"sorry ma'am, this is your 3rd jaywalking offense. Off to prison for life now. " 😂😂
