I would argue that piracy is also moral (or at least not inmoral) when doing it to normal AAA games that are available to purchase, if the person doing it cant afford to pay the full price of the game. In this situation 2 things can happen, this person doesnt buy the game because its too expensive, or they pirate it, either way the company that made the game doesnt get any money. This is even more relevant with modern Nintendo games, because you need to get the Switch to play them and then pay the full price for the game, no regional pricing or anything.
I think this is definitely not a valid argument for piracy. It is definitely morally wrong to pirate in an instance where someone cannot pay. Is it "okay?" maybe. Like I'd say a kid that didn't know any better, sure, but if you're an adult, there's no reason you should pirate when you could buy a game even if it involves saving up. I'd only argue this kind of thing is morally neutral with necessities like groceries.

With Nintendo games, especially ones that are no longer available to purchase for cheap, let alone purchase at all, I would argue it’s only piracy in the eyes of the law, but that’s it. I have a modded Wii U and 3DS and it is impossible to play everything I want to on them without some form of piracy. I will not, however, want to pirate new games that are still being produced and sold when I have the ability to own them legitimately.
OMFG This video is so True!! Also Piracy can give you more ownership of games you already bought. Like on steam if you purchase a game but you don't own it. Because for whatever reason, if value decides to delete your steam account you would loose all of you games and dlc you have purchased on there. There would be no legal way of getting ownership over them. Since you never had ownership over the games in the first place. You were basically just paying a subscription. The company might find it reasonable to download a ROM of it if you already own it, but there is no verification of whether or not you actually own the game, so there is no knowing if you are being stolen from or not.

When the PS2 was around game pirates would preserve NES and Sega Genesis games. Later when the PS4 hit the shelves now PS2 and Gamcube games needed preservation. Go figure. Are those people dumb enough to think I believe what they say? It is always clear they want games preserved that wouldn't cost them anything when downloading for free and when they believe that at the time given it has to be legal. The use of emulators is weird. Legal only when your game can be directly read by your computer and the emulator just has you playing the game. But most people do not even own most older games anymore. They download them and that is illegal. I can play PS1 games on my computer since my computer still has a CD/DVD drive. So in that case emulation is legal? Possibly not. Games companies and console companies own the rights to certain data files you need in order to make the emulator run properly. But nobody else really owns those. Which makes emulation tricky and to some extent indeed illegal. But even I find myself notmuch playing older games from older consoles anymore since my modern console provides me with all the games I possibly need to play right now. That alone leaves the preservation gunk in the dust.

Disagree I had a genesis growing up and it is at my mom's and it is hard to get games for it because it is an old system that is no longer made.
