    I'm a senior and easily understood this video. I did have a few specific questions about the DPOA and called his office leaving a message with staff. I was surprised and delighted that he actually called me back and at the time I was told he would be free! Patient and very helpful!

    Hello my question to you is on page 7 of a California general durable power of attorney, the section where is says Acknowledgment of Agent I would put my name their correct iam my husband agent.

    I'm planning to use a general Cal Durable POA form. At the end of the form it has a Preparation Statement "document was prepared by the following individual" Who specifically fills that out? The notary? An attorney? Or me and my attorney-in-fact? Thanks ahead

    Two questions.
    #1 You said that the DPOA is only good if you are incapacitated ? What if you die. Which is what I want it for. (SP)
    #2 Even though it is a California document. Is it acceptable to federal government agencies like the V.A. or SSA ?

    I have a question for you, my fiance explained to the doctors when he was admitted to the hospital that I am his wife and I have consent to make medical decisions if he's incapacitated. Every single hospital has given him a form to sign at that time. My husband was not given this form , then we had a nurse overstep her boundaries. She had been answering my questions lying and I was hysterical. That night I was betrayed by his mother apparently casting doubt on our marriage. We have been together for 12 years, but we never had gotten married. Since there is no common law in Kentucky I went from sleeping at the hospital by his side and making decisions for him after being put on a ventilator to not even being able to recieve his access code. The lead nurse said for his wishes verbally stated to be able to be honored we have to have it in writing. I began calling previous hospitals where this form was completed even though it was only good at that location I felt it is confirmation of his wishes in writing. I went thru all my past paperwork and it also appears we had filled one out 4 years ago however since the hospital had given us another to fill out there we never had gotten it notarized. I feel betrayed and like this hospital especially this particular nurse had overstepped her boundaries to cause chaos and harm to us and I don't understand why. All they keep insisting is we need to be married I am just devastated that anyone would dispute this because of how close we are. Since I was not told why his mother did this I asked and she would not answer the only thing that I can think of is that this nurse manipulated her and his mother played right into her hand. So I am waiting for the particular agreement we filled out to be overnighted to me I am concerned because although there are witnesses there isn't a notary signature and they have done so much to betray us I fear that this will not be enough. As I said he clearly expressed his wishes to many doctors and nurses. Did they prevent this from being honored by not giving him the consent form to complete at the time he said this? I know that the hospital has to order the records from previous hospitals to see these previous consents so am I able to do anything to get them to do this because 2 days after he was put on a ventilator this occured and I'm physically sick with worry. His mother is on the other side of the country and had seen him and her first granddaughter one time in the 12 years we've been together. He barely speaks to her but I felt like she should know our wishes and had betrayed them and won't tell me why. His trust in medical instutions isnt existing any more the way I finally get him to the hospital for medical treatment is promising I'll be by his side and I won't allow anything to happen to him. I was forced to break that promise. They won't let him express his wishes because they have him sedated and they betrayed his wishes right after he became in medical need of a power of attorney. Is there anything legally I can do to have them honor his wishes bc I'm devastated and I'm positive he's going to be so much more hurt and leave as soon as they allow him to speak for himself because he has been very clear of his wishes and consent. I plan to file a grievance based on the nurses behavior and the damage that can be caused by her lying and manipulation to myself and his mother could have affected my decisions if I had not went home crying and read as much as I could online regarding his condition that I realized she was lying and I believe she was doing it on purpose. The next morning feeling better knowing she was lying I even tried to apologize and explain why I became so upset and she was the nurse on the phone she became defensive immediately and had blindsided me with the request for a marriage certificate and I became unable to hear his condition. I have a difficult time that our not having a marriage certificate is validation to go beyond backstabbing us when we are so close and express written consent at every hospital if they knew that this was his decision and will not seek to see any written verification after they changed his consent could there be anything else I can do for him to have his wishes honored because this hospital says since we're not actually married I am forced out of hearing any thing and I am physically sick by this. If something happens to him I would not be abl to live without him to know that I was kept from keeping my promise in an overstepping of authority and a vendetta to cause much harm for no valid reason. Also if I feel the nurse had violated the hypocritic oath who could I call to look into her nursing license. Last is there such thing as discrimination based on drug use. Other than human resources in the hospital and , the better business bureau who could I call to express my Concern to prevent the next family from being lied to and manipulated I feel we could of experienced irreversible harm. This need to be investigated and she should be punished as severely as the harm that she could have caused. Can you think of anything else I can do to prevent her from doing this to someone else and return things to the way my husband and I had wanted ?

    What happens if you have power of attorney for your parents and they go purchase something and sign a contract
    Can the contract be revoked by showing the POA?

      No. POA doesn't mean they can make their own decisions. It just lets you make decisions and speak for them if needed. Doesn't mean you can override them. You would have to have them under your conservatorship. Then you can make decisions for them cause they can't do it on their own as stated by the court.
