  • A serving soldier who beat a woman unconscious in a random street attack, and boasted about it on social media, has walked free from court after being given a fully suspended sentence which the victim described as "not justice".
    Pat Kenny is joined by David Raleigh (Freelance Journalist) and Ivanna Youtchak (Violence Against Women Coordinator, National Womens Council) to discuss the controversial sentence.
    A serving Irish soldier, who beat a woman unconscious in a random attack, has walked free from court after getting a fully suspended sentence.
    Cathal Crotty (22) of Parkroe Heights, Ardnacrusha in Co Clare, boasted about the incident afterwards on social media.
    Mr Crotty had initially tried to blame the victim - 24-year-old Natasha O'Brien - by wrongly telling arresting Gardaí that she had instigated the attack.
    It happened on O'Connell Street in Limerick on May 29th, 2022.
    The court heard it appeared he had lashed out at Ms O'Brien after she and a friend of hers had "politely" asked him to stop shouting a slur.
    However after Gardaí showed the accused CCTV footage of him attacking Ms O'Brien without provocation he admitted his guilt, the court heard on Wednesday.
    Hours after the attack, Mr Crotty messaged friends on Snapchat with the words, "Two to put her down, two to put her out."
    Ms O'Brien sustained a broken nose, bruising, nightmares and panic attacks afterwards.
    Judge Tom O'Donnell said the Mr Crotty's actions were "utterly appalling", but said he had "no doubt" if he imposed an immediate jail sentence on Crotty his Army "career is over".
    The Judge imposed a three-year sentence which he suspended in its entirety and ordered Mr Crotty to pay €3,000 compensation to Ms O'Brien.
    Speaking afterwards Ms O'Brien criticised the sentence, saying she felt "there was no true regard given for the seriousness of his violent crimes, nor the lifelong trauma I am now forced to suffer".

      She can't. The way it works. A crime is reported to the gardai. They take a report and pass it on to the DPP. The DPP charge the person and take them to court. Only in cases of undue leniency can the DPP appeal. But this has to be granted. The victim has 0 say.

    As a serving soldier I want it known that we’re all sickened & outraged by (I don’t want to refer to him as either a soldier or a man) Crotty’s vicious attack on Natasha O’Brien.. If Natasha O’Brien reads this, I’m so sorry for my colleagues assault on you, we’re all truly outraged.. I hope you have a complete recovery, you’ve been very brave coming forward..     Crotty and the judge should be locked up together. What on earth is our society coming to? A woman is beaten unconscious in the street and it only warrants a suspended sentence?     Is shouting homophobic slurs at the two men across the street a hate crime? He should be charged with more than one crime. He bragged about the beating online. He needs to be dragged back to court and sentenced properly for all his crimes. That judge must go. I hope the citizens of Ireland protest until justice is done.

      I understand your point but it's for this exact reason the judge wouldn't be allowed to adjudicate the case due to bias and conflict of interest. These rulings are standard in Ireland. It is an institutional problem not just one dodgy judge. This country needs to be harder on violent crime as it is only going to increase in the coming years unfortunately

    As a woman, I find this appalling. I hope I never have to depend on this judge to administer justice. That soldier should have got at least 5 years. It sends an awful message to violent men out there. This is so sad for the women in Ireland.😢

However, just to be clear, I think I do have the right when it comes to violence to quote any academic or statutory research and inform that just 80% of violence against women is perpetrated by men- so, no in this instance, women and men would not be the same.
      A woman was beaten unconscious by a man, and your comment is entirely devoid of empathy. If you want to have a debate about the equality of men and women, then toddle off to another page!

      Many judges are not fit to hold judgement on people. Some have been found guilty of heinous crimes, others most likely have not been caught yet.
      Many judges are political appointments.

He’s in prison for ramming his beliefs down the management’s throat and acting aggressively in the process , not respecting the rule of law or the well-being of the students he’s supposed to care about.. upsetting the whole school with his antics.       Not sure what the day to day sentences passed down in court are for this, but the result of the last high profile case for unprovoked violent assault in the limerick courts was the same. Suspended sentence & retention of job and that was after a not guilty plea. So yes it would appear it is acceptable

    Absolutely disgraceful verdict. The judge reasoned that a prison sentence would finish his military career. Without question he should have been discharged from the army for bringing the forces into disrepute and imprisoned. That poor girl has been victimised by both Crotty and the justice system.

    This same judge, Tom O'Donnell, let of another man on a 2 year suspended sentence for assaulting a homeless man in Limerick city. This is unacceptable, build more prisons, smaller cells. Punishment first, then rehabilitation. It's the only way to do justice to the victims.

    This so called soldier should be locked up. No right to do what he done! What message is this leniency telling victims of abuse? It’s telling them that the law is only protects offender and the victim is secondary .

      As a former soldier I assure you that the matter hasn't ended for the military. They have to wait until the civil authorities deal with the matter as it has priority over military justice. Now the military regulations will be applied to the soldiers conduct. The likely outcome will be dismissal from the Defence Forces.

    The fact that a member of the Defence forces was actually shouting homophobic vile in a public place was bad enough and should have earned him dismissal or suspension on its own but then to go on and do what he did after..... this story has really blown my mind. His sentence has to be reversed.

      I wouldn't recommend them personally. I approached them after I was beaten up years ago. I was told they wouldn't assist me, as there was virtually nil chance of a successful outcome. The reason why? I am Autistic, so I was deemed to lack credibility.
