They clearly haven't applied and clearly aren't complying with any council policy or specification for maintenance. They are simply wanting to claim it as their own. Its not theirs. @@stevesvids as a rule of thumb the council don't maintain roads with 3 or less properties (in my neck of the woods anyway.) So the council are ignoring the bit in the middle to dodge maintenance costs of it. the property owners are maintaining it however and if they do so for a certain number of years then they can claim it and if you go there annoying them then they will act to get it closed as a right of way for everyone. and it looks like a nice walk so that would be a shame. the public footpath stile is to the left of the yard after the woodland bit. they need to get the right of way status changed which i think the cash strapped local authority will do quite happily.

So public .... get your bikes down there, get your 4x4s down there, get walking down there, get your horses down there, get your quads down there, get your tractors down there, get it all down there. If there's no planning application for gated access then get them gates gone. If the planted shrubbery is limiting the width of the byway for all users cut them back. Don't use it.... you lose it.

What's going to do more damage? A 100kg bike or a 600kg horse ? A bikes doesn't have the potential to lash out and kick someone or get spooked and bolt either !
My wife works at a farm that is at the end of a public road, which then continues as one of these rights of way. Once vehicles started using it, it became very muddy in places, so the landowner put down and compacted loads of road stone in those places to make the surface much better for drivers and riders. The same guy has cooperated with the local nature conservancy bods to encourage owls, red kites and other wildlife. Not all landowners are unfriendly.
"Why don't you get on a horse and do it?" I rode horses for about 20 years... these people still complain... In my village we had one safe place to cross a major road to get into the forest, that was by a dirt road with a street name and perfectly legal Only one house on that "street", guy complained about horses passing on Sundays to our gutless mayor... road closed for horseback riders... So the only way to get into the forest from the pastures was to cross a busy road known for speeding at a place where you couldn't see shit before crossing... People that live in these sort of places get too entitled and there is a reason why they chose live there in my opinion... they just don't like people and as a consequence... the feeling is mutual :p
The trouble with these snobby landowners is they fail to realise that before the dwellings they bought came onto the market they were either tied cottages for farm labourers our agricultural buildings on farms, along came a property developer and destroyed the same countryside they "love" so much by rapid expansion, and don't forget its alright to drive their cars up the same byways, and the byways went with the territory some of the ones I have used date back to the Medaevil period and still are as long as they have not been decommisioned rights of way.

The way to fight for our rights is to stay respectful and challenge illegal obstructions via the councils. You’ll find the councils don’t like people obstructing public access as much as you do! Unfortunately a lot of people take it into their own hands and it never actually gets reported. End result is the council doesn’t know there is an issue so can’t do anything about it.

Report them for obstruction of the right of way with their parked cars. Any member of the public can apply for a magistrates’ court order to force an authority to remove an obstruction on a public right of way. This includes footpaths, bridleways, restricted byways and byways open to all traffic. This procedure is covered by section 130A-D of the Highways Act 1980.
Its the same old crap, people have a house next to a byway and suddenly find out it doesn't suit them. I am afraid we are destined for a life of hatred from people like these who refuse to recognise its our right to use the byways. Well handled though buddy.

I am friendly to everyone and like to be a people person. I’ve had people yelling in my face and swearing it’s a joke just who do they think they are? It’s like they are entitled to treat you like this and the majority of riders I know of aren’t aggressive in anyway (riding style as well)

Look at the modification orders on the herefordshire government website they havent updated it yet its still down as a modification order and not passed however it was passed abit ago now our council arent the greatest for these kinds of things

The way she has everything setup, is a clear attempt to disguise the existence of the byway, thankfully she can never truly hide it. I would report her actions to the council as it's an offence to obstruct a byway.

Not necessarily, byways are a right of way, but they can be on private land, but they are not allowed to be blocked. You legally have the right to move any obstruction, but only as much as you need to get your vehicle through. I have met people like this once. It was very therapeutic, like when you are trying to get to sleep and there is some mooing in the background.
So, this guy is riding his bike on what's referred to as a BOAT (Byway Open to All Traffic), basically a road that anyone can use in any vehicle. The owner of the house at 04:37 has had their driveway illegally extended to the point where it overlaps on to the Byway. Think about it as if this person: prntscr.com/rsk6ax extended their driveway in to the middle of the road, same idea. She has then parked their little red Polo in the middle of said Byway, to the point where she is actually obstructing the highway, she then has a little whinge at the biker for driving on roads he is legally allowed to.

We own the farm below Knapp Green and have people coming through all the time messing up the ancient tracks made for horse riders and foot traffic only. Bikers hardly make any imprint when dry. Fair play to you for shutting all or our gates. We seem to have an Influx of people using these Byways recently and something needs to be done about it. If you want to see the countryside why not just drive the country roads instead of driving through people's estates...
@@jonathongreen7727 these are roads ive spoken to who i assume was your wife from that farm as i ride through there quite abit its our hobby we like riding dirt and seeing the countryside is a bonus we do shut all the gates that are already shut when we come to them (we being the herefordshire trf) ive led a few people thrpugh the local lanes but our guys wont ride fast through and we try not to cause uneccasry hard to the land i get the frustration with 4x4s but in all fairness it is a road... the reason i met your wife is because the route isnt marked up very well and was quite confusing the first time i went through and she had to point me in the direction if you want help marking it up so people dont stray from it asmuch me and the rest of the group woild be happy to help and if it doesnt cost too much woulc contribute to any signage or anything like that EDIT just re read what you said you dont actually live in the house the lane goes around if you own the farm below this shouldnt be a issue to you as there isnt any lanes going through that farm in particular unless you own the fieldfields up past it where the new gates are ?

We own the farm below Knapp Green and have people coming through all the time messing up the ancient tracks made for horse riders and foot traffic only. Bikers hardly make any imprint when dry. Fair play to you for shutting all or our gates. We seem to have an Influx of people using these Byways recently and something needs to be done about it. If you want to see the countryside why not just drive the country roads instead of driving through people's estates...
@@jonathongreen7727 these are roads ive spoken to who i assume was your wife from that farm as i ride through there quite abit its our hobby we like riding dirt and seeing the countryside is a bonus we do shut all the gates that are already shut when we come to them (we being the herefordshire trf) ive led a few people thrpugh the local lanes but our guys wont ride fast through and we try not to cause uneccasry hard to the land i get the frustration with 4x4s but in all fairness it is a road... the reason i met your wife is because the route isnt marked up very well and was quite confusing the first time i went through and she had to point me in the direction if you want help marking it up so people dont stray from it asmuch me and the rest of the group woild be happy to help and if it doesnt cost too much woulc contribute to any signage or anything like that EDIT just re read what you said you dont actually live in the house the lane goes around if you own the farm below this shouldnt be a issue to you as there isnt any lanes going through that farm in particular unless you own the fieldfields up past it where the new gates are ?

I will agree there are some motorised users nowhere near as considerate (you’ll find the same sort on tarmac too) but a blanket ban for ALL simply enjoying a legal hoody is unjust surely???
