Currently, there are only six justices at the Constitutional Court out of nine because three justices retired last October. This makes it challenging to judge President Yoon's impeachment case smoothly because Korean law requires at least six justices' agreements for any verdict. If the existing six justices unanimously make a decision, there is no problem. However, if, by any chance, they divide into two groups with different decisions, they cannot make any decision until new judges join so that they have at least six justices to make a decision, whether accepting or dismissing the impeachment. One justice among six is known to be pro-Yoon and may dismiss President Yoon's impeachment, though all the other judges accept Yoon's impeachment. The impeached acting president is being proven to be actively engaged in planning the illegal martial law declaration by the investigation of the police one by one, and for him, the best option is not appointing three justices so that he can block any possibility of making a final decision by the court. In this way, he can maintain Yoon's regime even in a weird way and avoid any treason charges on himself. However, this violates the Constitutional Law (Article 111(3)), which requires the president to appoint judges of the Constitutional Court selected by the National Assembly. In other words, the president has no right to refuse to appoint those judges selected by the National Assembly. The acting president doesn't have such a right, either. The second impeachment last night was for restoring the Constitutional order of South Korea by appointing three judges to make a final decision about the President's impeachment case as quickly as possible.
