Hey Buds!
Here's the scoop. I was grocery shopping in T'ranna, and by pure coincidence, stumbled upon a bottle of Coke, with "Out For A Rip" printed across the front. As you may or may not know, that happens to be the name of a song i wrote that made a fairly significant impact here in Canada. I also own the trademark for the phrase. (see link)

The bottle is being used as part of a music promotion by Coca Cola which allows folks to scan their bottle with their smartphone to bring up an online music playlist. The "Out for a Rip" playlist, for some reason, does not contain the song "Out for a Rip".
Soon after making this discovery, i was flooded with reports of these bottles popping up nationwide, and decided it was time to respond to this seemingly unlicensed use of my intellectual friggin' property. With my lawyer, Rob Kittredge, (RKIP.ca) I decided the best possible course of action would be to detail the whole ordeal in a music video that also serves as my legal demand letter to Coca Cola. I hope this answers some questions for all those who've been enquiring. Friggin' right on.

This is how a true Canadian settles a trademark dispute.

It's not about the language, it is that Coke is leveraging the popularity of b richmond to sell beverages. B richmond worked for that influence over his audience, and deserves to be paid by Coke for their access to that audience. That is the true function of licensed trademarks. When a phrase or slang is so strongly associated with a brand, musician or company, they can license it to prevent others from leveraging that phrase's connection, essentially gaining profits from the labor of others. To do so is actual theft, like making copies of a movie or music. It is immoral, unethical and illegal. But go ahead, promote your brand with the slogan "just do it." You'll get letters from Nike's legal department, I guarantee it.

@elquark0 It does matter if he's copyrighted the phrase. In that case, that line IS his property and as far as the law is concerned, he did invent it. If Coke wanted to use the catchphrase they should have done the legal work to ensure it wasn't copyrighted, or copyrighted it themselves before he did.
Too bad he already did that ages ago. He's well within his rights to send a cease and desist or sue.
Apple has a copyright on the apple logo, which is why you can't use it (see: iCarly) without paying royalties. If Apple had a company catchphrase, they could copyright that and sue anyone who used it.

I've shown people this as an example of the process of protecting your work with a cease & desist letter. And I've been asked a couple of times, what ever happened? Did Coca-Cola settle or just cease and desisted?
I've got one of the said bottles from a buddy in Miramachi Bay. I live in Wisconsin so we didn't get them here. Glad I was able to get my mitts on one before they went away 👍🏼

So many ignorant people in these comments. If you're so upset that they trademarked a "common phrase" used in Canada "way before this guy was even born", why didn't YOU trademark it then? They made it popular with their music video and filed a trademark claim first, so therefore it's their phrase in regards to marketing purposes. It's not like they're trying to say "no one is allowed to say this phrase ever", just that it can't be used for things that are sold for profit without a licensing agreement. They're completely in the right here and yes Coke is a massive multi-million dollar company but that doesn't justify taking whatever they want for their own marketing without permission or licensing. If that's truly what you believe then corporations will eventually own everything you possess including your own body just because they have more money than you.
Yet the fine bros try to trademark "React" and get shit on by the entire internet. Don't get me wrong, I support buddy, but I can't help but notice the ever so slight hypocrisy.
Trenton Pottruff I believe the reason Fine Bros got so much flack for that was because they were trying to make it so you HAD to go through their "brand" and license your video to even make one and post it online, let alone market it. In the case for "Out For a Rip", it seems to be more specifically when the phrase is used explicitly for marketing purposes. That's just what I've gathered from it, I could be wrong in saying that but Fine Bros definitely seemed to have much greedier intentions than Buddy.
The Fine Bros were trying to brand something that everyone was already doing. To me their actions were more like trying to set up a monopoly on a type of video production. It would be like Price is Right suing all other game shows for copying the concept of being a game show. What Coke did to b richmond was to leverage his audience that he worked to build, independent of Coke, and with Coke doing nothing even related, in order for Coke to make profits. Coke did this by using b richomnds registered trademark without compensation or consent. This is blatant infringement of richmond's rights.

ITT: A lot of folks who don't understand trademarks.
This is because most people have never produced their own unique intellectual property that they need to protect, and don't understand how said property can be "stolen" or leveraged by others to make profits while avoiding all the hard work, time and money to produce the results that you had to put in.
