      Clinton did not invoke immunity in 2001. He accepted a plea bargain. So there is precedent. Besides Holly Brewer, a professor of American cultural and intellectual history at the University of Maryland, said: “When designing the presidency, the founders wanted no part of the immunity from criminal prosecution claimed by English kings."

    Why didn't they ask rump's lawyer about the fact that when we talk about immunity, we are talking about what would otherwise be CRIMES? No innocent person argues for immunity. Sauer should have to explain why the president can commit CRIMES.

    It is so illogical and stupid that the Supreme Court hears such an argument. This matter is essential for the separation of the power of the three branches; a president does not have absolute immunity otherwise, we are in a Middle Eastern country in Cuba or in North Korea. How stupid.

      It also applies to every past president in my lifetime. All of them should have had criminal charges filed against them. It’s frustrating that they let all of them off the hook for war crimes and they come after Trump for something that’s not even a crime. If they rule there is no immunity, I hope to hell they come after past presidents too, but their past inaction process they won’t.

    The thing with "offical acts" is that they must conform WITH the Constitution. When the official act is anti-Constitution or contradicts or subverts the Constitution, then it is ground for impeachment and criminal prosecution. There's NO but to it. Article II, Section 3:, "he shall take Care that the Laws be faithfully executed." An insurrection against a new President who was elected by the majority of the people is definitely anti-Constitution. And the 62 voter fraud lawsuits were mostly dismissed or dropped due to lack of evidence or lack of standing, and not found in favor of the Republicans or Trump, and many of those were Trump appointed judges.

    Justice Thomas asked a question!! In the 30 years he's been on the court he has rarely asked a question during arguments. He didn't ask one question during the decade of 2006-2016. The last time he asked a question was in 2021. He woke up finally!

    The legal and constitutional ability of a president to pardon himself (self-pardon) is an unresolved issue. The Office of Legal Counsel (OLC) issued an opinion that concluded that a President may not self-pardon "[u]nder the fundamental rule that no one may be a judge in his own case." The issue remains unsettled and would likely require a constitutional amendment or a Supreme Court decision to clarify.

    When there is a hearing to become judge on the SC, the candidates are very clear that they dont opine on hypotheticals, only on cases.
    But in this case they are constantly talking "not about this case, but as a hypothetical". I do understand that you may need hypotheticals to state principles, but i struggle with the disparity of opinion. They opine on hypotheticals left right and center. Should they not focus on the case at hand??

      Allegedly means: "I think that the facts corroborate showing you violated a law, and a court ruling is pending on this."
      It's a legal term that can mislead many to assumption of guilt!
      I wish they would stop using the term as well.
      They probably have to because some of the rulings are pending and because they are before SCOTUS.

    IMHO official and unofficial acts need separating in the briefs before any kind of trial can proceed. If one "leg" is shared, then both need tried at the same time, maybe under two different Judges concurrently?
    Interesting: let's see how SCOTUS handles this.
