      I am not a cop and I know what the cop's problem is; He is a sadist in a rush to get a promotion. In this case he is actively attempting to illicit a negative response in an attempt to turn this into at minimum a resisting w/o violence or at most an aggravated felony stop.

    This video left me in awe. I feel so bad for this owner. I got pulled over in my Elantra N in my second week of owning it and the police officer was super relaxed and friendly. I admitted to the officer that I was speeding a little bit but he was mostly intrigued by the exhaust. I am also from California btw (Bay Area). The police officer politely asked me to open the hood so he can inspect the vehicle. I showed him how the car has different modes and he even let me rev it a little. In the end he let me go with no penalty and even complimented the car.
    That officer in the video was having a bad night and was drunk off his own badge. I hope the driver can resolve the issue without having to give up such an awesome car.

      This is partly why I live in the bay area. Most cops could care less about loud exhaust unless it's earpiercing loud. The problem in the LA area is there's so many moddified cars doing dumb stuff. Yea, we have side shows, but we don't really have a street racing scene, at least nothing like LA.

      How one person can remove an entire lineup of cars because of one being entitled.
      Serious, don't skip the number & data that backup the claim. The cops might have been 200 meters away & recorded this number. The kid just went full rev with the car in multiple instance.
      Whoever own that car, shoudn't even bother to defend this kid.

      @@heyaisdabomb This wasn't even LA area. This was in Riverside, which usually has more relaxed officers. So, this is pretty appalling behavior from the officer. He was in a power trip and it was caught on camera.

    I personally have no faith in Hyundai but the state is the problem in this case. A lawsuit needs to be filed against the police department and state regulated testing facility.

Those kind of cases that corner in big manufacturers are usually brought at the federal level. And the State would be aware it in the wrong

      @@stewart8127 The issue is that according to state law the vehicle noise level is to be tested in the "default" mode which does pass. The default mode is the one that the vehicle defaults to after a restart. The test center in this case requested that the owner place the vehicle in it's loudest setting which is incorrect.

      Finally nobody could get this resolved, and the vehicle failed subsequent inspections, and after nearly a year of fighting with Hyundai over this, they agreed to do a buyback of the vehicle and the owner got a 1991 Miata instead.

    For this situation, I would sue the Riverside PD, as well as the agency or office that does the inspections, and force the attorney representing the cop to show what statutes, if any, are the backing of the claims made by the cop. Also, force the state agency to show how the testing was done, and then prove it was done wrong. If no statutes are shown, and the documentation is that the car is stock, the judge should award a few things:
    1) An order enjoining the Riverside PD from enforcing any statute related to automotive exhaust systems
    2) An order requiring state inspectors to actually know what standards to test the exhaust under, and to be required to accept ANY documentation from manufacturers OR dealers that show a car has complied with state law, and is stock
    3) Go after Riverside PD for a cool $500,000, for the costs of being inconvenienced, as well as being unable to use property lawfully acquired.
    The only way you get public agencies to actually pay attention, is hit them in the pocketbook. And, don't hold back, because cops never do.

      Restitution and damages awarded to the public should come from professional insurance for police, like medical malpractice insurance. Cops that do their jobs as aggressively bad as in this case won't just be transferred to another district. It will be so expensive to employ them that they will never work in law enforcement again.

      Requiring private insurance for cops is something I've mentioned in the past, and is, IMO, not an unreasonable thing to require cops to have, if insurance is required for other jobs, like truck drivers or PIs.

      I say sue Riverside PD, Hyundai, the dealership, and the DMV and let them argue it out in front of a jury out about who is liable for selling a vehicle that apparently does not comply with the law and if it actually does comply with the law in the first place and if so who is liable for legal costs. It is absolutely insane that they managed to get stuck in a loop of bureaucracy with no solution but court.

    I'm a mechanic for this issue there is a simple solution go to the dealership and ask them to update the ECU with the latest firmware. And that is the repair. On the report say "Complate of loud exhaust by unqualified mechanic holding no certifications. "Specifically the cop" inspected the Car and preformed ECU update! Tested car and it preformed as intended in stock form!

      @@niyablake which is not how Society of Automotive Engineers (SAE) standard J1492 ( aka the testing method) is done. default mode, rpm sweeps up and down to see if it exceeds 95db at 50 feet from driving center line.
      this is either cop being jerk, or city/state trying to rake in more cash through bs charges.

I mean a part of the problem was the naive and too honest driver putting the car on track mode when he could've just said "I don't really know" or something, but well..

    They actually tried to pull something similar on a buddy of mine who had a stock Abarth 500. They actually come with no muffler from the factory and he had to get a signed letter from Fiat themselves saying that this vehicle came with no muffler from the factory.

      @@tylerwatt12 hopefully. In the meantime the system is broken. How can a car be manufactured and sold in a state where the exhaust "can" be too loud? Either it passes state inspection to be allowed to be sold in California and we are done with this matter, or it isn't allowed to be sold and California fucked up and allowed it to be sold here regardless.

I had a similar situation here in NY with a fishing lure, bought a fishing lure from a sporting goods store, went and used it, got a ticket for having treble hooks on the lure, even though it came with treble hooks from the store, turns out that you can't use them in certain waterways at certain times of year.

    That Officer absolutely needs to be on a final written warning over this. He is a bully. He clearly gets enjoyment and glee from telling this polite citizen that he’s is going to suspend his reg for too much noise. The psych evaluation that departments do prior to hiring an officer should’ve caught this guy. No one with this demeanor should be employed in a position of authority. This is what a sociopath sounds like. The excitement, the happiness, he is talking so fast he can barely control himself. He LOVED every second of making this kids life very difficult by taking his car away from him over such a small violation. A warning such as “so, for future reference, don’t run track mode on the street because you could get into some trouble. Have a safe night!” would’ve sufficed for most officers. But not canwright. He LIVES for throwing the book at people, it makes him feel important, because his father never supported him. He is clearly a Sociopath. Man this video pisses me off

    It also occurred to me that all the Riverside PD has to do is park right in front of the dealership and just cite all the N cars that leave the lot, or just go on the premises and cite all the unsold ones since they "know" they're equipped with that Track Setting and are therefore, illegal. That will NEVER happen as they know they're in the wrong on this. What they have is an arrangement of sorts with the local AG, the vehicle rep station and probably a congressman or two who love sticking it to what they consider the "other" side.

      All vehicles on private property are not subject the C.V.C. its only once they are driven on public roads can the law be enforced. But dealerships have "Dealer plates" since the vehicles are "never registered yet" so they can't do anything to them yet anyways.
      I am hopeful that Hyundai has to buy back and crush all these cars because of that one cop and one referee... I think that would be the news worthy event here.

      @@666chew This is a compounding problem that people aren't looking at correctly. Hyundai and the federal gov't probably did things correctly. But this officer in Riverside and his colluding buddy at the state referee have exposed a mafia like shake down of average citizens. In the process they have exposed that in fact when testing is done by our paid law enforcement folks, as "reasonable" people in the community the cop found the vehicle at low speeds to be making "offensive level of sounds" and the person specifically trained to do that one job of testing has proven that in FACT it was illegal. The car owner is not at fault and is the victim here... he should get 100% of his money back because of this discovery. Hyundai (much like VW) should be required to take the punishment of their profiting on illegal acts on purpose. CRUSH ALL the cars that Hyundai tricked people into buying.
      This is fraud at large scale by a manufacturer who should know better

      Doesn't quite work that way, if it did the police could wait outside any dealership and give everyone tickets for speeding since all the cars are capable of speeding or running stop signs or anything else, the issue here is track mode, if the guy hadn't admitted to running in track mode he might have not had this problem, kind of like when the police ask you do you know how fast you were going never tell them you were speeding, either refuse to answer or tell them you were going the speed limit and have them prove you weren't. once you say you were they can use that admission against you.

      But there's probably a law forbidding the exaust system from backfiring and releasing flames at the back. The officer stated he was stopping the car because the car was backfiring and after asked if the car was in track mode. At least the cop knew about track mode.

      @@Kagdar just wow, Hyundai's N line cars do NOT shoot flames. 1. MOST backfires do not produce flames, ive owned a Tuned Lancer Evolution, Subaru STI, Stinger GT, Veloster N, Civic Type R, NONE of them have ever shot flames ALL of them made popping noises, the Veloster N was the only one to do it in stock form, and its not a backfire. A backfire is when you have a rich air fuel mixture and excess fuel is detonated, MOST sports cars that have an exhaust that pops is due to a lack of backpressure when the throttle is closed, hence why it happens when you let off the gas. The car doesnt have a track mode...it has ECO, Normal, Sport and N mode, none of them are designated as track use in the owners manual, all any of them do is stiffen the suspension open a valve in the exhaust to let it make its natural sound and change computer settings for throttle response.

      @@Kagdar Elantra N doesn't have Track Mode. He just suggested this probably based on the cars appearance not actual knowledge. There's no way this car is shooting flames out. This is the exhuast stock form. I've heard numerous cars with V8's and up that are way lounder than this from stock. This is a joke. Never has it ever been a LAW for anyone not to drive in a preferred "Driving Mode" that's offered with the car. So then the cops should just sit and wait for every Elantra N and Sonata N sold and write every buyer up for the same violation. They already said it's not modified. Simple. What else is there argue.

      ​@@FdgIV99SpaceGhost Elantra N has active exhaust which changes the exhaust loudness and sound if you're on Normal, Sport, or N Mode.
      Probably got pulled over for the crackling and popping that happens in N mode. He had the state inspection done to waive the ticket but it was done in Sport mode which failed the exhaust noise limit test.
      In California it is simply illegal to have a loud car. So numerous v8's and basically every other loud car you can think of can be hit with this ticket. And if you have active exhaust, any exhaust mode or operating RPM which produces noise exceeding the noise limit is basically illegal as well. The Harley dopes and fartcan Civics ruined it for enthusiasts by being loud and obnoxious. In the same way those "coal rolling" pickup truckers are going to make it illegal to tune and modify the engine in any way.

    He posted another update that Hyundai gave him a hybrid loaner car and he has a lawyer and a court case for Feb 23rd. He still has to make payments on his N but Hyundai is giving him $500/mo towards it.

    I had a car accident and had a similar issue with the case managers not wanting to help. I told them if they didn't help I was going to get a lawyer, they didn't believe me, I got a lawyer and suddenly despite being informed to only contact my lawyer they were trying to talk to me and get a slip up. Needless to say I told the lawyer and never had to talk to anyone with that company again. They were in the wrong. The reason they reached out when they did is because they realized the likelyhood of them being represented with it going viral is high, and any arbitration possible would have to happen before legal help is retained otherwise they will be on the bill for anything that goes through the court. With all the right to repair laws and stuff this is another example of a car company refusing to fix cars. Although the repair is fabricated, they could have simply wrote up a paper for a customer that already paid them money to use a car.

    This same issue happened to a friend of mine in Rancho Cucamonga back in early 2000’s with his Acura Integra Type R. He was bone stock and it comes with DC exhaust if i am not mistaken. He ended winning the case in court because the Acura book shows it has that specific exhaust stock

    How come motorcycles can blow my ear drums out passing me. Sometimes they pass so fast it literally makes you jump. Not a good things while driving through traffic! Yet a car that is factory stock barely fails dB in a mode that the car is not in by default. It's a parlor trick at best. Make the exhaust sound sporty!
    Look, if this guy is running around and disturbing the peace by driving through neighborhoods and waking everyone up with his exhaust, then give him a ticket and a fine. Same as a radio played too loud. Nobody makes you remove the radio, they just say "keep it down from now on" so honestly I really do not get this.
    Again with the motorcycles... either it's an unacceptable sound level or it is not. I don't get why there are double standards like this.

      Your radio comparison really is true... It's a selectable mode, it's no different than me cranking the bass knob and rolling through the neighbourhood at full volume with the windows down. They don't tell you to get the radio re-programmed to max out at 1/4 volume, they just tell you to shut up, give you a little nuisance ticket, and hopefully you have learned your lesson.

      @@rdizzy1 That's shocking, where I live in Canada, motorcycles actually have a bit higher allowable DB than standard passenger vehicles. Then commercial vehicles are even higher than that. They all still get hassled regularly though, if a cop has decided he wants to give you a ticket, it's too late, no matter the status of your exhaust, stock or modified, or what his DB reader says. IF he even cares to test it... They often shove them right up the tailpipe here, like... at that close even a stock Prius would fail! But they have started more often now to not even test, as having a DB reading just gives you something to argue in court, they tend to prefer the Cops word vs Civilians word cases with no evidence on either side, as the judges always side with the Cops.

The dollar figures are all over the place. And then there is the business about driving the car in "track mode," and saying that there is a specific law against that. State law, county law, city law?     Seems to me if Lamborghini drivers do not go through this ( because they can afford good representation) there obviously isn’t a law against driving in track mode . So therefore if there is no legal means of enforcing this made up law . You should simply be charged with the loud exhaust violation period . I’m sure a good lawyer would shred this bogus ticket in court . Then also demand retraining for the officers on this subject via lawsuit for malicious prosecution.

      i want to really know what drag, sport, or manual mode, especially if the vehicle is actually manual lmao, has anything to do with the fact of a muffler or exhaust system being in stock form...cop here has too much time on his hands, and it does not help that he lives in his own world making up his own rules...392, mustang, and bmw owners stay in drag or sport mode, and their v8 and I6 engines are much louder than this...i'd go for a lawsuit aswell with those phony made up citations...

      @@ddrhazy they are "made up" when the vehicle is indeed stock from factory, and the noise itself is blamed on a specific driving "mode' and not an actual aftermarket bolt on parts like the exhaust, headers, intakes, and etc etc etc...for example, fix it tickets are only to be administered to people who have aftermarket, or deleted exhaust systems thus resulting in more "noise" and the Fix it is basically replacing the aftermarket exhaust system with a factory one...in this case here, the exhaust system itself is factory, so there is no "fix It."..even a 3 year old could understand this concept..

    I had been considering a Hyundai for my next vehicle, but with the recent events, between Hyundai not doing anything to help with this, refusing to issue a recall for the stolen car issue and instead putting it on the owner to pay to install an immobilizer that should have come with the car, and reports of cars that caught fire just sitting in garages I don't think I can go with a Hyundai sadly. It's a shame, most other automakers are making boring cars now, but if the company is either creating cars with dangerous defects or is not willing to back its customers, then I don't think they are a viable choice sadly.

    It’s really sad that Hyundai wasn’t really willing to do anything to help but the real problem is the state of California the officer issuing the ticket, as well as the state referee. Dude flat out lied and said the dealer is gonna have to remove track mode which is absolute BS as well as the prices he pulled out of his rear. And he was absolutely delighted to potentially completely ruin somebody financially. I personally don’t know too many people who can afford to have a $37000+ car they make monthly payments on to just sit around and do nothing. All while he didn’t do anything illegal, and the car is completely stock! You would literally think there was some sort of personal issue between the driver and officer if you didn’t know any better!

    The State used wrong mode for testing, per their regulations.
    His issue is with the State, not Hyundai.
    How many N cars are registered in CA, that pass inspection.

    Funny how he knew the car had track mode on it. I bet this is a go to ticket for them. If it’s illegal to operate it in track mode in California then it should have never been sent to a California dealership. Or a service bulletin should have been done to all registered cars so they could bring them in to disable them (I’m sure some type of software update would take care of that). Kinda like back in the day if you bought a car in California they had to have some type of special emission that was the best in the USA on it to even be sold.

      It's called n mode, but it doesn't necessarily mean track mode. At least that's how it is in a veloster n. They have similar modes and customization. Besides, track mode doesn't mean you can only use it on the track. More of a recommendation as the suspension gets stiff and sucks on public roads.

      It’s just a hot hatch that makes a few pops, much like a Focus ST, or a Golf R. My i30n Fastback is tue same thing essentially.
      No road cars come with modes illegal to run on roads. Even in California.
      Making a load of exhaust pops in a built up area is bound to get tue wrong type of attention though.
      Not only is the cop a nasty individual, he clearly knows nothing about cars 🙄
      In Europe, we’re not allowed standard exhausts that ‘Pop n crackle’ these days!
      I had 2015 3.4 and 2018 2.5T Cayman GTS that made quite a racket!
      My 2021 makes no pops at all ☹️
      You CAN mod them legally in the UK though 😃

      There's no track mode in any of the N cars. You can check the site and it has nothing about it.. now you can say "track ready" like it says on the site. N mode is just another fancy word for Sports+ because all the settings on the car can be changed Normal, Sport, Sport+. The issue is a lot of people are not very knowledgeable and if they hear a loud exhaust or pop/crackle they automatically think its custom. IMO the N cars are mild, I've heard Chargers, Challengers, Mustangs and all that are 5x louder and no one bats an eye. I honestly would not have touched sport mode when he did the inspection or I would've done N custom and put exhaust on Normal. Keep it on normal and let them test it. He might have used the term track mode and the officer immediately thought oh you're not on a track, this is illegal! because there are high performance/super cars that legit have a "track" mode setting.

    This officer is DRAGNET certified, as that's what you need as an officer/deputy to send someone to the state ref (they don't give out those stickers on the back of the cite unless they're dragnet certified). It DOES NOT matter if the vehicle is 100% STOCK - if the vehicle has different tunes made for the track, then yes I'm sorry but you can get sent to the ref for using track mode on the street. The only way to fix it is to get your ECM reflashed by the dealer to take away that mode entirely. The demeanor of the officer does not mean anything in traffic court. He had PC to pull them over and issue the citation. Does Cali have some stupid laws, yes, but I'm sorry this guy is not winning this one.

    Well if you watch a review of the Elantra N. You'll find out to get the "popping noise" the cop pulled him over for. Has to be turned on by the driver in the information center of the car. It does not come on automatically.

    TBh, there's nothing Hyundai can do. It's a BS CA law brought on by street takeovers. This exhaust law was only created by the hooligans taking over intersections. This incident could have happen to a BMW M2 Competition owner, a Supra owner, etc. There's absolutely nothing a car manufacturer can do in this situation, since this law was initially created to curb street racing, and street takeovers. This is a prime example of government and State overreach.

    Honestly the court case is simple and he and actually sue the state ref and the cop for this. His car in track mode is too loud, but not in normal mode. The citation shouldn’t have been so harsh because we’ll all the officer to do is tell him not to put it in track mode since he knew himself it was too loud when in track mode. This should be a simple case of filing a lawsuit and especially for the inconvenience caused for suspending his license

    Obviously they were doing enforcement for that particular violation on several cars. You can see the other motor Officer has someone else pulled over as well. From this observation, we can assume this is a “problem spot” for cruising. The vehicle in front of the Hyundai owner appears to have modified exhaust as well. Thanks to all the Fast n Furious copycats and the street takeover problems, it is now a misdemeanor to modify your exhaust in the state of California. It used to be a “fix it ticket” but no longer

    Some people outside of California might want an Elantra N. Sell the car and have it shipped if the owner can't get through the Cali red tape. Hopefully Cali reinstates the registration once they know the car is out of state. Or move to a state that doesn't have ridiculous auto laws. I'm in Florida and might be willing to buy the car myself if the guy is willing to discount it off list price because it is "used" and help with the registration. I would want to talk to an attorney first to see what reinstating the registration involves.

    Have a mechanic or the Hyundai dealer unplug or short out the sport mode switch, such that it no longer is selectable. Write the invoice as "delete sport mode." Retest the car. Whole lot of a holes in that state.

    I wonder if they could get the dealership to at least on paper replace the OEM stock muffler with a OEM stock muffler. I know it sounds stupid but if he had a piece of paper that said a "repair" was done he could get it tested again.

If it fails that then yes Hyundai has an illegal car and in my opinion its Hyundais problem and they need to issue a recall. But long story short move out of california and you wont have this problem.

      @@bigdogbigben yeah I get that. It should’ve been tested that way the first time. I think the issue is he can’t get a retest unless he gets documentation saying it was repair. Hyundai won’t repair because it’s stock. So he could either challenge the test in court. Or challenge the ticket in court.
      I admit it would’ve been smart for him to not say track mode as it isn’t a track mode. The owner definitely goofed that up, but I believe he was trying to be open and answer to have good faith in the officer not being a huge asshole. Buts that’s hindsight

    The car has a certification sticker, affixed under the hood. It will state what emissions rules the vehicle complies with. If it hasn’t been modified, and the dealer certified it, take it to a lawyer and let them sort it out. There are way too many hands in the pie, and making inquiries really isn’t helping. Take it to a lawyer, show that letter y’all got from the dealer, let the lawyer handle it.
    If y’all aren’t familiar, I can email a photo of what the certification sticker looks like. In my car’s case, it is affixed to the actual hood, on the passenger side nearest the windshield. Every car sold in the US has such a sticker affixed. Where it is, however, can vary from manufacturer to manufacturer. Your owner’s manual may have where to look for the sticker. NO vehicle sold becomes illegal due to the presence of a “track mode”. The track mode, is still compliant with those rules listed on the sticker. It is illegal to sell a new car that does not FULLY comply with the listed regs.
    Have a look here, as this is the EPA’s guidance where to find the sticker. It is unequivocal proof that your vehicle complies with emissions standards. Coupled with that letter that the dealer found no modifications, the state has NO GROUNDS AT ALL to hold or revoke your registration:

      To "Protect and to Serve" is just a motto. I remember there was a contest to come up with a slogan for a local police academy in CA way back in the day. The winning motto was submitted by a police officer, which was "Protect and to Serve." This motto became so popular, that it was adopted by hundreds of police forces around the country.
      The primary duties of a police officer is to enforce State, and local laws. With Federal police enforcing Federal laws. They're not there to protect us. We're responsible for protecting ourselves, which is why I'm a staunch supporter of 2A.

    I've had an encounter with Officer Canright myself, he rolls around school zones on a moped looking for anyone to go over 25 so he can claim children were present. He is a condescending, disrespectful and honestly terrible "Officer" that will find any excuse to give you a citation. In fact I'm pretty sure I saw him just the other day so I flipped him off, he pointed at me and then made a U-turn to try to get behind me and catch a minor moving violation, to his dismay I was one turn away from home lmao.

    My wife and I bought 2 brand new Hyundais for $48,000 Palisade and $38,000 Santa Fe the same day and they would not even add a tow hitch for me. Then on the first oil change for the palisade, the oil change kid messed up the O ring causing 2 quarts of oil to leak out. I was so pissed that I traded my santa fe in for a ford F150.

    Pretty sure all cars have to be less than 80 decibels by law and as long as it meets that criteria and there isn't a California law specifically saying that cars cant have track mode then he should be clear. They did the same with a hellcat not too long ago. But he may have to start a lawsuit to get a case started. I guess manufacturers will have to start selling California only models again.

      95 db for all cars less than 6,000 lbs. 80 db is for motorcycles. Basically all these cars with loud exhausts come with these active exhaust settings which make them quiet enough to use until switched off.
      And well despite what Faz Man here thinks, these types of noise ordinance laws are picking up steam across the US and Europe. The whole reason active exhaust systems were even created in the first place was to fit noise ordinances which were enacted years ago. Even the Nurburgring Nordschleife has a 95 db limit which has existed for 10+ years now.
