The doxxing dilemma - avoiding unintended consequences

  • This video addresses the current debate about how to deal with 'doxxing' and concludes with a rant about the woeful public consultation on the subject engaged in by the Commonwealth Attorney-General's Department.
    The Commonwealth Government has suggested that doxxing should be criminalised or form part of a tort of invasion of privacy. But could this lead to unintended consequences, such as protecting and encouraging anonymous online abuse? Would it lead to investigative journalists being prosecuted or sued? Would it prevent political scandals from being exposed? Would it foster the spread of misinformation on the internet, undermining our democratic system? Any such offence or tort would need to be carefully designed to avoid these consequences.
    A more sophisticated and considered debate is needed - but the current public consultation by the Attorney-General's Department has not provided it. Instead, it has confined itself to asking loaded questions, in order to produce the outcome it wants. It's not good enough, and this video shows why.

    I hope you took additional action and sent your comments directly to the Minister (who I thought was going to be quite good, but has proven to be something of a “damp squid”), the Opposition AG and all the members of the “Teals” group. This proposed legislation is typical of the laziness of modern governments. Thanks for another interesting video.

    Ah that felt good. There should be more ranting about the AG’s handling of the Privacy Act review. A public consultation should not be used to merely legitimise predetermined outcomes.
