  • Coming off of a recent presentation at the Virginia Workers Compensation Commission Conference, Workers Compensation and Personal Injury Attorney Joe Miller here summarizes the basic law as to what you must prove in order to have a compensable claim if you become a victim of workplace violence. He also explores the notion that in some cases, depending on the evidence, it may be in your best interests to prove you do NOT have a compensable claim. This way, you can avoid the exclusivity provisions of the Virginia Workers Compensation Act and potentially pursue a claim for money damages before a Jury in a regular Court of Law, as some recent folks have done or are trying to do in a couple of famous cases in our local area.
