This has been happening to me where usually he pays me every friday like we agreed but once a month he forgets payroll and I get my paycheck a week later than I was expecting. This time my car note auto drafted so now I have an overdraft fee and tomorrow ill get an extended overdraft fee. All the department of labor has to do is make your employer have to pay you more for being late and I gaurentee you everyone would magically start getting paid on time. The irony is my employer told me I can be fired for being a few minutes late, meanwhile he has no issue paying me late. Personally I believe every day you are paid late your employer should have to pay time and a half for the days they are late.
In California it only applies a penalty each day for 30 days if you are fired or quite. I’m not sure what state your in. Otherwise every late pay check is a penalty.
@@ramonsmediablog I live in Las Vegas, Nevada. As an update, I actually did end up filing a claim in July because I got fired and he refused to pay me my final paycheck. I got a letter back from the office of the labor commissioner with my final paycheck roughly 2 weeks after filing my claim with evidence. The letter also say that "this check is considered partial payment" and it states that the investigation is still ongoing. He paid me 3 weeks late this time so I hope they are trying to collect penalties too.
