      I disagree. If the two auditors weren't wearing face masks, he would be quick to arrest them for "trespassing" despite the two men filming from a public sidewalk. And I don't think you realize that all those SFPD officers are committing a felony under California Code, Penal Code - PEN 25300 by concealing their face _while_ carrying a weapon.

      (a) A person commits criminal possession of a firearm when the person carries a firearm in a public place or on any public street while masked so as to hide the person’s identity.
      (b) Criminal possession of a firearm is punishable by imprisonment pursuant to subdivision (h) of Section 1170 or by imprisonment in a county jail not to exceed one year.
      (c) Subdivision (a) does not apply to any of the following:
      (1) A peace officer in performance of the officer’s duties.

      Isn't it funny how dispensaries were considered ESSENTIAL during last year's lockdowns, while gyms and playgrounds were closed down? If cannabis dispensary employees can violate the rights of two videographers filming from a public sidewalk, then it makes you wonder about how corrupt the system really is.

If the security guards who murdered Mario Matthews and Angel Zapata Hernandez were never even CITED for assault, much less charged with manslaughter, then why on earth would this dispensary guard be charged with anything in the event that he had gotten violent and decided to lay hands on the auditors?

      That security guard was a loose cannon for sure. Unfortunately, believe it or not, security guards are given almost qualified immunity status by the courts thanks to their employer paying off prosecutors and police departments. So if the guard had been violent, he would have gotten away with it and SFPD wouldn't have done anything. They would have claimed that he was acting under "good faith."
      Why else were the guards who murdered Mario Matthews by violently restraining him and kneeling on his neck NEVER charged with manslaughter? Allied Universal even defended the actions of the guards by claiming that Mario was trespassing (he had entered a PUBLIC building called the Golden 1 Center) and that he was "threatening" the guards, even though no threats were captured on audio and the video footage showed Mario trying to _get away_ from the security staff. So the part about Mario -- a 125 pound transient -- "threatening" them was a lie since even if he did so, it was done BECAUSE security staff were after him.
      Derek Chauvin went to PRISON for doing the exact same to George Floyd, while the security guards who knelt on Mario Matthews's neck weren't even cited! The same goes for the security guard and MTS code enforcement inspector who knelt on the neck of Angel Zapata Hernandez and ended up murdering him on site. The names of those two security employees working for the MTS transit district were never even released!
      Long Island Audit has a couple videos of security guards assaulting him at PUBLIC buildings, and the responding law enforcement officers excuse the guards' actions by claiming that the guards were acting within the scope of their duties and didn't INTEND to inflict harm. The system is so corrupt that rent-a-cops are given more power than uniformed law enforcement!

Auditor guy should had used de-escalation techniques to calm that crazy guard down instead of raising his voice. Now the cannabis business can use that against the auditor by stating "Auditor was attempting to provoke a altercation" should things ever get to *Civil Court.*

    I've conducted hundreds of audits and have experienced many intense encounters during these audits. However, I've never experienced anything quite like what you and I experienced that day. With the way the security, staff, and even the customers were behaiving, I wonder if they were selling more than just marajuana in there.       Security guards, especially those working in retail settings (often as "loss prevention" or "store detectives" to get around the state guard card requirement), are failures who couldn't make it through Police Academy. It speaks wonders, though, that the police EXCUSE their violent behavior by claiming that the guards were acting in "good faith."

      They don't know the law, though. The legality of conducting videography from a public sidewalk is something which is even taught to Allied Universal guards. It's like knowing that two plus two equals four. But I guarantee you that those same SFPD officers arrest individuals who walk into PUBLIC libraries maskless.
      SFPD refuses to do anything about homeless people throwing bottles in your front yard, but they WILL arrest you for not wearing a mask at the library or school board meeting while London Breed parties maskless.

    I swung by there a few days ago and there was a different much more chiller guard working the door. Not sure if this hyper agro guard got fired or was just off that day, but hopefully 2one2 learned their lesson. Definitely needs to be a follow up audit on them. Good work!

      You are incorrect. The guard in the video was working for Intervention Group, which is based in Oakland. I contacted them, and they watched excerpts of what we filmed. They further stated that the matter had been addressed internally "...and to the satisfaction of our client." Moreover, when I mentioned calling intervention Group, the guard referred to them as "My boss."
      Are you suggesting that the Intervention Group logo on his uniform is fake or that the dispensary owns Intervention Group? What is your source of information?

    NO CONCENT REQUIRED TO USE THEIR IMAGE. One thing that causes confusion is the concept of requiring releases to use a photograph for a “commercial” purpose. A lot of people (understandably) take this to mean photographs taken to make money for someone. However, in this context, commercial really means something more along the lines of for explicit advertising or marketing purposes, e.g. the photo will be used in an advertisement.
    Most other uses are considered editorial, even if it is some supermarket tabloid. The photos still, at least in theory, need to be taken in a place where there is not expectation of privacy i.e. public venues. Generally, courts have held that while in a public area that is viewable by third parties, there is no reasonable expectation of privacy. “There is no law in the US that prohibits making video recordings of people in a public space without their consent. In addition, if the purpose (commercial or otherwise) is in the nature of journalism, the First Amendment kicks in and overrides the personality issue. This is why paparazzi may take photographs of famous people, even without their consent: the photographs are of journalistic merit and thus may be used, even commercially, without the consent of those photographed. Anything shot in public is free to use for editorial or artistic use. And anyone newsworthy is editorial.
    There are some limited exceptions, but in general, a photographer can use any photo they take on their website, in an art gallery, or sell prints of that image as a work of art without a model release. You can resell it, you just can not use it to promote a product. Anything shot in public is free to use for editorial or artistic use. And anyone newsworthy is editorial. In the United States, photographs that are taken for editorial use in a public place generally enjoy Constitutional protection under the right of free speech. Even though the laws vary from state to state, all privacy law must permit uses that are protected by the First Amendment of the U.S. Constitution-freedom of press and freedom of expression. These rights outweigh an individual right of privacy. Consequently, even if a photograph is licensed or sold for a fee, it will not be “commercial use” under privacy law if the end use is an editorial (newsworthy) or expressive use (such as a photograph displayed as a work of art).

    Look at all those yuppies claiming that the auditors were "antagonizing" the guard. Didn't they see the guard make contact and harass the videographers about filming...something they have the RIGHT to do?
    More auditors need to test security guards as they're NEVER held accountable for their actions. If Officer Tou Thao and Officer Kueng were sent to prison because they did nothing to help George Floyd, then why weren't the guards involved in the death of Mario Matthews ever sentenced?
    We need to defund (BAN) security guards and retail loss prevention instead of defunding the police! It's power tripping rent-a-cops who violate your rights more often than the police do. So-called "private citizens" are also much more likely to use excessive force than the police. And I bet that NONE of the people at 2:39 would have defended the guard had he been a police officer because apparently, it's okay to violate other people's rights so long as you're a security guard and NOT a cop.

    The guard could be arrested for PC 422. When he came at you in a violent and threatening manner, the requirements were met. Physical contact is not necessary for a criminal threat. Officer Sabella doesn't understand that. He also doesn't understand that loitering is possible on a public sidewalk. The loitering laws were originally instituted to discourage acts like drug dealing and prostitution on the sidewalk.
