- Here is a First Amendment Audit of the Port of Oakland, where reactions to my filming varied significantly.
The Port of Oakland is public property owned by the City of Oakland. It leases portions of its property to various companies. This video was filmed entirely from areas open to public access. At no time did I set foot onto land which is leased by a terminal operator or any other private entity.
Notice: This video consists mostly of dialogue. Many viewers may find it to be excessively long and boring. However, I believe that getting people to understand the purpose of First Amendment audits is an important element thereof. WTF? The woman guard is intimidated? Is she in the right line of work? Just asking. A camera is like pointing a gun? Why not explain that part of this is to educate? To show them that they have no right to privacy in public, and that photography is not a crime or a threat. That they have no right to issue orders, intimidate you, or threaten you (as he did twice) for doing something perfectly legal on a public sidewalk or easement. If they are so timid, they need more than a chain link fence. If they're too cheap for that, it's their problem.
How can someone who literally sits in a booth with 13 monitors surveying everyone not see the hypocrisy

Cameraman is also endeavoring with his efforts to protect all U.S. citizens' rights, as well as the Security Guards Constitutional Rights. Please look at the larger picture...of all of us as U.S. citizens. Thank you.

With all the bullshit today, I was driving home and randomly thought of this security guards words and it rings true today. Respect to the both of you.
I can tell most people commenting here didn't see the whole video. Much respect to both of you for communicating your points for the most part in a cordial and civil way, for understanding each other and for overcoming the initial insults. F Dailey said things he didn't even have to say about his personal life and that made me respect him even more. He got the point at the end which is what counts.

Both made solid arguments. This was a good conversation. Rudeness was the price to be paid to exercise his rights. Sometimes you gotta be rude to protect something more valuable. Rights outweigh rudeness, so that doesn't make OP a terrible person. It's fair to decide not to waive your rights just because someone perceives it to be rude. These kinds of videos will help educate people more to practice respecting peoples rights and find other ways to deal with uncomfortable situations rather than resorting to attempt to squash someone's rights, which is a scary phenomenon that OP did mention in the video.
I'd much rather live in a country of freedom with both rude and kind people rather than an opressed state which mandates kindness and outlaw rudeness.
I keep seeing people say this was nothing more than provocation... I can only imagine you missed the point OP made in the video. It's not enough to just be asked politely and expect someone to leave. Being polite doesn't make you right, it just makes you easier to talk to and yes it is preferred way to be cordial... but when it DOES become cordial, that doesn't automatically mean that you must suddenly expect someone to do what you tell them. That kind of expectation is like the creepy entitled "nice guy" syndrome that some people have. Just being nice doesn't entitle you to everything. OP made a point to go to that point and beyond that point because of that very reason.

The one guy said you're not gonna get a show, I'm not so sure he was correct about that. Taken as a whole the video was epic. Both of you had good points. Maybe I'm biased but I think more ppl are gonna have to break out cameras so we all learn, not just the cops, what a very wise man once said, "it's just a camera, man"

This was great... except for the first guy and the coward that hid in his car. A few minutes of offensiveness turned into a great conversation.

The poster brings up a good point I had not thought of before. We are being filmed constantly when we are in public.
Being uncomfortable doesn’t mean you can violate the constitution.

I think the auditer could have been more polite to Mr. Daily, at times. Daily was being really decent. He seems to be a really, really, good man. Maybe when the employees are respectful the auditors should seek to acknowledge that and find common-ground. Educate, don't retaliate. That man is an ally. As for the a-hole tough guy in the car, he deserves no respect at all, unless he were to apologize. At the end, both parties end the exchange with mutual respect and dignity. Great video!

I'm a Bay area native and besides the fact that these people need to be a little more educated I liked that fact that the police were very calm ,collected and professional.
If you're a security guard who cant confront a suspicious person, you need a new job.
I really liked that black guy and thought he was speaking very sensibly, apart from when he said that pointing a camera at someone is the same as pointing a gun at someone. Especially after saying that he didn't mind having a camera pointed at him and being photographed. Long video, but totally worth watching. Thanks for this video, I learnt from it.
"Don't come on this side of the fence." He forgot to add: "Don't smoke, brush after every meal, avoid fatty foods, exercise regularly, call your mother as often as you can."
I have never understood how many people love and support the government surveillance state but freak out when a single citizen has a camera. And these same people all work at places with hundreds of video cameras.

Ok if a camera is intimidating the women in the booth then why does she work in a place that has more cameras then most towns. She gets filmed her entire day but when the camera is held by someone then she is uncomfortable. Don’t believe it you notice how he said it is okay to film then starts arguing why he can not do it.
Because the cameras filming her the entire day, their footage doesn't end up on RUclips.
That is actually one of the most impressive response from security I have ever seen, until he went on the "how do we know you aren't a f*ing terrorist" and just had to go too far. If he had stopped with the original shaming strategy.
If the security guard woman is so easily spooked then she's in the wrong line of work. The last thing the world needs is more under trained, fear motivated, cowards in a perceived position of power.
If you're so frightened by being videotaped in public, then don't work in public in a position where your job is to interact with the public. She's an idiot and so are you.
To me, a woman in a booth who's intimidated by a camera is not a woman. And I can say that - I'm a woman. :-) And who was that security guard AFTER the cops came? Classic 180! Stay safe!
If the female guard is intimidated by someone recording from a public space; she should find another occupation. Good job on your part and the cops were professional as well.

Bother's me that somehow a female security guard being scared is more of concern than if a male security guard is scared. Why would it matter the sex of the worker, they have the same job and same expectations/qualifications?

So a camera (eyeballs) recording to a SD card (brain) is scary, but the millions of people who walk by and record, with their eyeballs and brain is okay, but walk by with a camera, and you are scaring the female security guard? Maybe she isn't fit for the job if her co-worker has to defend her..

That's kind of the point. This backlash kind of started with the Patriot Act post 9/11. People got arrested for taking part in an AmTrak train photo contest. Free Speech zones, "In this day and age" talk and everyone being a terrorist jamming everyone up over a power trip. People are pushing the law to the limit because the little square of freedom kept getting smaller and smaller. The guy responding knew what this guy was attempting to do and rather than being cordial and respectful he decided to be a dick. It's his right, he can be a dick, but he probably shouldn't be working with the public if he can't keep a cool head.
Police filming is whatever but I really dont get the point of filming people that are just working and not bothering anybody

I think this was a good audit for the most part, although some of the conversation became heated it turned out pretty cool I think they should have coffee together! Even the police officers who arrived especially the Asian police officer was very cordial indeed!
