      I was impressed the Hispanic Judge knew the defensive attorney for those boys would use a warrant issued by him to have case thrown out. Like he said, It's an important case. Get it right.

      The basis for the warrant was flimsy, but the detectives thought a Hispanic judge would be sympathetic to their request. They thought they could play on his ethnic sympathies, but he wouldn't have it.
      That's why I said they went judge-shopping.

      A lot of judges have large case loads (most courts in the US are backlogged by months), so it it may be more likely that judges would rather do a bare bones analysis, trusting the cops, and end up rubber stamping it.
      If the cops had enough for a warrant, they save time to spend on their actual case load. If they don't, the judge won't be held responsible anyway, as judges have absolute immunity from suit involving any "judicial action" they make.

    For those playing at home: If you come to court to show your support for someone who is one of the parties being sued or charged, the best thing you can do while the judge is on the bench is to stay still and stay quiet, maybe smile and wave at your friend, but that's it. Don't be like this gallery, don't make any noise that can mess with the stenographer, and don't make eye contact with the opposing party, the jury, or the judge. Judges can and will have you removed for any reason. The court is not a popularity contest.
    I have seen a defendant try to not only sway the court with a crowd of supporters, but the supporters were also duped into trying to intimidate the plaintiffs. The judge was LIVID. He made it crystal clear to defense counsel and the gallery that if they made another sound they would be immediately removed, and that they were very close to breaking federal law (witness tampering). Defendant handily lost that case, because not only were the facts not on his side, he had as much respect for the court as a fallen dictator.

      I sat in on some court proceedings once. The judge really didn't have to do things to maintain order among spectators. The bailiff was all over people for the tiniest infractions, such as standing up or using a cell phone.

      Unfortunately I had to opportunity to be present at a court case to morally support the victim(s). I clearly remember the judge thanking us after the verdict for keeping our composure during this emotionally challenging times. He said "we've seen families react in much different ways"

      @Thrifty I think we were in different jurisdictions. I would imagine courts handle this particular thing differently. I never saw the bailiff move or speak, but the gallery's main offense was rowdy applause. I would imagine the bailiff in the courtroom I was in would tackle anyone who entered the well without permission, though.

    I hate that teenagers get a reduced sentence or reduced bail for the reason that they have a "bright future". They've proven that they are capable and willing to commit violence.

      @@StarFighters76 People's brain's don't fully develop until they're 25. Teenagers are, while not incapabale, less likely than someone over 25 of making a rational decision. It's not an excuse, it's a scientific fact. That said, kids who commit serious crimes like murder and such I agree shouldn't get reduced anything.

      Anyone who doesn't think teenagers aren't capable of sociopathic or psychotic behavior clearly doesn't remember their first 12 years of school, especially elementary, middle and high school. Nothing says "capable of causing trauma" like kids who haven't figured out that they're not immortal and they're not invincible...and good luck with having parents who aren't too busy or neglectful to tell the kids what Right and Wrong are...

    I like to think that the amount of attention that these clips have been getting is part of the reason they are reviving this show for season 21.

    A couple of the parents were crying when their kids were sent to jail because they show everyone how stupid they are because they believe their kids are innocent despite the fact that they're complete monsters and it's like what that prosecution attorney said the parents are unwilling or unable to watch over their kids and make sure that they're supervised so for all the heartache and sorrow that those parents got they deserved at 10 fold.

      People think of criminals, they think of monsters, someone "other". They don't consider that the person has hobbies, interests, loves. They're a criminal and that's their whole identity. So if you know someone and to you, their identity is "kid I changed diapers on who's headed to college to become an accountant" it's impossible to redefine them in your head as a criminal.

      Reminds me of the video a lady posted of her confronting the cashier at a Starbucks drive thru for using the lady’s card info and going on a shopping spree. The young girl was saying she didn’t mean to do it and was begging the lady to not report her because she was a good kid in school and was on the swim or soccer team (might have been something else, but it was a sport).

      Just looked it up, only 3-5% of Argentines have African ancestry and even among those most have only 1-10% African ancestry.

      @@xyPERSON Fontana wasn't bad, but if I had a choice between a marathon of his two seasons with all of Briscoe's seasons on Law and Order, I'll choose Briscoe.
      No offense to Dennis Farina, but Jerry Orbach was a tough act to follow, I'd think that would be true no matter who replaced him.
      In all fairness though, I still preferred Fontana to Nina Cassady. I don't think she was mentioned again after her one season, she was just gone by the following season. But considering the way she bungled the case with the senator, I think it's safe to assume Van Buren took away her badge, or rather the higher-ups did, anyway.

      @@yucol5661 It's a little bit more nuanced than that, I think.
      If a family with school-aged children moves to the US, the children are not only allowed, they are required to attend school. The one complaint that that might draw is if an immigrant family is larger - has a large number of children - than the smaller family size that is the standard in the US nowadays. They might be accused of being an unduly large draw on public educational resources.
      Children born to immigrants - even if they are illegal - are automatically considered US citizens, due to SCOTUS' unfortunate reading of the 14th Amendment. As such, their public schooling is as unquestioned as that of any US citizen child.
      That's a fact and I am sure he knows it.

    Spoiler:
    Verdict:
    In the account of murder of the 1st degree: Not guilty (Regarding another hispanic man found dead with the same MO)
    In the charge of attempted murder against Oswaldo: Not guilty
    In the charge of assault in the first degree: Guilty
    Story takes a sad turn as Oswaldo, guy from the start, dies due to his mother signing a DNR (do not resuscitate) when signs pointed to him not ever recovering. McCoy and his two lawyers decide to go for the throat this time with 1st degree murder charge since the man passed away. The episode fades to black and we are not shown what comes out of that case. It's strongly hinted that they might win considering the circumstances and that the overall narrative has changed since Oswaldo ended up dying from the assault.

      Short answer is that they're unable to prove that the kids were responsible for any of the murders, and the kids only get convicted with first-degree Assault for Oswaldo. However, Oswaldo's mother, Maria, after being informed that Oswaldo will almost certainly never wake up, takes him off of Life Support and he dies. Now that he's dead, they can upgrade the charge to a murder and because the kids have already been convicted for the Assault charge, getting them convicted for a murder will be extremely easy.
      The episode ends with them wondering if Maria knew that they would be able to charge the kids for murder if her son died, but McCoy decides it doesn't matter. "Everyone games the system."

      @@jdrancho1864 I guess so. I don't think that the episode explained what she did with the body after. It's possible she could have had him cremated in the states and then had his ashes transported back to Honduras.

      @@KhaosN7 It doesn't matter to the case. It's just the way my mind works, I have this thing about answering questions that nobody asked and filling in negative spaces.
      It's just that I've heard of many instances of immigrants dying in the US and then getting repatriated to their home town. That's often at considerable cost 'coz shipping a body costs more than getting on a plane as a passenger.
      In many Catholic countries cremation is frowned upon. The preference is to have a proper funeral with a corpse in a casket being lowered into a grave.

      Shipping a body seems so hard and expensive that I wouldn’t be surprised if the mom just gave up and said her goodbyes without taking the body

    That appeal to suppress makes no fucking sense, since they're charged WITH a hate crime. If it was just murder, I /Could/ see that but seeing how they're being accused of targeting Latino men and killing them, wouldn't the video be relevant to the trial?

      @@GroundScarecrow The defendants only get convicted for the assault on the first victim and only get six years. McCoy convinces the first victim's mother to take him off life support so they can recharge for first-degree bias murder. That's the end of the episode.

I just don't understand bringing in a completely new character into the scene one ever talked about like the victim's mother. Plus the wife is the next of kin.       Either he doesn't have a high opinion of illegals, non taxpayers who he may view as not as hard working as him. Or possibly he thought at first it would be big press to help someone and then be good for his buisness, but when he heard it was an illegal, he decided he couldn't be bothered. It leads you to suspect he could have been a racist. But he doesn't have to be. Just someone who decided its not worth helping his fellow man because there was no money in it for him.

    08:21 -- Law & Order, rightly or wrongly, taught a generation of Americans that judges casually toss out obvious evidence just because lawyers ask them to. Often with a bored tone of voice, like it was just a ritual before they all go golfing together.

    If you think protecting your kids from the consequences of committing violent and hateful crimes is the way to help your kids, you should not be a parent, can’t imaging sitting there and wringing my hands and crying because my kids were being rightfully punished for harming someone rather than wondering how I raised someone with so much hatred and the willingness to hurt people as a result

    8:37 even after he explained it, I still don't understand how the videos could be suppressed? The videos show that the kids are prejudiced against latino men and have beat them in the past, how is that not relevant to the case? He says it would prejudice the jury against the kids... yeah?!     I'm pretty sure if intentionally killed someone I could keep it together for a day or so, if I accidently killed someone, you would find me sobbing next the body confessing and saying sorry.
    How hit and runs happen boggles my mind.

      Well, this show has been known to play a little fast and loose with procedure.
      Video and audio recording is technically hearsay under rules of evidence (hearsay is generally not allowed but there are a ton of exceptions), obviously that's not what the defense argued. I don't know if "this is prejudicial" will actually stick in Manhattan, but I'm not an attorney.

      One of the three kids involved flips on the other two, but they find out that a juror was listening to an anti-immigrant podcast in the jury room and the remaining defendants are convicted of assault but not attempted murder. Then Oswaldo’s mom takes him off life support and the DA’s re-charge the kids with hate crime murder.

      Their lawyer pushed that the videos were not part of this case (different incidents, stretching that they were unrelated) and that they would taint the jury and prejudice them against his clients. And because they're "good boys, with promising futures" (ie athletes), the judge was ball-less and allowed it. Same sh*t as Brock Turner; they 'didn't want to ruin his future', so he got off with barely a slap on the wrist.
