Which is why there is no English style law of trespass in Scotland and people have legal right to roam. There are, of course conditions to the right to roam. Personal privacy is protected and that means you cannot roam in close proximity to a dwelling and you can trespass on such as railway lines and MOD property but I suspect these have more to do with personal safety and danger. It is a modern law that no private person can clamp or two away a vehicle parked on private land and demand payment for its return from the owner as they can do in the Kingdom of England. It is probably like other legal matters - full of grey areas.

Its a work in progress. The highlands are pretty sterile, it shouldn't look as it currently does. There should be more biodiversity, broad leaf trees and animals but the land is kept barren for sport shooting by the few who own the large estates or littered with non native Scandinavian pines for timber that support hardly any animals. There is a land tax being debated in Holyrood at the moment that would slowly tax the rich per acre of land they own making it a poor investment to continue to hold money in large land ownership here. We then get first rights to buy land back for those of us who live here full time and we can return en masse back to our highland homes making it anew :)

This has been like this all over Europe for centuries. The Monarchs and Oligarchs owned all the land and used the peasants for slave labor. I think they call it crown land or something of the sort. Anytime they cut timber from the land, they have to pay the Queen.

Some would argue that one owns land (originally) by creating value from it, by using it. If a farmer tills previously untouched land and grows, say, wheat there, it becomes his by virtue of his being the first to work it. Scotland will get another referendum when the fog of Brexit clears and the Scots have a clear will for it. You'd wish to devalue the pound even more? Especially considering you're going to be using that currency as an independent country.
It hasn't even been 10 years since the last referendum. A referendum isn't a general election, it is supposed to emulate the will of the people, not the whims of the losing side.
The Scottish parliament is elected by real proportional representation, so the apart from undemocratic English interference, the Scottish own Scotland.

Its a work in progress. The highlands are pretty sterile, it shouldn't look as it currently does. There should be more biodiversity, broad leaf trees and animals but the land is kept barren for sport shooting by the few who own the large estates or littered with non native Scandinavian pines for timber that support hardly any animals.
There is a land tax being debated in Holyrood at the moment that would slowly tax the rich per acre of land they own making it a poor investment to continue to hold money in large land ownership here. We then get first rights to buy land back for those of us who live here full time and we can return en masse back to our highland homes making it anew :)
Most of us applaud the present system.

It sounds like these rules might incentivise that. You cant have a community buy up your land if there is no community.
This has been like this all over Europe for centuries. The Monarchs and Oligarchs owned all the land and used the peasants for slave labor. That's why many Scots and other peoples fled to America where they could have their own farms. In Canada, a dominion of the Monarchy, the Queen owns 89% of the land still today. I think they call it crown land or something of the sort. Anytime they cut timber from the land, they have to pay the Queen.

I’m mean “ owning land” is perhaps the most natural thing to own. Lions packs,l for example ‘own’ territory which they defend.
Some would argue that one owns land (originally) by creating value from it, by using it. If a farmer tills previously untouched land and grows, say, wheat there, it becomes his by virtue of his being the first to work it. Of course now land is bought and sold, but thats one of the original arguments.

I thought that William Wallace fought a successful revolution against England. It was my understanding that Robert the Bruce then took the Crown and promptly made land deals with England for powerful Scottish clans and power in England. I guess those deals still stand today.
