    Rooster Teeth has addressed the design and changed the art for the gun to be less like Chris Lee's Dust Trivolver. This will be the version printed in the physical release as well.

      As a huge fan of both rooster teeth and game theory I am disappointed to see a former theorist making a big deal out of a big misunderstanding. Rooster teeth has clarified that DC does the comic and RT just proof reads it and they weren’t aware of Chris lees work and since they have acknowledged the issue you can’t badmouth them the way you are! I expected more from a theorist and fellow Rwby fan!

      Ren Amamiya That would be fine, except that they weren’t referencing it. Citation is different from plagiarism. Taking a fan design is different from making a reference. They didn’t at all link the actual creator of the design to the artwork, which would be done if it were indeed a reference, nor did they address the issue or update the comic.
      This is not a reference. This is theft.

    People wondering why they didn’t just ask permission, the answer is simple: didn’t want to risk having to pay the creator a single cent; They didn’t want to brave the HORRIBLE risk of asking a fan if they could use their design and the fan *gasp* asking for compensation

      When it was posted online as a "RWBY weapon", that made it a derivative work, and RT could use it without permission. Saying thanks would be nice - and because RT has done that in the past with fan-made content, I suspect DC's involvement. Not excusing RT for this, but the comics are DC's work, and RT really doesn't seem to be involved. They don't seem to even know what's in them for the most part.

    As a comic artist myself, I’m going to play devil’s advocate here. There’s a real chance that the artist was simply looking for references online to make the world as Canonical as possible, not realizing that this Trivolver was fan made. Again I’m not condoning intellectual theft of any kind but I’m willing to give the artist from DC the benefit of the doubt here

      That's what I believe honestly.
      If this came from DC, they might not have known.
      I recall a commission where I kinda had to use a previous commission as a reference and accidentally drew something that wasn't actually a part of their character and was just there as a part of the scene.
      *shrug* I mean. If it wasn't that way, shame on them, but this COULD just be an honest mistake and with the way they're changing it out, I feel like that's the case. As critical as I am of RT recently, I don't think this one was done intentionally.

      As an RPG industry freelancer who has worked on big-name IPs, I have to agree with Infinity Art. This is likely an honest attempt at research that was done a little too quickly. And that sort of language on their TOS has to be there. It has to, to protect them in the cases where parallel ideas do occur. Most companies historically have had a policy to return unsolicited submissions unopened, for just this reason. Since the only similar alternative in the modern age is to just forbid the posting of fan art or story ideas, their TOS must contain language that protects them.

      Yeah I dont think anyone on earth is losing sleep because an artist at DC decided to spend at most 5 minutes drawing a weapon a fan made based on their intellectual property. They should feel grateful someone at DC even did this rather than throw up some kind of temper tantrum or stir controversy over this nonsense. At the end of the day all I can see is that this is either about money or egotistical notoriety.

Food recipes are one of the most wildly distributed and used forms of art on earth if not the largest, everyone steals and uses other peoples dishes and culinary tips, tricks, etc without due credit globally so yes why do you need that credit? Can you remember the first chef to work with noodles? Do you even remotely care? I'm going to assume no to both of those questions.

      @@acthoundentertainment The point was that it's still pretty messed up. The food analogy makes sense because like with art it's not illegal (as long as no copyright or whatever on art) to take it without crediting. It's messed up and several youtubers have done this. I really don't get your noodle argument though since a lot of dishes use the techniques to make noodles for their own original recipes. I wouldn't want someone to be credited because I made chicken alfredo in my own style. Like with art you borrow some techniques to add to your own. I still do this now to try and find an art style that suits my taste.

    I agree that a knife gun isn't a complex or even original design, but the design and coloring of the knife in addition to the triple barrel revolver and the knife covering the sight is highly suspect. Due to their terms of service, this is totally legal, but it's still a scummy move imo,
    I'd also like to apologize about this not being up yo my channel's normal standards. I quickly put this together since I'm currently working on other, much larger, videos. I hope those will make up for the images in this one being so static.

    Rooster teeth got very corporate after WarnerMedia bought them.
    They have certainly lost a lot of what had made them special and their willingness to screw over their own employees, contractors and even fans has really let them down.

      @@Threads_Of_Fate RT's main focus is obviously the show it self, pretty sure they just give the creators of the manga and the comics just a general lay out of how the story goes. And even if RT was involved, it would be the blame of who ever was over seeing the work, until that's known, the full blame should be on DC comics since their the ones who are making the comic version.

    I bet Monty would be ashamed to see his work tarnished like this, especially with his amazing talent and imagination to even create RWBY to begin with.
    Both Monty and RT started as internet nobodies and skyrocketed to internet stardom in certain fandoms. With Monty sadly gone and not able to defend his work RT should be trying harder to protect his memory and legacy.

      Monty left his notebook at RT after his passing which has the original ideas for volume 4-6. RT just didn’t follow his ideas and rewrite them, nowadays real RWBY fans are leaving RWBY cuz they know that RT only cares about pleasing the toxic “fans” with new character’s clothes design, which RT thinks they can win back the original fans.

      @@Gloomdrake The axe I don't really believe. What we got with Team Bronze didn't completely match with the art that he claims it was taken from. Turning the sniper barrel into the handle of the ax, and the handle of the sniper rifle into the ax head, isn't hard at all to think of.

      Honestly as an artist I think there's 2 possibilities to why this happened, 1. They actually did it on purpose to show to the community, or instead, the artist did without knowledge of it's superiors, or, 2. They actually crunched their artists, that one just took the first reference that saw and shipped it without proper examination...
      Honestly Idk which one is worse

    Mad respect for Drake on this one. I don't know how deeply things like PR and networking run or how complex it can become. To me it seems like a huge risk to criticize not one but two major companies your business model is connected to. Especially since alot of comic youtubers either have or aspire to have close working relationships with arms of various publishers. This could lead to alot of work or remove opportunities. So, whatever differences of opinion I have with Drake. He's the fucking man for sticking to his guns.

    On legality, this is for the roosterteeth website and refers to works that are "submitted" to Rooster teeth. If Chris Lee submitted/posted his concepts on Rooster Teeth's site then he is bound to them. Just because you post something on RUclips doesn't mean you agree to another site's terms of service.

      Connor Lewandosky re read the legal agreement, any and all derivative works on any media platforms is covered in their agreement. legal wise, if it's labeled RWBY, it's RT property.

      Connor Lewandosky legal wise, by using RWBY content, you are agreeing to the clause, but I agree completely that from an ethical standpoint, it is wrong to use the content without giving credit. I believe the update says they are changing it.

    I think I speak for most artists, fans, and everyone in general when I say I wouldn't mind if I had a design of mine appear on something as long as I'm credited for it.
    Otherwise, it's basically stealing. Even if it's a fan made design.

    Regardless of TOS and regardless of if he submitted it to RT, it's not illegal to draw a rough sketch of an item seen in a 3d animation uploaded to youtube. Copyright does not apply.

    I personally don’t like rooster teeth. They produce, in my opinion, subpar shows, and since their acquisition of death battle everything has gone controversial to the extreme.

    That Dust Trivolver looks suspiciously similar to the DenGasher (a weapon with six components that can be arranged into a sword, rod, axe, gun, boomerang and naginata used by Kamen Rider Den-O and a few other riders) in Gun Mode. The Aura Ax (the axe blade part of the DenGasher) is even in the same position as the blade of the Dust Trivolver.

    Thank goodness they removed the revolver for the trade, stealing art is really freak'n scummy. Even then, the wand Glinda uses makes more sense anyway, I can't ever recall her using an actual gun on the show.

    Btw terms of use are not legally binding. Especially when they conflict with actually copyright law. So all the legalise is just bs. I’d sue if they did that to me. Especially since the gun itself is not inherently linked to rwby and is just a general trick weapon design, easy to plug into any medium. Clearly the rwby team had no right to use it without contracting the creator. Sue them.

    People are really quick to jump on the hate for RT and DC when the reality is that the fault lies solely on the artist, neither company probably would have known and the artist would have needed a design for a pistol and stole it and any editorial would have either assumed it was a pre existing design or an original design of the artist.

    I remember a time when something like this would be looked as good. fan art being used by the creators meant that the creators saw your work, liked it and thought it would fit in the world perfectly. I remember when people wished their original creations could get into the series they like. That being said if RWBY has referenced the artists they took the designs from prior, then the should do it now still

    I agree that it would be nice if the creator was in the credits, but people do have to keep in mind that there are like 100.000 fanart design of rwby teams, weapons and semblance out there. It's hard to design a new wheel. Something will always resemble something that's already invented. BTW Lee's design is also inspired by some simular weapons.

    Wait their policy doesn't account for his designs because they are on his RUclips channel which isn't owned by Warner Bros who owns Roosterteeth and DC but is owned by Alphabet Inc, which isn't owned by Warner Bros. If they're talking about fan art on any website, then that's complete BS and everyone knows it. Companies don't take fan art without credit. In fact most of them would hire them if they are really good. That's like going on Reddit, those forums, Twitter, and weird NSFW websites and taking that art/concept and not give credit.

    Shows are allowed to take fanart. You don't own the IP, they do. It sucks but they can cause it doesn't go under fair use, unless its a parody which is fair use.

    Yeah this does look much more like straight up copying the concept than simply taking inspiration. I'd understand if it were just a multi-chambered gun, but the design itself is IDENTICAL.

      @@nobody-xh6ii Except he does. The terms of service ONLY apply to what's submitted to the Rooster Teeth site. These weapon designs, to my knowledge, never were. Meaning that this is in fact theft and the artist should receive credit/compensation.

    On top of that they gave it to Goodwitch, the character they basically burned because of their interactions with her voice actress.
    After a former employee released a letter detailing his disapproval with how they were handling his friend Monty's (recently deceased at the time) work there was blow back. He claimed that the new heads of the show were making mistakes and going against the designs of the original creator, not to mention his complaints about the working conditions and demands on him and his team. Afterwards the voice actress for Goodwitch joined him claiming that the grievances were valid and true. From there she had a few more heated complaints about the companies habits and she was fired, her character all but being written out of the show. Which is a real shame because I imagine most fans would have liked to see how she was handling Vale in the aftermath.

      I mean she also went on a tirade on Twitter about how RT had no apparent support for its female employees during her time there while simultaneously claiming Ashley Jenkins only got to where she was in the company because of her relationship with Burnie and also demeaning the accomplishments of other ladies in the company and playing "no u" with people who said she was being unfair to Ashley but go off I guess.

I'm just wondering what brought her to the point where she wanted to air what she viewed as a bunch of dirty laundry to the public.     I'm pretty sure the artist just Google'd "RWBY revolver" and Chris' design was among the first results and they just thought it was an official design, especially since it was gonna be used for just one panel and is not even meant to be the main focus.

      Bubble Butt I don’t think that he “didn’t an idea” for the story or character. That would be unlikely. I believe that he just didn’t have much talent as a storyteller. That is not the same. I can have an idea for an epic war scene, where giant rock Yetis march into battle with mountain tops as clubs as weapons. Doesn’t mean that I have the talent to write it cohesively.
      Monty’s strength was at his action choreography. In looking at a scene and asking himself: “what would make this more fun?”. This is a valid and important ability to make something great. But he always lacked end goals and how to get there. It was part of his animation philosophy. He said, that he didn’t really plan any of his epic fight scenes out too much. He just did what looked cool at the moment.

    Playing Devil's advocate for a sec: I honestly feel that this more just a rushed artist combined with a lack of editorial oversight. However, is it actually possible for an IP owner to steal fan works, considering their derivative nature? People may see the word "derivative" as inherently negative or insulting but it's the most accurate descriptor. Fan works are derived in whole from existing works with a connection to them. They are advertised on that connection with nothing that truly separates them from that original work.
    I know that some might cry "Fair Use", however I'm not sure it applies. Fan works are rarely (if at all) transformative enough and could easily be confused with official media. A company or creator could easily shut down a convention's artist alley due to copyright infringement and be well within their rights (although they wouldn't because of the backlash).

      I disagree. Immensely. Most classic art is fanart if the Bible.
      If you draw the Eiffel tower do the Parisian government own that piece? Of course not. And this isn't even that at all.
      This person designed an all new weapon. It IS intellectual property. No one but him gets to claim the creation rights. It's one thing to make money over it officially, as he is not the creator of RWBY. This is not fanart if an already existing weapon. If you commission an artist to create concept art for you, they get credit and monetary compensation for their official use. That's how art business works.

      The guy combined different things to make something new, so that deign belongs to him. It is a RWBY fanart, but still HI original design. If we go by your definition RWBY owes money to dead German men for being based off of Fairy Tales. It is taking something existing, and transforming it with your own creativity that makes it Intellectual Property.
      The comic lifted his design without any changes. THAT is plagiarism.

    I don't see how this is a DC or Rooster Teeth problem. It's clearly on the blame of the artist and artist alone. They have editors sure, but I can't fault the editor for missing a reference to a little channel that didn't have that many views (before the incident).
    On the other hand, the artist knew what they were doing and just went with it. Punish the artist, not the writers, editor, DC or RT.

    I really like how you handled this video Drake. Calm and to the point with that was happening, and while you gave your opinion it wasn't flooded with tense emotions that others could be swept up in! I do hope Chris gets credit for his designs, but seeing your update that the comic at least as a different colour and design for the gun will have to be enough in this case.     If I had to guess at what happened here I'd guess that someone working on the comic saw the gun in the past and it registered subconsciously and they drew it, realised they done goofed and have changed it. It would make no sense for a company that's very open to fan content to suddenly steal what is after all a very minor piece of artwork

    Oh, man I just realized that the Dust Tri-volver looks almost like Vincent Valentine's Cerberus and Kaze's Magun from Final Fantasy VII and Final Fantasy Unlimited.
    All three are essential triple barreled revolvers. Although I think the Dust Tri-volver resembles the Magun the most. Also I am a little upset too, that DC and Roosterteeth didn't give Mr. Chris Lee any Credit or citation when Chris Lee himself cited how he had was influenced by Cerberus and Finnick's trident at the end of his video. Come to think of it he makes sure to cite every inspiration at the end of his videos.

      the knife-sight is the damning thing, though. chris had the decency to cite the cerberus and it looks different enough that it isn't an exact copy ( note the coloring and the aforementioned knife-sight ) while DC/RT has this suspiciously too similar gun design in their own comic
      very disappointed in DC. i thought they were better than this

    Although didnt he just upload it to youtube? How would RWBY have any write to use it if it was distributed or published on another website entirely? Since if that excerpt just applies to their website then it wouldnt matter if it was on youtube since Rooster Teeth is only using RUclips to distribute their work not the other way around meaning theoretically they should be following RUclipss guidelines not their own since that only applies to their website, correct?

If this was true then RWBY wouldnt have to even state the guidelines they did in this video if that's how copyright works nor would it even be considered stealing then. Since regardless of its title and similar concepts it still belongs to the guy who made it, heck, RWBY doesnt own transforming weapons, that's something you need a patent for. Otherwise Kingdom Hearts an anime inspired video game with transforming weapons like RWBY is an anime inspired cartoon with transforming weapons, if that was the case then KHs ideas and weapons should be owned by RWBY by that logic. Heck, even that title part is ridiculous considering that would still be plagiarism regardless of the title since they only have rights to the title not the item made which is the point of this discussion. Heck, this argument comes across as an excuse to justify something as my first point previously debunks even if it should really only apply to their website and not youtube since they dont own anything on there and have no grounds on what can or cant be made on this site only their own especially when none of us have signed a terms of conditions here that carries over to RWBYs site that's why terms of conditions exist to act as contracts in trade of a service something RWBY cant give us on this platform since they have no power to distribute it or cant because its youtubes site not theres.

    ...me personally I Get the back lash. But not really. It's one gun design as a shout out showing that they see fan art. If it was me I'd be buying a dozen copies to show my friends. That doesn't go for bigger pieces where by copying a fans art your stealing the entire style and composition of an artist but to make a big deal about this without taking a deep breath and allow them to "make it right" to the fan.

    May or may not be the case, but I wonder how often people get “inspired” by fan art or otherwise someone else’s work and unwittingly just copy the idea because they forgot about the source material. I remember hearing a story about this and a guy getting caught. He fought the idea of such a thing until he saw the original piece and admitted that he basically ripped off someone work. Wish I remembered where I heard this or read this.
    I remember a long time ago the Extra Credits guys said their main writer wasn’t allowed to check fan mail lest he be influenced by fan suggestions and ideas for games. If he accidentally used a fan’s idea, then he may have had legal backlash. At least that’s the idea from what gathered.

    That bit in the Terms and Services is bog-standard legal boilerplate that pretty much every website that allows the submission of user content uses. It's specifically designed to allow the company who owns the website to display said content on the website in whatever format is necessary. Without this legal boilerplate, the company in question would not legally be able to create and display thumbnails of user content images, among many other things.
    It does not grant them the legal go-ahead to take a design created by a user and put it in a comic book.

    Just to be clear: the sniper-axe is from a fan-made team. Rooster teeth had a contest for fan-made team to be used as one of the tournament losing team. The creators of the teams knew they could be used and agree to it when submiting their team design and weapons. I believe, in this specific instance, your blame was misplace and if thievery there was for the sniper-axe, it happen before the RWBY team used it.

    You know what, As a comic artist, it's hard enough as a comic artist to make a living. Most of the time most comic artist (or illustrators for that matter) have to have a day job just to try and make the comics thing work. The idea that companies that hire and employ people are lifting concepts from people who are essentially working on fan projects and getting paid nothing is really upsetting. This industry would be nothing without the creativity of the fan communities that surround them. The sad part is that the "professionals" that eventually ascend (in spite of the chances of failure) aren't even pulled from the fan communities that love these franchises so much. In short, the ones that benefit from this sort of nonsense, in a lot of cases weren't even fans of the franchise to begin with. They have no real skin in the game. This is just another project for them to work on that can generate revenue.

    I'm at a point in my life where the notion of owning an idea is absurd. And even if I did, the moment that idea is passed onto someone else, no matter how closely they copy it, it immidiatly becomes something else as a result of moving into a different intellectual environment.
    For the purposes of operating in the world, I accept that certain idea are "mine" -- but I don't cling to them. If someone else wants them, they're welcome to it and are often in circumstances where the content is of better use than it would be to me anyway.
    This is not true of most people.
    RT and DC needs to be more careful about exploiting these ideas because the artists in question are more than likely to take it the wrong way. Even though most of them would love to be involved with the project in that way, the idea that the ego can claim credit for what it produces is a very deeply ingrained social game that has to be respected if you're going to cooperate with them as consumers.

    Problem: in a DC comic that Rooster Teeth has allowed to be made (for both entertainment and funding purposes probably) a fan weapon was practically shown.
    Solution: don't just shit on the companies involved, do some research,and compare the designed weapon with the drawn one.
    Conclusion: more then likely, DC, as they make the comics, saw this guy's work, then thought it was okay to use it (since he was a fan). This lead to this problem and now both companies (Rooster Teeth most definitely) are getting bad reps for some pretty bad ideas on both ends. DC for this... "Odd" looking comic of RWBY that doesn't look to be in the canon and weapon theft, and Rooster Teeth for even letting them make this comic.

As well most of RWBY's concepts are not even original. it is like saying RWBY is owned by the people that own the rights to fairy tales that they used to make the main characters.
