You want to use the sound, not the midi so it wouldn't matter. But to answer your question, the midis I use are either mine or free to use, or under creative commons, or non-commercial licence. My videos are also under the fair use doctrine. At the same time, I don't make money from of my videos, so it's a bit irrelevant at the end of the day.
